Bodies engaged in counterintelligence activities have the right:

1) determine the organization and tactics of counterintelligence activities;

2) involve individuals in confidential cooperation;

3) create secret facilities (enterprises and organizations), as well as use documents that encrypt employees, military personnel, confidential assistants, departmental affiliation of units, organizations, premises and vehicles;

4) freely enter the territory and premises of organizations at any time of the day, as well as the territory of special–regime, high-security, strategic and other facilities of the Republic of Kazakhstan of significant state importance, with notification to their heads only for conducting counterintelligence activities provided for in Article 11 of this Law.;

5) to use the property of individuals and legal entities during counterintelligence activities with their consent;

6) involve, in coordination with the bodies authorized to carry out operational investigative activities, the forces and means of these bodies in conducting counterintelligence activities;

7) use the assistance of officials and specialists with the necessary scientific, technical or other special knowledge;

8) to carry out actions imitating intelligence and subversive activities during counterintelligence activities;

9) make proposals to eliminate conditions conducive to the implementation of intelligence and subversive activities;

10) use special and other technical means and equipment intended for conducting counterintelligence activities;

11) exercise other rights provided for by laws and acts of the President of the Republic of Kazakhstan.

The Law of the Republic of Kazakhstan dated December 28, 2016 No. 35-VI SAM.

This Law defines the legal basis of counterintelligence activities and the system of guarantees of legality of their implementation.
