I DECREE:
1. To approve the attached Rules for the formation of the Presidential Personnel Reserve of special state bodies of the Republic of Kazakhstan.

3. Control over the implementation of this Decree is entrusted to the Administration of the President of the Republic of Kazakhstan.
4. This Decree shall enter into force from the date of signing.

Rules of formation of the Presidential Personnel Reserve of special state agencies of the Republic of Kazakhstan

Chapter 1. General provisions
1. These Rules for the formation of the Presidential Personnel Reserve of special state bodies of the Republic of Kazakhstan (hereinafter referred to as the Rules) define a special procedure for the selection, enrollment of employees and military personnel of special state bodies of the Republic of Kazakhstan (hereinafter referred to as employees) in the Presidential Personnel Reserve of special state bodies of the Republic of Kazakhstan (hereinafter referred to as the Presidential Personnel Reserve), their training and exclusion from it.
2. The Presidential personnel Reserve is a list of employees who have passed a special selection procedure provided for by these Rules for nomination to vacant senior management positions of special state bodies of the Republic of Kazakhstan.
3. The purpose of forming the Presidential Personnel Reserve is to create a professional staff through high–quality selection of employees and their training to fill vacant senior management positions in special government agencies of the Republic of Kazakhstan.
4. The formation of the Presidential Personnel Reserve is carried out for positions stipulated by the List of positions of political civil servants, officials and other persons appointed and dismissed by the President of the Republic of Kazakhstan and (or) in agreement with him, elected on the proposal of the President of the Republic of Kazakhstan, as well as appointed and dismissed in agreement with the Administration of the President of the Republic of Kazakhstan, approved by Presidential Decree No. 290 of the Republic of Kazakhstan dated July 31, 2023 "On certain issues of personnel policy in the system of public authorities".
5. Approval of the Presidential Personnel Reserve is carried out by the Head of the Presidential Administration of the Republic of Kazakhstan on the recommendation of the Department of Military Security and Defense of the Security Council of the Republic of Kazakhstan (hereinafter referred to as the Department of Military Security and Defense), agreed with the Secretary of the Security Council of the Republic of Kazakhstan in accordance with these Rules.
Approval of the Presidential Personnel Reserve of employees of the State Security Service of the Republic of Kazakhstan (hereinafter referred to as the State Security Service) is carried out by the Head of the Presidential Administration of the Republic of Kazakhstan on the recommendation of the Head of the State Security Service.
6. The Department of Military Security and Defense is responsible for organizing the work on the formation of the Presidential Personnel Reserve.
The organization of work on the formation of lists of employees of the State Security Service recommended to the Presidential Personnel Reserve, and the preparation of documents specified in paragraph 10 of these Rules, are entrusted to the State Security Service.
7. These Rules do not apply to the positions of the first heads of special state bodies of the Republic of Kazakhstan.
Chapter 2. Formation of the Presidential Personnel Reserve
8. The formation of the Presidential Personnel Reserve is carried out quarterly, taking into account the forecast of the current and future demand for candidates for senior positions in special government agencies of the Republic of Kazakhstan.
The Presidential personnel reserve is formed from the number of employees:
1) meet the qualification requirements, including the requirements for length of service, the level of professional training provided for the replacement of the proposed position;
2) corresponding to the position held by the decision of the attestation commission, including those recommended for enrollment in the personnel reserve or promotion to a higher position.;
3) having no disciplinary action at the time of sending the materials.
Employees seconded to government agencies and international organizations may be recommended to the Presidential Personnel Reserve by the first head of a special state body of the Republic of Kazakhstan, subject to compliance with qualification requirements.
According to the proposal of the head of the structural unit of the Presidential Administration of the Republic of Kazakhstan, agreed with the first head of the special state body of the Republic of Kazakhstan, who seconded the employee, employees seconded to the Presidential Personnel Reserve may be assigned to the Presidential Administration of the Republic of Kazakhstan, who meet the requirements.
9. The selection of candidates for admission to the Presidential Personnel Reserve is based on the study and assessment of the personal and business qualities of employees, the results of their professional activities and the decision of the attestation commission.
10. By the 1st day of the last month of the corresponding quarter, the lists of employees recommended for enrollment in the Presidential Personnel Reserve must be sent to the Administration of the President of the Republic of Kazakhstan.
The following materials should be attached to the lists of employees recommended for enrollment in the Presidential Personnel Reserve:
1) presentation of the first head of a special state body of the Republic of Kazakhstan with the indication:
business and personal qualities of the employee, the main performance indicators in the position (in dynamics over the past three years);
compliance with the qualification requirements for the proposed position;
decisions of the attestation commission, and in respect of persons who are not subject to attestation, specific performance indicators.;
