MOTION
to postpone the preliminary court hearing
Civil case No. 7514-26-00-2/25699 is pending before the Bostandyk District Court of Almaty upon the claim of Andrey Sergeyevich Lebedev against Individual Entrepreneur “B.E.” represented by its head Y.V.M., S.E.D. and S.E.D. for recovery of the amount and penalty.
The preliminary court hearing in civil case No. 7514-26-00-2/25699 is scheduled for September 22, 2026 at 10:00 a.m.
The Defendants applied for legal assistance to the Law Firm “Zakon i Pravo” only on September 18, 2026 (Friday) in the evening.
Due to the late engagement of the principals, the representatives require additional time to review the civil case materials, examine the evidence submitted by the Plaintiff, coordinate the legal position with the Defendants, and prepare a written response to the statement of claim. In addition, Defendant Seysenbekov Yerkan Dzhumagalievich intends to consider the possibility of settling the dispute amicably, and therefore the parties need additional time to conduct negotiations and discuss possible terms of reconciliation.
Holding the preliminary court hearing on September 22, 2026 does not, in fact, provide the representatives with sufficient time to properly prepare for the case and exercise the Defendants’ right to qualified legal assistance.
Based on the foregoing, guided by Articles 172 and 198 of the Civil Procedure Code of the Republic of Kazakhstan,
WE ASK THE COURT:
· To postpone the preliminary court hearing scheduled for September 22, 2026 at 10:00 a.m. to another date, providing the Defendants and their representatives with a reasonable period to review the case materials, formulate their legal position and prepare a response to the statement of claim, as well as to conduct negotiations with the Plaintiff with a view to potentially settling the dispute amicably.
