MOTION
to Summon and Question an Expert / Specialist
Civil case No. 1952-25-00-2/5853 is pending before the Court under the statement of claim of the Akim of Karasai District (hereinafter referred to as the “Civil Claimant”) against the Defendant B.N. Adilzhanovna (hereinafter referred to as the “Civil Defendant”) concerning the compulsory alienation (purchase) of a land plot for state needs.
Pursuant to Article 77 of the Civil Procedure Code of the Republic of Kazakhstan, the court may engage as a specialist an adult person who is not interested in the outcome of the case and possesses special knowledge, for participation in a court hearing or procedural actions for the purpose of assisting in the collection, examination and evaluation of evidence by providing consultations (explanations) using scientific and technical means.
The court may also engage specialists at the request of a party. Persons participating in the case may file a motion with the court to engage a specific person possessing special knowledge as a specialist.
A person appointed as a specialist shall be obliged to: appear upon summons of the court; using special knowledge, skills and scientific and technical means, conduct procedural actions and participate in the trial; provide consultations; provide explanations regarding the actions performed by such person, including through the use of technical means of communication. The specialist’s conclusion on all issues that have arisen shall be submitted to the court in written form or in the form of an electronic document.
The Defendant applied to LLP “Center for Expertise and Valuation” with a request to conduct a commission specialized construction and commodity studies, the expert / specialist being:
Tsoy Tatyana Yuryevna, holder of Qualification Certificate No. 318 dated 28 March 2003, issued for the right to conduct forensic examination in the specialty 10.4 “forensic construction and commodity examination” by the Ministry of Justice of the Republic of Kazakhstan, with 28 years of expert work experience, including in forensic examination bodies;
Gulnaz Tursynkyzy Alayeva, holder of Qualification Certificate No. 316 dated 28 March 2003, issued by the Ministry of Justice of the Republic of Kazakhstan for the right to conduct forensic examination in the specialty 10.4 “forensic construction and commodity examination”, with 32 years of expert work experience, including in forensic examination bodies.
On 23 January 2026, LLP “Center for Expertise and Valuation”, in Specialist Opinion No. 2, determined the value at KZT 75,784,360.
Based on the foregoing, and pursuant to Article 77 of the Civil Procedure Code of the Republic of Kazakhstan,
I ASK THE COURT TO:
• summon for questioning expert / specialist A.G. Zholseitova of the Institute of Forensic Examinations in Almaty of the Republican State Enterprise on the Right of Economic Management “Center for Forensic Examinations of the Ministry of Justice of the Republic of Kazakhstan”;
· summon for questioning expert / specialist Gulnaz Tursynkyzy Alayeva of LLP “Center for Expertise and Valuation”, tel.: +7 777 213 8007.
