Decree of the President of the Republic of Kazakhstan dated September 22, 2010 No. 1066.

In order to implement the Decree of the President of the Republic of Kazakhstan dated August 17, 2010 No. 1039 "On measures to improve the effectiveness of law enforcement and the judicial system in the Republic of Kazakhstan"

I DECREE:

1. Reorganize:

1) The Ministry of Labor and Social Protection of the Population of the Republic of Kazakhstan, with the transfer of its functions in the field of population migration, as well as on refugee issues, with the exception of the functions of quotas for attracting foreign labor and paying one-time allowances and compensations to Oralmans and their family members who arrived under the immigration quota of Oralmans, to the Ministry of Internal Affairs of the Republic of Kazakhstan;

2) state institutions - administrators of courts in the regions, the city of republican significance and the capital of the Committee for Judicial Administration under the Supreme Court of the Republic of Kazakhstan, according to the annex to this Decree, by dividing them into state institutions - territorial bodies (court offices) in the regions, the capital and cities of republican significance of the Department for Ensuring the Activities of Courts under the Supreme Court of the Republic of Kazakhstan (Office of the Supreme Court of the Republic of Kazakhstan) and state institutions - territorial bodies of the Committee for the Execution of Judicial Acts of the Ministry of Justice of the Republic of Kazakhstan.

2. To the Government of the Republic of Kazakhstan:

1) abolish the Migration Committee of the Ministry of Labor and Social Protection of the Population of the Republic of Kazakhstan;

2) to form a Committee for the Execution of judicial acts of the Ministry of Justice of the Republic of Kazakhstan with territorial divisions;

3) to ensure the redistribution of the staffing of the abolished and reorganized state bodies of the Republic of Kazakhstan.

3. To approve the attached list of state institutions - territorial bodies (court offices) in the regions, capital and cities of republican significance of the Department for Ensuring the Activities of Courts under the Supreme Court of the Republic of Kazakhstan (office of the Supreme Court of the Republic of Kazakhstan).

4. To make amendments and additions to the following decrees of the President of the Republic of Kazakhstan:

1) to the Decree of the President of the Republic of Kazakhstan dated January 22, 1999 No. 29 "On measures for further optimization of the system of state bodies of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 1999, No. 1, art. 2; 2000, No. 54, art. 593; 2001, No. 1-2, art. 2; No. 4-5 43; 2002, No. 26, Article 272; No. 45, Article 445; 2003, No. 12, Article 130; No. 16, Article 160; 2004, No. 13, Article 166; No. 21, Article 267; No. 27, Article 344; No. 48, Article 590; 2005, No. 16, Article 189; No. 27, Article 329; No. 30, Article 380; No. 49, Article 623; 2006, No. 7, Article 50; No. 26, Article 264; No. 28, Article 299; No. 30, Article 320; 2007, No. 30, Article 330; No. 33, Article 361; 2008, No. 10, Article 105; 2009, No. 5, Article 13; 2010, No. 27, Article 205):

in appendix 1 to the above-mentioned Decree:

to state it in the following wording:

in appendix 3 to the above-mentioned Decree:

to exclude the staff limit of the Committee on Judicial Administration under the Supreme Court of the Republic of Kazakhstan;

in appendix 4 to the above-mentioned Decree:

in the line "Financial police authorities of the Republic of Kazakhstan", replace the numbers "3945" with the numbers "3970";

in the line "Agency of the Republic of Kazakhstan for Combating Economic and Corruption Crimes (Financial Police)", replace the numbers "338" with the numbers "363";

2) abrogated by Decree of the President of the Republic of Kazakhstan dated 04/17/2019 No. 26.

