In accordance with paragraph 2 of Article 53 and paragraph 1 of Article 54 of the Building Code of the Republic of Kazakhstan and subparagraph 2) Paragraph 3 of Article 16 of the Law of the Republic of Kazakhstan "On State Statistics" I ORDER:

1. Approve:

1) Rules for the provision of engineering services in architectural, urban planning and construction activities in accordance with Appendix 1 to this order;

2) A list of certain orders that have become invalid, in accordance with Appendix 2 to this order.

2. The Committee on Construction and Housing and Communal Services of the Ministry of Industry and Construction of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:

1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) posting of this order on the Internet resource of the Ministry of Industry and Construction of the Republic of Kazakhstan.

3. Control over the execution of this order is entrusted to the supervising Vice Minister of Industry and Construction of the Republic of Kazakhstan.

4. This order will enter into force on July 1, 2026 and is subject to official publication.

Rules for the provision of engineering services in architectural, urban planning and construction activities

Chapter 1. General provisions

1. These Rules for the provision of engineering services in architectural, urban planning and Construction activities (hereinafter referred to as the Rules) have been developed in accordance with the Construction Code of the Republic of Kazakhstan (hereinafter referred to as the Code) and regulate the procedure for the provision of a range of services that ensure the preparation and implementation of construction.

2. These Rules use the concepts defined by the Code, as well as the following concepts:

1) author's support is an engineering service in architectural, urban planning and construction activities for the implementation of construction stage support by the author(s) of a construction project, including making changes to it;

2) project documentation – a set of text and graphic documents created during the design process, which includes:

landscaping and landscaping projects. Landscaping and landscaping projects can be part of a construction project.;

urban planning projects are projects containing solutions for integrated urban planning of the organization, development and development of territories and settlements or their parts (general scheme of organization of the territory of the Republic of Kazakhstan, interregional schemes of territorial development, integrated schemes of urban planning of territories, general plans of settlements (schemes of development and development of settlements), detailed planning projects);

construction project – design and estimate documentation containing the relevant requirements of this Code, as well as estimates for the organization and management of construction, engineering preparation of the territory, landscaping. Construction projects also include projects for the conservation and postutilization of construction sites.;

An architectural project is a project for the construction of a building object (monument), in the design of which the participation of an architect is required.;

3) treasury support – control over the targeted use of funds allocated for the implementation of budget investment projects related to construction, ensuring the completeness of tax payments by all project participants – the general contractor and subcontractor at all stages of payments through accounts with treasury authorities for construction facilities;

4) technical supervision is an engineering service for supervision of construction at all stages of the construction project, including quality, cost, acceptance of completed works and commissioning of construction facilities;

5) the authorized body for architecture, urban planning and construction is the central executive body responsible for the management, as well as, within its competence, intersectoral coordination in the field of public administration of architectural, urban planning and construction activities.

3. The customer, when engaging a specialist (employee) who has the appropriate certificate for the right to provide engineering services in the field of architectural, urban planning and construction activities (hereinafter referred to as the specialist), or an organization with certified specialists (employees) (hereinafter referred to as the organization), is guided by these Rules, other regulatory legal acts of the Republic of Kazakhstan and the terms of the engineering services agreement.

4. Technical supervision in the field of equity participation in housing construction is carried out by engineering companies in the field of equity participation in housing construction in accordance with the Law of the Republic of Kazakhstan "On Equity Participation in housing Construction".

An engineering company in the field of equity participation in housing construction monitors the progress of construction, the targeted use of shareholders' money, and checks the volume of work performed within the design cost.

The heads of an engineering company in the field of equity participation in housing construction, certified specialists who control the targeted use of money for the provision of engineering services for a construction project should not be affiliated with the management of a Single operator, developer, authorized company, contractor (general contractor) of this construction project.

An engineering company in the field of equity participation in housing construction meets the following requirements:

1) have experience in providing engineering services for commissioned construction facilities in the Republic of Kazakhstan with at least three customer reviews of the engineering services provided;

2) have in its staff at least three certified specialists for the right to provide engineering services in the field of architectural, urban planning and construction activities;

3) have a specialist(s) on staff to monitor the intended use of money.

