     In order to implement the Decree of the President of the Republic of Kazakhstan dated December 18, 2012 No. 449 "On measures to implement the Address of the Head of State to the People of Kazakhstan dated December 14, 2012 "Strategy "Kazakhstan - 2050": a new political course of the established state"

I DECREE:

     1. To establish the National Commission on Personnel Policy under the President of the Republic of Kazakhstan (hereinafter referred to as the National Commission).

     2. Approve the attached documents:

     1) Regulations on the National Commission;

     2) The official composition of the National Commission;

     3) The Model Regulation on the personnel commission of the region, the city of republican significance, the capital (hereinafter referred to as the Model Regulation);

     4) Standard official staff of the personnel commission of the region, the city of republican significance, the capital (hereinafter referred to as the Standard staff).

     3. Akims of regions, cities of republican significance, and the capital should form personnel commissions of regions, cities of republican significance, and the capital, and approve their regulations and compositions in accordance with the Standard Regulations and Standard official Composition approved by this Decree.

     4. The Government, the Administration of the President of the Republic of Kazakhstan and the Agency of the Republic of Kazakhstan for Civil Service Affairs shall take the measures resulting from this Decree.

     5. Control over the implementation of this Decree is entrusted to the Administration of the President of the Republic of Kazakhstan.

     6. This Decree is effective from March 26, 2013.

Regulations of the National Commission on Personnel Policy under the President of the Republic of Kazakhstan

Chapter 1. General provisions

     The footnote. The title of Chapter 1 is as amended by Decree of the President of the Republic of Kazakhstan dated January 18, 2021 No. 495 (effective from the date of its first official publication).

     1. The National Commission on Personnel Policy under the President of the Republic of Kazakhstan (hereinafter referred to as the National Commission) is formed in order to implement the Law of the Republic of Kazakhstan dated November 23, 2015 "On the Civil Service of the Republic of Kazakhstan" and to consider issues of admission of citizens of the Republic of Kazakhstan to administrative civil service, its passage and termination, as well as the involvement of foreign citizens in state bodies employees.

     2. In its activities, the National Commission is guided by the Constitution, legislative acts of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and these Regulations.

Chapter 2. Tasks of the National Commission

     3. The tasks of the National Commission are:

     1) elaboration and submission of proposals to the President of the Republic of Kazakhstan for consideration on the formation of personnel policy and its implementation in relation to administrative civil servants of the "A" corps;

     2) consideration of special qualification requirements for administrative government positions in the "A" corps;

     2-1) consideration of issues of attracting foreign workers to government agencies;

     2-2) consideration of issues related to the occupation of administrative government positions in the "B" building without competitive selection:

     current judges, members of Parliament, deputies of maslikhats who work on a permanent basis, political civil servants, international employees who perform their duties for at least six months;

     international employees, judges who have served for at least six months and terminated their powers, with the exception of those who terminated their powers for negative reasons;

     political civil servants who have served for at least six months and terminated their powers, with the exception of those who terminated their powers for negative reasons, provided that their positions are classified as political public positions in accordance with the Register of Positions of Political and Administrative Civil Servants in force at the time of the decision of the National Commission;

     persons with at least five years of work experience in international, foreign or transnational organizations, foreign government structures;

     persons who have at least two years of work experience in their specialty and have completed doctoral studies (PhD, doctor in profile) at leading foreign higher educational institutions, determined by the Republican Commission for Personnel Training Abroad;

     persons enrolled in the Presidential Youth Personnel Reserve;

     2-3) excluded by Decree of the President of the Republic of Kazakhstan dated 12.06.2017 No. 498; 3) excluded by Decree of the President of the Republic of Kazakhstan dated 18.01.2021 No. 495 (effective from the date of its first official publication);

     4) developing and making recommendations on the issues of passage and termination of public service by administrative civil servants of corps "A", training, rotation, disciplinary responsibility, dismissal from their positions;

     5) coordination of the activities of personnel commissions of regions, cities of republican significance, the capital;

     6) other tasks assigned by acts of the President of the Republic of Kazakhstan.

