I DECREE:

1. To form a Commission under the President of the Republic of Kazakhstan on personnel policy in law enforcement agencies of the Republic of Kazakhstan (hereinafter referred to as the Commission).

2. Approve the attached documents:

1) Regulations on the Commission;

2) the composition of the Commission.

3. Abrogated by Decree of the President of the Republic of Kazakhstan dated 07/31/2023 No. 290.

4. This Decree shall enter into force from the date of signing.

Regulations of the Commission under the President of the Republic of Kazakhstan on Personnel policy in Law enforcement agencies of the Republic of Kazakhstan

1. This Regulation defines the legal status and powers of the Commission under the President of the Republic of Kazakhstan on Personnel Policy in Law enforcement agencies of the Republic of Kazakhstan (hereinafter referred to as the Commission).

2. In its activities, the Commission is guided by the Constitution, legislative acts of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and these Regulations.

3. The main task of the Commission is to consider submissions and prepare proposals to the President of the Republic of Kazakhstan or the first heads of government agencies (departments) on the appointment of persons applying for positions in the law enforcement agency specified in paragraph 4 of these Regulations.

4. The Commission shall consider the appointment of persons applying for positions in law enforcement agencies provided for in the List*.

* List – a list of positions of political civil servants, officials and other persons appointed and dismissed by the President of the Republic of Kazakhstan and (or) in agreement with him, elected on the proposal of the President of the Republic of Kazakhstan, as well as appointed and dismissed in agreement with the Administration of the President of the Republic of Kazakhstan, approved by Decree of the President of the Republic of Kazakhstan dated July 31, 2023 No. 290 "On some issues of personnel policy in the system of public authorities."

6. In order to achieve its main objectives, the Commission may:

1) request and receive, in accordance with the established procedure, the necessary information and materials from government agencies and organizations on issues within the competence of the Commission;

2) invite and hear representatives of government agencies and other organizations on issues within the competence of the Commission;

3) perform other functions on the instructions of the President of the Republic of Kazakhstan.

7. The Commission consists of the Chairman of the Commission, the Secretary and the members of the Commission.

8. Chairman of the Commission:

1) carries out the general management of the Commission's activities;

2) determines the place, time and format of the Commission meetings;

3) preside over the meetings of the Commission;

5) gives binding instructions to the members of the Commission.

9. The members of the Commission have the right to make proposals to the Chairman of the Commission on the schedule of work and the agenda of its meeting.

10. A meeting of the Commission is considered competent if it is attended by at least two thirds of its members.

11. Meetings of the Commission are held in person, in absentia or online format as required.

12. Personnel issues related to the persons referred to in paragraph 4 of these Regulations are considered by the Commission, as a rule, without their personal presence.

13. The Commission's decisions are made by a simple majority vote of the total number of Commission members present at the meeting. In case of equality of votes, the vote of the Chairman of the Commission is decisive.

The Commission's decision-making by absentee voting is allowed with the consent of the Chairman of the Commission.

14. The Commission's decisions are taken separately for each individual.

15. Based on the results of the meeting on the consideration of submissions for appointment, the Commission makes one of the following decisions::

1) recommend for appointment to the proposed position;

2) refuse to make a recommendation for the proposed position.

17. The Commission's decisions are formalized by a protocol, which is signed by its chairman.

19. The working body of the Commission is the Department of the Law Enforcement System of the Presidential Administration of the Republic of Kazakhstan.
