Issues of division and allocation of living space
The issues of division and allocation of living space relate to the provision of housing for citizens. An analysis of judicial practice shows that, in general, there is a common practice in the republic of dividing the living space belonging to spouses.
Most often, the division is carried out in kind, in the absence of consent to the division, the court determines the procedure for using the premises according to the relevant statement of claim.
Considering that participants in common shared ownership have equal rights in relation to common property in proportion to their share, the court, when allocating a share in kind, also transfers to the owner a part of an apartment building and non-residential buildings.