5. In the case of the provision of engineering services by the organization, after signing the contract, the organization submits to the customer for approval the organizational structure created by it for technical supervision and author's support and project management, as well as the candidacy of the project manager from the organization.

6. The organization shall provide the customer in writing with a list of specialists who directly provide engineering services, their duties and powers.

7. Persons who carry out technical supervision, author support and project management for projects financed by public investments and quasi-public sector funds are registered and maintain executive documentation in a digital system for organizing construction on a "one-stop shop" basis in accordance with the established Rules governing the procedure for maintaining a portal and information systems for organizing construction on a "one-stop shop" basis.one window", approved by the Order of the Minister of Industry and Infrastructure Development of the Republic of Kazakhstan dated September 11, 2020 No. 465 (registered in the Register of State Registration of Regulatory Legal Acts No. 21224).

Chapter 2. Organization of engineering services

Paragraph 1. Provision of engineering services for the implementation of technical supervision

8. Technical supervision is carried out:

1) for the construction of industrial and non-industrial buildings and structures in order to ensure systematic verification and acceptance of completed stages of construction and installation work;

2) for compliance of buildings and structures with design decisions, state standards in the field of architecture, urban planning and construction;

3) quality control of the materials, products and structures used;

4) control over the construction and commissioning of facilities in accordance with the established procedure and within the time limits specified by the agreement (contract).

9. When carrying out technical supervision with the involvement of specialists (organizations) for the provision of engineering services, the customer submits to the technical supervision in one copy a complete set of design and estimate documentation with a mark in the drawings "For work".

10. When carrying out technical supervision, the head of general technical supervision is accountable to the customer, and the specialist in technical supervision for special types of work is accountable to the head of general technical supervision.

11. Technical supervision is carried out in contact with specialists of the author's support, employees of the contractor's production quality control services, as well as with specialists of the state architectural and construction control and supervision.

12. Technical Supervision Specialist:

13) ensures the monitoring of the performance of works that affect the safety of the facility, the monitoring of which cannot be carried out after other work has been completed, as well as the safety of building structures and sections of engineering and technical support networks, if the elimination of deficiencies identified during construction control is impossible without disassembly or damage to other building structures and sections of engineering and technical support networks;

14) promotes through its activities the targeted and rational use of the customer's funds, maintains complete and accurate records of completed and paid works in the cumulative statement;

15) requires the contractor to comply with proper storage conditions for materials, products, structures and equipment on the construction site, as well as to ensure the safety of completed works, erected buildings and structures before their delivery to the customer;

16) considers the contractor's claims regarding the provision of construction with design and estimate documentation and its quality, as well as on issues of quality control and acceptance of work, makes decisions on these claims or makes suggestions for decision-making by the customer;

17) during the construction period, establish, together with the contractor, observations of the plantings of responsible buildings and structures provided for by the project and draw up the results of observations with appropriate documentation.;

18) when accepting works performed under a construction contract, as well as when preparing for the commissioning of the facility, it checks the actual readiness of each type of work, structures, equipment and the facility as a whole, the availability of properly executed executive documentation, checks the availability of installed and installed equipment listed in the acceptance certificates, with the actual availability on the leased object;

19) confirms the readiness of the facility for commissioning, issues an opinion on the quality of construction and installation works, in accordance with the form approved by the Order of the Minister of Investment and Development of the Republic of Kazakhstan dated April 24, 2017 No. 235 (registered in the Register of State Registration of Regulatory Legal Acts No. 15150) "On approval of the forms of opinions on the quality of construction andinstallation works and compliance of the completed works with the project, declaration of conformity".

20) participates in the inspection of objects subject to conservation, in the preparation of documentation for conservation or temporary cessation of construction, as well as in the assessment of the technical condition of objects when they are transferred to construction organizations to continue work after deconservation or temporary cessation of construction;

21) makes proposals to the customer on the suspension of construction and installation works performed in violation of design estimates and government regulations;

22) suspends the production of works (with mandatory subsequent written notification to the customer and contractor) in cases of threat of deformations and collapse of structures, danger to human life and health and the environment, as well as failure to comply with instructions from technical supervision to eliminate defects and violations.;

23) makes proposals to the contractor, and, if necessary, to the customer, on bringing to justice persons who violate the requirements of design estimates and government regulations and do not comply with the instructions of technical supervision;

