In accordance with subparagraph 20) of Article 44 of the Constitution of the Republic of Kazakhstan, paragraph 1 of Article 33 of the Constitutional Law of the Republic of Kazakhstan dated December 26, 1995 "On the President of the Republic of Kazakhstan", I DECREE:
1. To establish the National Commission on Women's Affairs and Family and Demographic Policy as an advisory body under the President of the Republic of Kazakhstan.

2. Approve the attached documents:
1) Regulations on the National Commission on Women's Affairs and Family and Demographic Policy under the President of the Republic of Kazakhstan;
2) the composition of the National Commission on Women's Affairs and Family and Demographic Policy under the President of the Republic of Kazakhstan.

3. To the Government of the Republic of Kazakhstan:
1) within one month, develop and approve a model regulation on the commission on Women's Affairs and Family and Demographic policy under the akims of the regions, Astana and Almaty cities;
2) take other necessary measures to implement this Decree.

4. Akims of the regions, Astana and Almaty cities should form the above-mentioned commissions on women's affairs and family and demographic policy.

5. To amend the following decrees of the President of the Republic of Kazakhstan:
1) to the Decree of the President of the Republic of Kazakhstan dated September 13, 1996 No. 3108 "On the composition of the Pardon Commission under the President of the Republic of Kazakhstan":
in paragraph 1 of the said Decree, in the line:

The words "Minister of Environmental Protection of the Republic of Kazakhstan - Chairman" and "women" should be replaced by the words "Adviser to the President of the Republic of Kazakhstan - Chairman" and "gender policy", respectively;
2) abrogated by Decree of the President of the Republic of Kazakhstan dated 02/01/2010 N 922;
3) abrogated by Decree of the President of the Republic of Kazakhstan dated 05/08/2012 No. 325;
4) to the Decree of the President of the Republic of Kazakhstan dated November 29, 2005 No. 1677 "On approval of the Strategy of Gender Equality in the Republic of Kazakhstan for 2006-2016":
In paragraphs 3 and 4 of the Decree, the word "women" should be replaced with the words "gender policy";
in the Strategy of Gender Equality in the Republic of Kazakhstan for 2006-2016, approved by the said Decree, the seventh paragraph of the subsection "Strategy of Action" of section 1 should be worded as follows:
"to introduce the posts of secretaries of the commissions on family affairs and gender policy under the akims of the regions, Astana and Almaty, dealing with family and gender policy;".
6. Invalidate:
1) Decree of the President of the Republic of Kazakhstan dated December 22, 1998 No. 4176 "On the National Commission for Family and Women's Affairs under the President of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 1998, No. 48, art. 425);
2) Decree of the President of the Republic of Kazakhstan dated March 5, 1997 No. 3395 "On the Concept of State Policy for the advancement of women in the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 1997, No. 11, art. 74);
3) Decree of the President of the Republic of Kazakhstan dated March 4, 1999 No. 16 "On Approval of the staff of the National Commission for Family and Women's Affairs under the President of the Republic of Kazakhstan";
4) Decree of the President of the Republic of Kazakhstan dated February 27, 2002 No. 314 "On Amendments to Decree of the President of the Republic of Kazakhstan dated March 4, 1999 No. 16" (SAPP of the Republic of Kazakhstan, 2002, No. 6, art. 45);
5) Decree of the President of the Republic of Kazakhstan dated March 2, 2005 No. 527 "On Amendments to Decree of the President of the Republic of Kazakhstan dated March 4, 1999 No. 16" (SAPP of the Republic of Kazakhstan, 2005, No. 12, art. 117).
7. This Decree shall enter into force from the date of signing.

Regulations of the National Commission for Women, Family and Demographic Policy under the President of the Republic of Kazakhstan

1. General provisions
1. The National Commission on Women's Affairs and Family and Demographic Policy (hereinafter referred to as the Commission) is an advisory body under the President of the Republic of Kazakhstan.

