Complaint about actions (inaction)
On September 18, 20__ of the Department of Economic Investigations in the Almaty region, we submitted an application to the Department of Economic Investigations in the Almaty region (hereinafter – DER) with a request to conduct an audit of the activities of the LLP __________________ and KGP on PCV "__________________ to establish the fact of embezzlement of budget funds. Subsequently, we repeatedly went to the DAR in order to receive an answer to our application. However, we still have not been able to receive a response to the application. In accordance with art . 8 of the Law of the Republic of Kazakhstan "On the procedure for considering Appeals from Individuals and Legal Entities" (hereinafter referred to as the Law):
1. An application from an individual and (or) a legal entity that does not require receiving information from other entities or officials or an on-site inspection is considered within fifteen calendar days from the date of receipt by the entity or official. 2. An application from an individual and (or) a legal entity, for consideration of which information is required from other entities, officials or an on-site inspection, is considered and a decision is made on it within thirty calendar days from the date of receipt by the entity, official. In cases where additional examination or verification is necessary, the review period is extended by no more than thirty calendar days, which is notified to the applicant within three calendar days from the date of the extension of the review period. According to paragraphs 1 and 3 of paragraph 1 of Article 9 of the Law, subjects and officials, within their competence, ensure objective, comprehensive and timely consideration of appeals from individuals and legal entities and inform applicants about the results of consideration of their appeals and the measures taken.
By virtue of Article 17 of the Law, violation of the legislation of the Republic of Kazakhstan on the procedure for considering appeals from individuals and legal entities entails liability in accordance with the laws of the Republic of Kazakhstan. Based on the above,
I ask you to:
1. To bring to justice the guilty officials of the Department of Economic Investigations in the Almaty region for the late submission of a response to the application of an individual. 2. Respond to the application within the time limits prescribed by law.