24) on the portal for the organization of construction on the principle of "one window" provides regular reports on a monthly basis by the 5th day of the following month after the notification of the start of construction and installation work is submitted to the state architectural and construction control authorities on the progress of construction and the quality of work performed in accordance with Appendix 4 to these rules (with the appendix photo report);

25) has permanent access to the construction site;

26) monitors the availability of the relevant right to the land plot, approved design (design estimates) documentation, a positive project expert opinion, as well as notifying the authorities carrying out state architectural and construction control and supervision of the commencement of construction and installation work, the availability of a license for the right to carry out the relevant types of licensed architectural, urban planning and construction activity, compliance of completed (performed) construction and installation works, applied building materials, products, structures and equipment approved by design decisions and state (interstate) standards, including ensuring the strength, stability, reliability of load-bearing and enclosing structures and the performance of buildings (structures), the organization and implementation by the contractor (general contractor) of all types and forms of its own production control and supervision of the quality of construction (entrance, operational, acceptance, laboratory, geodetic and others), timeliness and correctness of execution of executive documentation;

27) submits a monthly report to the customer on the progress of the projects in the form approved by the customer.

During the construction of facilities financed by public investments and funds from the quasi-public sector, it also submits a monthly report to the customer on the control of the use of materials, equipment, products and structures of Kazakhstani producers in accordance with design estimates.

28) submits to the relevant local executive body responsible for state architectural and construction control and supervision, for review, the construction project, as well as the expert opinion on the relevant construction projects.

13. The representative of the technical supervision carries out an inspection of hidden works, intermediate acceptance of responsible structures and acceptance of works for their payment. The survey and acceptance of works is carried out with the participation of a representative of the contractor, and, if necessary, representatives of subcontracting construction organizations (during the survey and acceptance of the work performed by them) and the design organization providing the author's support.

14. The contractor shall notify the technical supervision specialist of the upcoming inspection or acceptance of the work no later than one day before the start of the inspection and acceptance of the work. If the technical supervision representative has not arrived to inspect the hidden works by the deadline specified in the contractor's request, and the delay in the inspection will lead to the suspension of subsequent work, the contractor shall unilaterally draw up an act of inspection of the hidden works. In this case, if a representative of the technical supervision is required to open the structures to confirm the correctness of the work, the opening is carried out at the expense of the customer, and if violations of quality requirements are detected at the expense of the contractor. Based on the results of the survey of hidden works, an act is drawn up in the form prescribed by regulatory technical documents.

15. The inspection of hidden works is carried out before the start of subsequent work. If the subsequent work has to be carried out after a long break (more than six months) or a sudden change in the weather (rains, frosts, etc.), then the inspection of hidden work is carried out again. Repeated inspection is also carried out in case of damage to the surveyed works and structures after the damage has been repaired.

16. Acceptance of completed works for their payment is carried out by a representative of the technical supervision in accordance with the procedure established by the construction contract. A month can be taken as the billing period, or the time period required for the construction of the facility or the execution of construction work. Based on the results of the acceptance, an act of acceptance of completed construction works is drawn up, which is signed by a technical supervision representative within three working days in accordance with the form set out in Appendix 3 to the Rules for Organizing Activities and Performing the Functions of the customer, approved by Order No. 229 of the Minister of National Economy of the Republic of Kazakhstan dated March 19, 2015 (registered in the Register of State Registration of Regulatory Legal Acts for No. 10795), or a reasoned refusal is issued if there are violations of the requirements of Chapter 3 of these Rules.

17. During the inspection of hidden works, intermediate acceptance of critical structures, as well as acceptance of completed works for their payment, the technical supervision specialist requires the following documentation from the contractor:

1) a document on the establishment of the boundaries of the land plot in accordance with the Order of the Minister of National Economy of the Republic of Kazakhstan dated November 5, 2014 No. 67 "On approval of forms of documents for the provision of land plots for the construction of facilities within the settlement" (registered in the Register of State Registration of Regulatory Legal Acts No. 9952);

2) the act of planting a building or structure;

3) the act of checking the geodetic breakdown of the main axes of the building and structure;

4) the act of transferring the marker mark;

5) general work production log;

6) journal of pile driving, pile surveys, journal of work on the installation of building structures;

7) Welding log;

8) journal of corrosion protection of welded joints;

9) logbook for sealing mounting joints and assemblies;

10) log of mounting connections on bolts with controlled tension;

11) the magazine of the author's support;

12) acts (protocols) of testing materials, products, structures, engineering systems and equipment;

13) quality documents (passports and certificates) of the material, product, structure and equipment;

14) executive geodetic schemes.

