On approval of the Rules of activity of guides, guides and instructors of tourism

Order of the Minister of Tourism and Sports of the Republic of Kazakhstan dated July 15, 2026 No. 128. Registered with the Ministry of Justice of the Republic of Kazakhstan on June 16, 2026 No. 39310

 In accordance with subparagraph 20-27) of Article 11 of the Law of the Republic of Kazakhstan "On Tourism activities in the Republic of Kazakhstan", I ORDER:

     1. To approve the attached Rules for the activities of guides, guides and instructors of tourism.

     2. The Committee of the Tourism Industry of the Ministry of Tourism and Sports of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure:

     1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

     2) posting of this order on the Internet resource of the Ministry of Tourism and Sports of the Republic of Kazakhstan;

     3) within three working days after the execution of subitems 1) and 2) of this paragraph, provide information on the execution to the Legal Service Department of the Ministry of Tourism and Sports of the Republic of Kazakhstan.

     3. Control over the execution of this order is entrusted to the supervising Deputy Minister of Tourism and Sports of the Republic of Kazakhstan.

     4. This order shall enter into force upon the expiration of ten calendar days after the date of its first official publication.

Rules of activity of guides, guides and instructors of tourism

Chapter 1. General provisions

     1. These Rules of Activity for guides, guides and instructors of tourism (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 20-27) of Article 11 of the Law of the Republic of Kazakhstan "On Tourism Activities in the Republic of Kazakhstan" and determine the procedure for the activities of guides, guides and instructors of tourism.

     2. The following basic concepts are used in these Rules:

     1) tour guide – an individual professionally trained to provide information and (or) organizational services to tourists operating in the Republic of Kazakhstan;

     2) a tourism instructor is a professionally trained individual operating in the Republic of Kazakhstan who has the appropriate qualifications and experience in traveling tourist routes;

     3) the state register of tourist routes and trails is a document accounting for tourist routes and trails;

     4) a tourist product is a set of all necessary tourist services sufficient to meet the needs of a tourist during a trip.;

     5) a tour guide is an individual who is professionally trained to conduct excursions to tourists to get acquainted with tourist attractions in the country (place) of temporary stay, operating in the Republic of Kazakhstan.

Chapter 2. The procedure for the activities of guides, guides and instructors of tourism

     3. Guides, guides and instructors of tourism carry out activities if they have the citizenship of the Republic of Kazakhstan and a notification of the start of their activities.

     4. Notification of the beginning or termination of the activity of a guide, tour guide, or tourism instructor in the Republic of Kazakhstan is carried out in accordance with the Law of the Republic of Kazakhstan "On Permits and Notifications".

     Notification of the beginning of the activity of a guide, tour guide, or tourism instructor is submitted on the Internet resource www.elicense .kz according to the information forms attached to the notification of the start of travel agency activities, activities of a guide, tour guide and tourism instructor operating in the Republic of Kazakhstan as individual entrepreneurs, approved by the Law of the Minister of Investment and Development of the Republic of Kazakhstan dated February 27, 2015 No. 249 (registered in the Register of State Registration of Regulatory Legal Acts under No. 11209).

     5. The authorized body in the field of tourism activities maintains the state electronic register of persons who have submitted a notification of the beginning or termination of the activities of a guide, tour guide and instructor of tourism in accordance with the Law of the Republic of Kazakhstan "On Permits and Notifications".

     The register of guides, tour guides and instructors of tourism is posted on the official Internet resources of the authorized body in the field of tourism and the organization established by the Government of the Republic of Kazakhstan for the development of domestic and inbound tourism.

     6. Guides, guides and instructors of tourism provide tourist services on the basis of a contract by agreement of the parties concluded between the guide, guide, instructor of tourism and the tourist, according to the legislation of the Republic of Kazakhstan.

     To conclude an agreement, a tourist provides the guide, tour guide, and tourism instructor with information about himself and the persons in whose favor the agreement is concluded, to the extent necessary to fulfill obligations under such an agreement.

     7. Guides, guides and instructors of tourism, 3 (three) calendar days before the start of the trip, provide tourists in writing with information about the specifics of travel, including necessary and reliable information about the rules of entry, stay in the country (place) of temporary stay, legislation, customs of the local population, religious rituals, shrines., monuments of nature, history, culture and other objects of tourist display that are under special protection, the state of the environment, as well as the dangers they may encounter when traveling, and carry out preventive measures aimed at ensuring the safety of tourists.

     8. Guides, guides and instructors of tourism, within 1 (one) working day, immediately inform the authorized body in the field of tourism and the authorized body in the field of civil protection, as well as the family of the tourist from the moment when they learned or should have learned about the emergency with the tourist during the trip.

     If an emergency has occurred with foreign tourists in the territory of the Republic of Kazakhstan, guides, guides and instructors of tourism, also inform the bodies of the diplomatic service.

     9. When passing routes that pose a threat to the life and health of a tourist within the Republic of Kazakhstan, guides, guides and tourism instructors receive written consent from the tourist that the tourist is informed and agrees with the possible risk to life on this tourist route to ensure the safety of his life and health.

     Local executive bodies of the capital, regions and cities of republican significance maintain the state register of tourist routes and trails in accordance with the Law of the Republic of Kazakhstan "On Tourism Activities in the Republic of Kazakhstan".

     10. Guides, guides and instructors of tourism, when carrying out their activities, provide reliable information to tourists, should not distort facts and commit actions that violate the norms of the legislation of the Republic of Kazakhstan and the rights of tourists.

     11. Tourism guides and instructors in their activities provide tourists with organizational services for the implementation of preparatory measures and accompanying tourists along the route, aimed at coordinating their interaction with other services, without forming, promoting and selling a tourist product.

     12. Guides in their activities provide sightseeing services for organizing visits to tourist resources for educational purposes in the country (place) of temporary stay, which do not provide accommodation (overnight stay) for tourists and cover a period of no more than twenty-four hours.