2) a reference lens (track record) with a photograph of the prescribed form;
3) information about the employee passing a mandatory special check.
The first head of a special state body of the Republic of Kazakhstan has the right to request characterizing materials regarding seconded employees from the head of the body (organization) where the corresponding employee serves.
If the submitted materials are found to be incomplete or contain any inaccurate information by the personnel departments of special state bodies of the Republic of Kazakhstan, the above deficiencies can be eliminated without the Military Security and Defense Department returning the materials for employees recommended for enrollment in the Presidential Personnel Reserve.
It is not allowed to simultaneously send materials for enrolling a candidate in the Presidential Personnel Reserve and submitting them for approval of an appointment to a position.
11. Department of Military Security and Defense quarterly:
1) by the 15th day of the last month of the relevant quarter, verify the accuracy and completeness of the submitted materials and the compliance of employees recommended to the Presidential Personnel Reserve with the requirements established by these Rules, if necessary, by requesting information, additional verification measures are carried out.;
2) by the 30th day of the last month of the corresponding quarter, a list of employees recommended for enrollment in the Presidential Personnel Reserve is formed based on the results of reviewing the materials.;
3) within ten working days after the approval of the Presidential Personnel Reserve, the first heads of special state bodies of the Republic of Kazakhstan are informed.
12. The Military Security and Defense Department, after forming a list of candidates for the Presidential Personnel Reserve and coordinating with the Secretary of the Security Council of the Republic of Kazakhstan, submits it to the Head of the Presidential Administration of the Republic of Kazakhstan for approval.
Based on the results of consideration of submissions for enrollment in the Presidential Personnel Reserve, the Head of the Presidential Administration of the Republic of Kazakhstan makes one of the following decisions::
1) enroll in the Presidential Personnel Reserve;
2) refuse to enroll in the Presidential Personnel Reserve.
13. The personnel divisions of the special state bodies of the Republic of Kazakhstan, within ten working days from the date of receipt of an extract from the approved list of the Presidential Personnel Reserve, notify employees of their enrollment in the Presidential Personnel Reserve.
14. The term of an employee's stay in the Presidential Personnel Reserve should not exceed three years. Persons enrolled in the Presidential Personnel Reserve, but not appointed to vacant senior management positions during their tenure, may be re-enrolled on a general basis.
Unless otherwise decided by the President of the Republic of Kazakhstan or the Head of his Administration, the minimum period of stay in the Presidential Personnel Reserve for appointment to senior management positions should be at least three months.
15. The first head of a special state body of the Republic of Kazakhstan has the right to submit additional candidates to the Presidential Personnel Reserve in accordance with the procedure established by these Rules.
16. Employees of the Presidential Personnel Reserve undergo professional retraining and advanced training at the Academy of Law Enforcement Agencies under the General Prosecutor's Office of the Republic of Kazakhstan in order to improve their professional skills and managerial competence necessary for appointment to prospective leadership positions.
17. Employees enrolled in the Presidential Personnel Reserve, with the exception of those seconded to government agencies and international organizations, may be temporarily assigned duties in the position to which they are enrolled in the Presidential Personnel Reserve, in accordance with the procedure established by the Law of the Republic of Kazakhstan "On Special State Bodies of the Republic of Kazakhstan".
Chapter 3. Exclusion from the Presidential Personnel Reserve
18. An employee is excluded from the Presidential Personnel Reserve in the following cases::
1) bringing him to administrative responsibility in court for an intentional offense;
2) bringing him to disciplinary responsibility for committing a corruption offense;
3) imposing disciplinary penalties on him in the form of a warning about incomplete official compliance, dismissal from his position (demotion by one step), reduction in a special (military) rank by one step;
4) submitting a report on his exclusion from the Presidential Personnel Reserve;
5) expiration of the period provided for in paragraph 14 of these Rules;
6) his dismissal from service in special state bodies of the Republic of Kazakhstan;
7) transfer (secondment) him to special state and law enforcement agencies of the Republic of Kazakhstan, civil protection agencies, the Armed Forces of the Republic of Kazakhstan, other troops and military formations;
8) his demotion or transfer from his current position to a lower position based on the results of the attestation.
19. The decision to exclude an employee from the Presidential Personnel Reserve is made upon the grounds provided for in paragraph 18 of these Rules by the Head of the Presidential Administration of the Republic of Kazakhstan in accordance with the materials submitted by the personnel units of special state bodies of the Republic of Kazakhstan to the Department of Military Security and Defense.
20. Employees excluded from the Presidential Personnel Reserve in accordance with subparagraph 3) According to paragraph 18 of these Rules, they may be enrolled in the Presidential Personnel Reserve no earlier than one year after the grounds for exclusion have been eliminated in accordance with the procedure provided for in these Rules.
