MOTION
A criminal case concerning B.M. Tursungalievna on the fact of fraudulent acts is currently under investigation by the Police Department under the Police Department of the Medeu District of the Department of Police of Almaty.
Pursuant to Part 9 of Article 23 of the Criminal Procedure Code of the Republic of Kazakhstan, a suspect has the right to freely deny his or her guilt or admit guilt, reconcile with the victim, enter into a procedural agreement, or conclude an agreement on achieving reconciliation through mediation.
Pursuant to Article 24 of the Criminal Procedure Code of the Republic of Kazakhstan, an investigator is obliged to take all measures provided for by law to comprehensively, fully and objectively investigate the circumstances necessary and sufficient for the proper resolution of the case.
The suspect, B.M.T., has reconciled through mediation with the victims K.A.T., A.S.T. and K.A.G.
Pursuant to Article 70 of the Criminal Procedure Code of the Republic of Kazakhstan, a defense counsel has the right to file motions.
Pursuant to Article 99 of the Criminal Procedure Code of the Republic of Kazakhstan, a motion shall be considered and resolved immediately after it is filed. In cases where an immediate decision on the motion is impossible, it shall be resolved no later than three days from the date of its filing.
Based on the foregoing, I REQUEST THAT YOU:
– attach to the criminal case file the Agreement on Reconciliation through Mediation in the course of criminal proceedings concluded between B.M.T. and K.A.T.;
– attach to the criminal case file the Agreement on Reconciliation through Mediation in the course of criminal proceedings concluded between B.M.T. and A.S.T.;
– attach to the criminal case file the Agreement on Reconciliation through Mediation in the course of criminal proceedings concluded between B.M.T. and K.A.G.
