Grounds for derogation from the principle of equality of spouses' shares in common property
According to the requirements of family law, the court may withdraw from the beginning of equality of shares in order to protect the interests of minor children. This is possible in cases where one of the spouses did not receive income for disrespectful reasons or spent common property to the detriment of the interests of the family. As a rule, no such evidence is provided by the parties. In this regard, there is no deviation from the equality of shares.
The decisions presented for generalization did not reveal any facts of deviation from the principle of equality of shares in the property of spouses when dividing in the interests of minor children with the allocation of specific property to them, which would be necessary specifically for children.
