Statement
The reason for our appeal to you is the blatant injustice and lawlessness in the Police Departments of the Yenbekshikazakh district of the Almaty region. The fact is that earlier in the proceedings of the UP of the Yenbekshikazakh district, a criminal case was initiated by the ERDR for No. 201940031000554 dated 03/14/2020 on the grounds of a crime under art.189 Part 1 of the Criminal Code of the Republic of Kazakhstan (embezzlement or embezzlement, that is, theft of someone else's property entrusted to the perpetrator).

Subsequently, more than 1 year has passed since the initiation of the criminal case, but to date there has been no progress and investigation of the criminal case by the police officers of the Upbekshikazakh district. Whereas Part 2 of Article 192 of the CPC of the Republic of Kazakhstan stipulates that the pre-trial investigation in cases of inquiry should not exceed one month and two months in cases of preliminary investigation. Moreover, when we applied to the UP of the Yenbekshikazakh district to familiarize ourselves with the case materials, firstly, we were not answered by the statutory deadlines, and secondly, we learned from the duty station that the case had been dismissed. Accordingly, we subsequently filed a Complaint with the Prosecutor's Office of the Almaty region, where we received a letter that the Decision to terminate the criminal case for the absence of a crime was canceled by the district prosecutor's office and at the moment the case has been accepted into the proceedings of the UP of the Yenbekshikazakh district for additional investigative actions.

According to the above-mentioned material of the pre-trial investigation, the staff of the UP of the Yenbekshikazakh district is still very negligent, moreover, we believe that the Police Department is inactive. In this criminal case, the requirements of Article 24 of the Criminal Procedure Code of the Republic of Kazakhstan were violated, that is, a comprehensive, complete and objective investigation of the circumstances of the case. In addition, the criminal case was unreasonably terminated several times. We are saddened that in our country there is such a practice that officials, law enforcement agencies and judges begin to consider cases objectively only after contacting a higher authority, posting information on social networks and creating a public outcry. We are extremely outraged by the irresponsible actions of incompetent employees of the UP of the Yenbekshikazakh district of the Almaty region, which discredits the good name of the Police. Based on the above violations on the part of the staff of the UP of the Yenbekshikazakh district, we believe that it is necessary to bring to criminal responsibility for violations that are stipulated in art. 370, 371 of the Criminal Code of the Republic of Kazakhstan, this is Inaction in the service, that is, the failure of a person authorized to perform government functions, or a person equivalent to him, or an official to perform his official duties in order to extract benefits and advantages for himself or other persons or organizations, or harm other persons or organizations, if this entailed significant violation of the rights and legitimate interests of citizens or organizations, or the legally protected interests of society or the state. Also negligence, that is, the failure or improper performance by a person authorized to perform public functions, or by a person equated to him, or by an official, or by a person holding a responsible public position, of their duties as a result of unfair or negligent attitude to service, if this has caused significant harm to the rights and legitimate interests of citizens or organizations or protected in the interests of society or the state by law. Also, the investigator's action/inaction and the above facts lead us to the idea of corruption in the ranks of the UP Police Departments of the Yenbekshikazakh district of the Almaty region. Which contradicts Article 366 of the Criminal Code of the Republic of Kazakhstan. Based on the above and guided by the Legislation of the Republic of Kazakhstan, I ASK YOU:
To assist in the logical conclusion of the ERDR criminal case No. 201940031000554 dated 03/14/2020;
To bring to disciplinary responsibility responsible police officers of the UP of the Yenbekshikazakh district of the DP of the Almaty region for non-fulfillment or improper performance of their official duties.;
To respond to the application within the time limits prescribed by law and provide an order to bring responsible employees to disciplinary responsibility.