18. Individual responsible structures, as soon as they are ready, are subject to interim acceptance by representatives of technical supervision with the registration of an act in accordance with the form established by state regulations.

19. During the inspection and acceptance of works, intermediate acceptance of responsible structures, the technical supervision representative checks the compliance of the materials, products, structures and equipment used with the requirements of design and regulatory and technical documentation; compliance of the composition and scope of work performed with design estimates; elimination of defects and violations noted in the journals of work and author's support.

20. Works performed in full compliance with the design and estimate documentation are subject to acceptance. All deviations from the design and estimate documentation are coordinated by the customer with the design organization. In the absence of such approvals, the work is accepted only after the elimination of deviations.

21. Upon completion of construction and installation works, the technical supervision submits for approval the conclusions on the quality of construction and installation works to the relevant local executive body carrying out state architectural and construction control and supervision, in accordance with the procedure established by the legislation of the Republic of Kazakhstan.

Paragraph 2. Provision of engineering services for the implementation of copyright maintenance

21. The author's support is carried out in order to control the development of a construction project (construction documentation) carried out by the author(s) of an architectural and urban-planning work and the implementation of a construction project carried out by its developers, including the author(s) of an architectural or urban-planning work.

22. The author's support is provided by the developers of the design (design and estimate) documentation at all construction sites, with the exception of those specified in paragraph 1 of Article 133 of this Code.

23. Copyright support is provided on the basis of an agreement concluded between the customer and the author and (or) the project developer, or a specialist (employee) authorized to conduct copyright support.

24. The author and/or developer of the project, after receiving the draft agreement, makes one of the following decisions within a month:

1) signs the draft contract and sends it to the customer;

2) delegates the author's supervision of the construction of the facility to the customer in order to independently select a supplier of engineering services for conducting author's supervision, which has the appropriate certificate, and notifies the customer in writing.;

3) delegates the author's supervision of the construction of the facility to a specialist (employee) who holds a certificate for the right to provide engineering services in architectural, urban planning and construction activities, and who has a seal indicating the surname, first name, patronymic, position, certificate number and date of issue, which he notifies the customer in writing.

In this case, the contract for the author's support is concluded between the customer and a specialist (employee).

25. The author and (or) the developer of the project, as well as specialists (employees) who have been delegated the right to conduct author's support, carry out author's support in accordance with the design solution by visiting the facility in accordance with the developed schedule of visits to the construction site for the entire construction period and maintaining a journal of author's support in accordance with the forms, according to appendices 1 and 2 to these Rules.

26. Each visit and its results are recorded in the journal of the author's support and certified by the personal seal of the person providing the author's support.

27. The author or developer of the project, as well as a specialist (employee) in author support:

1) verifies the conformity of the composition of work and production technology with design solutions;

2) promptly resolves issues arising during the construction process on the design and estimate documentation, introduces additions and amendments to the design and estimate documentation in accordance with the procedure established by the current state regulations.;

3) participates (together with the technical supervision of the customer) in the acceptance of individual critical structures and the main types of hidden work in accordance with the requirements of state regulations;

4) verifies the compliance of certificates (passports) and other technical documentation for structures, parts, building materials and equipment with state standards, specifications and design estimates;

5) does not allow the use of structures, parts, products, building materials and equipment that do not comply with national standards, technical regulations and design estimates;

6) gives instructions to representatives of the customer and the contractor on the termination of work performed in violation of the requirements of design estimates and regulatory documents.

28. The author or developer of the project, as well as a specialist (employee) in author support, is responsible for:

1) high-quality and timely performance of functions;

2) high-quality and timely logging of the author's supervision of the construction of the facility;

3) timely implementation and strict adherence to the schedule of author support;

4) ensuring compliance of the object under construction with the design and estimate documentation.

29. During the initial visit to the construction site, the author and (or) the project developer or the specialist (employee) providing author support establish the conformity of the documents used in conducting author support in accordance with state regulations.

