Regarding the Obtaining of CCTV Recordings
MOTION
On 27 March 2026, KRA filed a complaint with the Turan District Police Department of Shymkent concerning theft incidents that occurred on the premises of the “Zhibek Zholy” Market, involving Abdusheva Shakhida Dilmuratovna.
According to the circumstances set out in the said complaint, the suspected person systematically committed acts of secretly taking possession of another person’s property. The place where these acts occurred was the territory of the “Zhibek Zholy” Market, where CCTV cameras are installed, including in the vicinity of Booths Nos. 16 and 17, as well as at adjacent retail outlets.
In this regard, the CCTV recordings are of significant evidentiary value for the complete and objective determination of the exact time, manner and scope of the theft incidents, as well as the identification of persons involved in their commission.
Furthermore, according to information provided by the market administration, the CCTV recordings are retained only for a limited period of time, and therefore there is a risk that they may be deleted. This, in turn, may impede a comprehensive, complete and objective investigation of the case.
Pursuant to Article 254 of the Criminal Procedure Code of the Republic of Kazakhstan, a seizure is carried out for the purpose of taking possession of specific items and documents relevant to the case where it is precisely known where and with whom they are located, as well as property subject to confiscation.
Based on the foregoing, and guided by the requirements of Article 254 of the Criminal Procedure Code of the Republic of Kazakhstan,
I HEREBY REQUEST THAT YOU:
- obtain from the administration of the “Zhibek Zholy” Market, as well as from the owners of all retail outlets located within the said premises and equipped with CCTV systems, all CCTV recordings in full for the period relating to the theft incidents that occurred in the vicinity of Booths Nos. 16 and 17;
- obtain, examine, record and attach the said CCTV recordings to the criminal case file as evidence in accordance with the procedure established by Article 254 of the Criminal Procedure Code of the Republic of Kazakhstan and the requirements of criminal procedural legislation;
- take measures to promptly obtain and ensure the preservation of the CCTV recordings in order to prevent their deletion.
