MOTION
A criminal case is currently being investigated by A.N. Mukishev, Investigator of the Investigative Department of the Police Department of Almaty Region, based on the application filed by A.I.S. against Z.B.N. concerning fraud under Article 190 of the Criminal Code of the Republic of Kazakhstan (hereinafter — the “Criminal Code”). The criminal case was registered in the Unified Register of Pre-Trial Investigations (ERDR) under No. 261900031000268.
At present, the injured party has not been provided with up-to-date information regarding the progress and procedural status of the criminal case.
Furthermore, in order to exercise the procedural rights of the injured party and obtain up-to-date information on the progress of the pre-trial investigation, we request that A.I.S. and his representative be provided with the opportunity to monitor the criminal case through the information service of the Committee on Legal Statistics and Special Records of the Prosecutor General’s Office of the Republic of Kazakhstan at qamqor.gov.kz.
Pursuant to Article 99, Part 4 of the Criminal Procedure Code of the Republic of Kazakhstan, a motion shall be considered and resolved immediately upon its submission. Where an immediate decision on the motion is impossible, it shall be resolved no later than three days from the date of its submission.
In view of the foregoing and pursuant to Articles 71 and 99 of the Criminal Procedure Code of the Republic of Kazakhstan,
I HEREBY REQUEST:
- To provide information on the current procedural status of the criminal case registered in the ERDR under No. 261900031000268 based on the application filed by A.I.S. against Z.B.N., and, if the criminal case has been terminated, to provide an opportunity to review the decision on termination of the criminal case;
- To ensure that the injured party, A.I.S., and his representative are provided with access to information concerning the criminal case registered in the ERDR under No. 261900031000268 through the public sector of the ERDR (erdr-public.kgp.kz), to the extent necessary to monitor the progress and procedural status of the pre-trial investigation.