30. Acceptance of completed works for their payment is carried out by a representative of the author's support in accordance with the procedure established by the construction contract. A month can be taken as the billing period, or the time period required for the construction of the facility or the execution of construction work. Based on the results of the acceptance, an act of completed works is drawn up, which is signed within 3 (three) working days by a representative of the author's support in accordance with the form set out in Appendix 3 to the Rules for Organizing the Activities and Performing the Functions of the customer (developer), approved by Order of the Minister of National Economy of the Republic of Kazakhstan dated March 19, 2015 No. 229 (registered in the Register of State Registration 10795), or a reasoned refusal is issued if there are violations of the requirements of Chapter 4 of these Rules.

31. During subsequent visits to the construction site, the author and (or) the project developer or the specialist (employee) providing the author's support establishes the conformity of the construction and installation works performed with the approved construction project.

32. If there is a discrepancy between the completed works, the author and (or) the project developer or the specialist (employee) providing the author's support make notes in the journal and report this in writing to the customer, contractor and the state Architectural and Construction Inspectorate within five calendar days from the moment the comments are identified.

33. Upon completion of the construction of the facility, the person providing the author's support issues to the customer (developer) an opinion on the compliance of the completed works with the project, or a negative opinion in accordance with the established form of the approved regulatory legal act.

Chapter 3. Provision of engineering services for project management

34. For the construction of construction projects, including unique construction projects and large investment projects, and for "pilot" projects implemented as part of the implementation of treasury support for public procurement, the customer of the construction project (program) may involve accredited legal entities providing engineering services for project management.

35. An accredited organization providing engineering services for project management (hereinafter referred to as the organization) is engaged by the customer or investor for the entire investment period, including the pre–project stage and the stages of design, construction and commissioning of an object or several objects at any stage of the project implementation.

36. When implementing a project being built at the expense of public investments, it is not allowed to combine project management functions and contract work (development of pre-design, design and estimate documentation and (or) construction and installation work) in this project.

37. When providing engineering services for project management, the organization performs the following functions::

1) provides the services stipulated in the contract with the customer, necessary for the successful implementation of projects and the execution of contracts.

2) ensures timely and correct execution of technical specifications and executive surveys;

3) organizes contract tenders, develops technical specifications, determines the qualifications of participants and evaluates their proposals;

4) participates in the process of preparing the contract between the customer and the contractor;

5) informs the customer about the problems that have arisen or may arise in relation to the implementation of the contract and issues recommendations;

6) during project development:

verifies the effectiveness of the adopted design decisions;

makes suggestions for improving the technical performance of the projected facility;

provides recommendations on the use of new building materials and technologies for the production of works;

7) in case of poor-quality project development or a negative conclusion of a comprehensive non-departmental expertise on the project, makes a proposal to the customer to suspend the project organization from work.;

8) in consultation with the customer and the project developer, makes decisions on making changes to the approved design solutions.;

9) submits a monthly report to the customer on the progress of projects, the contractor's (designer's) activities, the quality of work (with a photo report attached), and the disbursement of allocated budget funds;

10) during construction and installation work:

has access to the construction sites of facilities for which contracts have been concluded;

represents and protects the interests of the customer at construction sites as a technical representative of the customer;

ensures full compliance of the design and estimate documentation of the construction and installation works performed by the contractor;

Ensures that the contractor complies with safety, labor protection and environmental regulations at construction sites.;

verifies the quality of building materials, structures and products used at facilities, the availability of quality documents (technical passports, certificates, laboratory test results, etc.), organizes laboratory tests in accordance with standards and other government regulations in the field of architecture, urban planning and construction in force in the Republic of Kazakhstan;

reviews and submits to the customer for approval the work schedules prepared by the contractor, the project of work production;

evaluates the compliance of the pace of work with the approved schedule, the progress of completing facilities with material resources and technical means, and the availability of qualified labor;

keeps records of machines and mechanisms operating at the facilities, evaluates their technical suitability and compliance with the list specified in the contractor's tender application.;

verifies the contractor's claims regarding the extension of work deadlines, compensation for additional or unforeseen work, and costs, and issues recommendations to the customer.;

