MOTION

FOR ATTACHMENT OF VIDEO RECORDINGS TO THE CRIMINAL CASE FILE

At present, pre-trial investigation is being conducted, based on the statement of Ka R A, against Aa Sh D under Part 3 of Article 188 of the Criminal Code of the Republic of Kazakhstan. The said criminal case has been registered in the Unified Register of Pre-Trial Investigations (hereinafter – the ERDR) under No. 267914031000483.

Pursuant to Paragraph 6 of Article 71 of the Criminal Procedure Code of the Republic of Kazakhstan, the victim has the right to submit evidence.

Pursuant to Paragraph 4 of Article 122 of the Criminal Procedure Code of the Republic of Kazakhstan, a suspect, accused person, defence counsel, private prosecutor, victim, civil claimant, civil defendant and their representatives, as well as any individuals and organizations, may submit, for attachment to a criminal case as evidence, information in oral, written or electronic document form, as well as things and documents.

For the purpose of exercising this right, video recordings containing information relevant to the criminal case are being submitted on an electronic storage medium (USB flash drive).

The said video materials are of significant evidentiary value for establishing the circumstances of the criminal offence, the manner and time of its commission, the amount of damage caused, as well as the persons involved therein.

Pursuant to Articles 71, 99 and 122 of the Criminal Procedure Code of the Republic of Kazakhstan,

I REQUEST THAT YOU:

recognize the 26 video recordings in MP4 format stored on the “UNION” USB flash drive, submitted in criminal case No. 267914031000483 of the ERDR, as physical evidence and attach them to the materials of the criminal case.