Chapter 3. Functions of the National Commission

     4. In accordance with the tasks, the National Commission is entrusted with the following functions::

     1) reviewing the personal files of candidates for Corps A positions and, if necessary, conducting interviews with them;

     2) reviewing personal files and other materials related to the activities of administrative civil servants of the "A" corps, and conducting interviews with them;

     2-1) making decisions on the recruitment of foreign workers to government agencies and coordinating their positions in government agencies;

     2-2) making decisions on the occupation of administrative government positions in the "B" building without competitive selection:

     current judges, members of Parliament, deputies of maslikhats who work on a permanent basis, political civil servants, international employees who perform their duties for at least six months;

     international employees, judges who have served for at least six months and terminated their powers, with the exception of those who terminated their powers for negative reasons;

     4) hearing at meetings of heads and representatives of state bodies, organizations, including chairmen of personnel commissions of regions, cities of republican significance, the capital on issues related to the competence of the National Commission;

     5) making decisions on issues within the competence of the National Commission;

     6) sending decisions to heads of state bodies and chairmen of personnel commissions of regions, cities of republican significance, the capital;

     7) involving, as necessary, officials and specialists of state bodies and organizations in the consideration of issues within the competence of the National Commission;

     8) inviting officials and other persons who are not members of the National Commission, as well as representatives of the mass media, to meetings of the National Commission;

9) submitting proposals to the President of the Republic of Kazakhstan on the development of instructions and regulatory legal acts on issues within the competence of the National Commission;

     9-1) excluded by Decree of the President of the Republic of Kazakhstan dated January 18, 2021 No. 495 (effective from the date of its first official publication);

     10) performing other functions established by the President of the Republic of Kazakhstan, necessary for the implementation of the tasks assigned to the National Commission.

Chapter 4. Composition and organization of the National Commission

     5. The National Commission consists of the Chairman, his deputy and the members of the commission. The President of the Republic of Kazakhstan determines its official composition.

     6. Chairman of the National Commission:

     1) carries out the general management of the activities of the National Commission;

     2) determines the place and time of the meetings of the National Commission;

     3) preside over the meetings of the National Commission;

     4) approves the personal composition of the National Commission;

     5) approves the work plan of the National Commission;

     6) gives binding instructions to the members of the National Commission;

     7) reports to the President of the Republic of Kazakhstan on the work of the National Commission.

     7. During the absence of the Chairman of the National Commission, his functions are performed by the Deputy Chairman of the National Commission.

     8. Meetings of the National Commission are held in accordance with the schedule of its work, as well as as necessary, but at least once every six months.

     9. By order of the Chairman of the National Commission, absentee voting of the members of the National Commission may be conducted.

     A meeting of the National Commission or absentee voting is considered valid if at least two thirds of its members are present at the meeting or participate in absentee voting. Members of the National Commission participate in its meetings and in absentee voting without the right to substitute.

     The deadline for absentee voting of the members of the National Commission should not exceed three working days from the date of sending the materials to the members of the National Commission.

     Before the end of the absentee voting period, the members of the National Commission send their opinions in writing to the working body of the National Commission.

     In case of failure to provide a response within the specified period, it is considered that the member of the National Commission voted for the adoption of the draft decision.

     Decisions of the National Commission are made by open voting or by absentee voting by a simple majority of the total number of members of the National Commission present at the meeting or participating in absentee voting. In case of equality of votes, the Chairman's vote is decisive.

     10. The decisions of the National Commission are formalized by a protocol signed by the Chairman and Secretary of the National Commission.

     The decisions of the National Commission are sent to the relevant State bodies and organizations and are subject to mandatory review within the time limit set by the National Commission.

     11. The Secretary of the National Commission is the Head of the Civil Service Department of the Presidential Administration of the Republic of Kazakhstan.

     12. The working body of the National Commission is the Civil Service Department of the Presidential Administration of the Republic of Kazakhstan.

     The authorized body for civil Service affairs provides organizational support for the activities of the National Commission.

     4) resolving issues of enrollment in the regional reserve and exclusion from it.

     8) consideration of candidates recommended for admission to the regional reserve;

     9) consideration of the issue of exclusion of a person from the regional reserve;

     10) approval of the dates of the selection stages, the number of candidates enrolled in the regional reserve, industry areas, taking into account the socio-economic situation in the region, the city of republican significance, the capital and priorities for the development of the public administration system for each specific selection in coordination with the authorized body in the field of public service;

     11) performing other functions established by the President of the Republic of Kazakhstan and decisions of the National Commission necessary for the implementation of the tasks assigned to the commission.

     9. A meeting of the commission is considered competent if it is attended by at least two thirds of its members. The members of the commission participate in its meetings without the right of replacement.

     The commission's decisions are taken by open voting by a simple majority of the total number of commission members present at the meeting. In case of equality of votes, the Chairman's vote is decisive.

     10. The commission's decisions are formalized by a protocol signed by the chairman and secretary of the commission.

     The commission's decisions are sent to the relevant government agencies and organizations and are subject to mandatory review within the time limit set by the commission.

     11. The working body of the commission is the territorial division of the authorized body for civil service affairs.

     12. The working body provides information, analytical and organizational support for the activities of the commission, including the preparation of draft work plans, agendas of meetings of the commission and other materials necessary for the organization of its work, submits them to the commission for consideration, monitoring the civil service of persons enrolled in the regional reserve.