verifies the volume of completed works and their costs in accordance with the approved design and estimate documentation and certifies the acceptance certificates of completed construction and installation works upon interim payment and final settlement with the contractor.;

for projects implemented as part of the implementation of treasury support for public procurement for construction, within three working days certifies the acceptance certificates of completed construction and installation works by issuing a payment certificate confirming financial calculations for payment in accordance with the form approved by Order of the Minister of Finance of the Republic of Kazakhstan dated December 4, 2014 No. 540 "On Approval of the Rules of Budget Execution and its cash register service" (registered in the Register of State Registration of Regulatory Legal Acts No. 9934);

performs inspection of hidden works, intermediate acceptance of critical structures and acceptance of works for their payment;

provides preparation and approval of technical reports and summaries, timely documentation of the progress of work;

conducts periodic and final measurements of the completed volumes of work and issues conclusions on their compliance with the contractor's reports.;

ensures acceptance and safety of all warranty documents and certificates for all materials, structures, equipment and transfers them to the customer upon completion of the construction of the facility.;

monitors compliance with design decisions, construction deadlines and requirements of state standards in the field of architecture, urban planning and construction;

controls the targeted and effective use of funds for construction and installation work;

conducts inspections, surveys and, if necessary, tests of completed facilities, submits comments, ensures their complete elimination by the contractor and, in accordance with the established procedure, submits recommendations to the customer on the acceptance of facilities into operation.;

requests from the contractor and subcontractors the necessary executive documentation for the facility;

suspends the production of works in case of detection of violations of technology, deviations from the project, the use of substandard building materials until the identified defects and violations are eliminated.;

makes proposals to the customer on the removal from work of the contractor, systematically allowing deviations from the design (design and estimate) documentation, violating the technology of work and the requirements of state standards in the field of architecture, urban planning and construction;

makes proposals to the customer to adjust the documents submitted for payment or exclude from the acceptance certificates of completed works submitted for payment the cost of the amount of work that does not comply with government regulations and project documentation.;

sends proposals to the contractor's officials on the elimination of defects and the causes of their occurrence;

creates a system for recording, using, and storing documents, including correspondence, research and testing data, meeting minutes, financial records, and a construction site diary;

Submits a report on project risks, completion plans, and construction progress on a monthly basis to local executive bodies responsible for state architectural and construction control and supervision.;

informs the customer in case of non-fulfillment or improper fulfillment of obligations by the contractor (general contractor), and also informs the relevant local executive body responsible for state architectural and construction control and supervision.

38. Organization in accordance with the legislation of the Republic of Kazakhstan and the terms of contracts:

1) represents, on behalf of the customer, his interests in relations with local executive bodies, with owners of land plots and communications, with other organizations and the public on issues of construction and reconstruction of facilities;

2) in agreement with the customer, disposes of the monetary and material resources allocated for the construction of the facility and bears the responsibility provided for by the legislation of the Republic of Kazakhstan and the contract.

39. Upon completion of construction, the organization providing project management services and persons carrying out technical supervision and author support, which is on the staff of this organization carrying out technical supervision and author support, issues conclusions on the quality of construction and installation work and the conformity of the work performed with the construction project, in the form, approved by the Order of the Minister of Investment and Development of the Republic of Kazakhstan dated April 24, 2017 No. 235 (registered in the Register of State Registration of Regulatory Legal Acts No. 15150) "On approval of the forms of conclusions on the quality of construction and installation works and the conformity of completed works to the project, declaration of conformity."

1. This explanation on filling out the form intended for collecting administrative data on the report on the progress of construction and the quality of work performed (hereinafter referred to as the Form) details the procedure for filling it out.

2. The form is filled in by individuals and legal entities providing technical supervision services.

3. The form is signed with an electronic digital signature of the responsible technical supervision specialist and the head of the accredited legal entity, or a person authorized to sign such documents.

4. The form is provided monthly no later than the fifth day of the month following the reporting month.

5. The form must be filled in the official and Russian languages.

6. The report form is reviewed by the state architectural and construction control bodies within 15 working days from the date of receipt of the report on the progress of construction and the quality of work performed.

Chapter 2. Explanation of filling out the Form

Column 1 is compiled automatically by the information portal for the organization of construction on the principle of "one window" when submitting the report.
