MOTION
The criminal case based on the statement of A IS against Z B.N. concerning fraud under Article 190 of the Criminal Procedure Code of the Republic of Kazakhstan (hereinafter referred to as the “CPC”) is currently under the investigation of Investigator A.N. M of the Investigation Department of the Police Department of Almaty Region. The case has been registered in the Unified Register of Pre-Trial Investigations (ERDR) under No. 261900031000268.
According to the response received from the Police Department of Almaty Region, on 18 August 2026, the pre-trial investigation was terminated pursuant to Paragraph 2 of Part 1 of Article 35 of the CPC of the Republic of Kazakhstan due to the absence of the elements of a criminal offense in the act.
However, a copy of the decision to terminate the pre-trial investigation itself has not been provided to the injured party to date.
Pursuant to Part 4 of Article 99 of the CPC of the Republic of Kazakhstan, a motion shall be considered and resolved immediately upon its submission. Where it is impossible to make an immediate decision on the motion, it shall be resolved no later than three days from the date of its submission.
In view of the foregoing and pursuant to Articles 71 and 99 of the Criminal Procedure Code of the Republic of Kazakhstan,
I HEREBY REQUEST YOU TO:
Provide a copy of the decision dated 18 August 2026 to terminate the pre-trial investigation in criminal case ERDR No. 261900031000268, as agreed with the prosecutor, including all information and endorsements confirming such approval.