2. The legal basis of the Commission's activities is the Constitution and laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan, other regulatory legal acts of the Republic of Kazakhstan, as well as this Regulation.
2. The main tasks of the Commission
3. The main tasks of the Commission are:
1) development of recommendations on prioritization, formation and implementation of a comprehensive state policy on family, equality of women and men in the context of the Concept of Family and Gender Policy in the Republic of Kazakhstan until 2030 and international treaties on family and gender equality, to which Kazakhstan is a party;
2) interaction with government agencies and civil society institutions on the protection of family interests, the implementation of the United Nations Millennium Declaration, the Concept of Family and Gender Policy in the Republic of Kazakhstan until 2030;
3) analysis of issues of the status of women and the family demographic situation and development of proposals and recommendations to government agencies on the main directions of gender and family demographic policy in the Republic of Kazakhstan;
4) assistance:
achieving equal opportunities for women and men in the economic sphere, further developing entrepreneurship among women, and increasing women's competitiveness in the labor market;
creating conditions for family members to combine work with household duties and raising children;
strengthening the institution of the family, achieving equal opportunities for women and men in family relations;
development of a set of measures to preserve and promote public health, including reproductive health, and improve the quality of life;
elimination of domestic and workplace violence and implementation of international experience in combating violence against men, women and children;
gender education and public awareness;
conducting scientific research, forming an information base in order to analyze the real situation of the family, equal opportunities for women and men in the economic, social, political and cultural life of society;
improving the demographic situation;
5) consideration of proposals from government agencies, international organizations and public associations on issues within the competence of the Commission, preparation of relevant recommendations to the President of the Republic of Kazakhstan;
6) development of recommendations and proposals for the Head of State to ensure that government officials comply with the requirements of the legislation of the Republic of Kazakhstan on family and gender equality;
7) interaction with the media in order to better reflect the aspects of the family and gender equality in Kazakhstan;
8) consideration of citizens' appeals, media reports concerning family issues, non-observance of gender equality;
9) participation in the development of concepts, state and sectoral (sectoral) programs on women, family and demography;
10) participation in the preparation and consideration of draft legislative and other regulatory legal acts aimed at improving the situation of the family and women;
11) initiation and conduct of gender-legal expertise;
12) cooperation with government agencies and international organizations, development of proposals for the implementation of international initiatives, participation in conferences, meetings, seminars on the status of women, family and demography.

3. Powers of the Commission
4. The Commission, within the limits of its competence, has the right:
1) to hear at their meetings the heads of state bodies directly subordinate and accountable to the Head of State, central and local executive bodies;
2) request and receive necessary documents, materials and information from government agencies, organizations and officials;
3) require the heads of relevant government agencies to conduct inspections and official investigations into violations of laws related to gender equality, family and demography;
4) to make proposals on draft acts of the President of the Republic of Kazakhstan submitted to the Head of State for consideration, draft acts of the Government of the Republic of Kazakhstan concerning issues of gender equality, family and demography;
5) involve government officials in the consideration of issues within the competence of the Commission, as well as reputable and professionally trained members of the public as freelance experts to participate in the preparation of Commission meetings, the development of programs and the conduct of inspections;
6) coordinate the activities of the commissions under the akims of Astana, Almaty, Shymkent and the regions, and hear reports on their activities;
7) promote the nomination of women for leadership positions.

5. Based on the results of consideration of received appeals from citizens and media reports, the Commission may send materials for consideration by the relevant state body or official for making a decision on the merits.
6. Members of the Commission may attend meetings of the Parliament of the Republic of Kazakhstan and its chambers, the Government of the Republic of Kazakhstan, and boards of state bodies on gender equality, family, and demography by invitation.

6-1. To conduct expert and analytical research, the Commission creates an expert council consisting of representatives of scientific institutions, educational organizations and non-governmental organizations, working on a voluntary basis. The composition of the expert council is approved at a meeting of the Commission.

4. Organization of the Commission's work
7. The Commission consists of the Chairman, Vice-Chairmen, Secretary and its members. The President of the Republic of Kazakhstan determines its personal composition.

8. Meetings of the Commission are held as necessary, but at least once a quarter.
9. Meetings of the Commission shall be considered valid if they are attended by at least half of the total number of members of the Commission.
10. The Commission makes decisions by a simple majority of votes from the number of Commission members present at the meeting. If the votes are equal, the chairman's vote is decisive.
11. The Commission's decisions are formalized by protocols.
12. Chairman of the Commission:
1) submits proposals on the composition of the Commission to the Head of State for consideration;
2) organizes and directs the activities of the Commission;
3) determines the agenda of the meetings of the Commission;
4) convenes and chairs meetings of the Commission. In the absence of the Chairman of the Commission, one of the Vice-Chairmen of the Commission shall preside at the meetings.;
5) from among the members of the Commission, determines a rapporteur on a specific issue to be considered at a meeting of the Commission.;
6) systematically reports to the Head of State on the results of the Commission's work;
7) exercise other powers provided for by acts and instructions of the President of the Republic of Kazakhstan.

12-1. In the absence of the Chairman of the Commission, official documents, recommendations and conclusions of the Commission are signed by one of the Vice-Chairmen.

5. Ensuring the activities of the Commission
13. Information, analytical and organizational support of the Commission's activities is provided by the relevant sector, which is part of the structural unit of the Presidential Administration of the Republic of Kazakhstan.