3) to the Decree of the President of the Republic of Kazakhstan dated December 29, 1999 No. 317 "On approval of the Register of positions of political civil servants and the Rules for imposing disciplinary penalties on political civil servants" (SAPP of the Republic of Kazakhstan, 1999, No. 58, art. 559; 2002, No. 18, art. 196; No. 32, art. 339; 2003, No. 20, Article 201; 2004, No. 19, Article 234; No. 21, Article 265; No. 33, Article 439; 2005, No. 27, Article 329; No. 30, Article 380; 2006, No. 23, Article 229; No. 39, Article 429; 2007, No. 43, Article 499; 2008, No. 9, Article 89; 2010, No. 2, Article 12):

in the Register of positions of Political Civil Servants approved by the above-mentioned Decree:

in the line "Heads of the offices of the Senate and Mazhilis of the Parliament of the Republic of Kazakhstan, the Supreme Court of the Republic of Kazakhstan, their deputies and heads of the offices of the Constitutional Council, the Office of the President of the Republic of Kazakhstan, the Accounting Committee for Control over the Execution of the Republican Budget", replace the words "Supreme Court of the Republic of Kazakhstan" with the words "head of the Department for Ensuring the Activities of Courts under the Supreme Court of the Republic of Kazakhstan Kazakhstan (Office of the Supreme Court of the Republic of Kazakhstan)";

in the line "Chairman of the Committee on Judicial Administration at the Supreme Court of the Republic of Kazakhstan and his deputies, Head of the Medical Center of the Office of the President of the Republic of Kazakhstan and his deputies", replace the words "Chairman of the Committee on Judicial Administration at the Supreme Court of the Republic of Kazakhstan and his Deputies, head" with the word "Chief";

4) abrogated by Decree of the President of the Republic of Kazakhstan dated 07/31/2023 No. 290; 5) abrogated by Decree of the President of the Republic of Kazakhstan dated 05.05.2018 No. 681;

6) to the Decree of the President of the Republic of Kazakhstan dated December 28, 2007 No. 501 "On measures to optimize positions of civil servants" (SAPP of the Republic of Kazakhstan, 2007, No. 49, Article 599; 2008, No. 9, Article 89; 2009, No. 12, Article 69):

in the Register of positions of administrative civil servants by category, approved by the said Decree:

in the heading of the section "Category Group B":

Replace the words "Office of the Supreme Court of the Republic of Kazakhstan" with the words "Department for Ensuring the Activities of Courts under the Supreme Court of the Republic of Kazakhstan (Office of the Supreme Court of the Republic of Kazakhstan)";

in the heading of the section "Category group C":

The words "Committee on Judicial Administration under the Supreme Court of the Republic of Kazakhstan" should be deleted;

7) to the Decree of the President of the Republic of Kazakhstan dated March 11, 2008 No. 552 "On approval of the Regulations on the Administration of the President of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 2008, No. 12-13, Article 116; 2009, No. 24-25, Article 207):

in the Regulations on the Administration of the President of the Republic of Kazakhstan, approved by the above-mentioned Decree:

In the fifth paragraph of subparagraph 1) of paragraph 32, the words "Committee on Judicial Administration under the Supreme Court" should be replaced by the words "Department for Ensuring the Activities of Courts under the Supreme Court of the Republic of Kazakhstan (Office of the Supreme Court of the Republic of Kazakhstan)".

7. State bodies shall take measures resulting from this Decree.

8. Invalidate:

1) Decree of the President of the Republic of Kazakhstan dated September 1, 2000 No. 440 "On measures to strengthen the independence of the judicial system of the Republic of Kazakhstan";

2) Decree of the President of the Republic of Kazakhstan dated October 12, 2000 No. 471 "On measures to ensure the functioning of the new judicial administration system" (SAPP of the Republic of Kazakhstan, 2001, No. 1-2, art. 2; 2007, No. 30, art. 330; 2010, No. 27, art. 205);

3) subparagraph 2) of paragraph 3 of Decree of the President of the Republic of Kazakhstan dated January 22, 2001 No. 536 "On measures to improve law enforcement activities in the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 2001, No. 1-2, art. 2);

4) Decree of the President of the Republic of Kazakhstan dated January 25, 2005 No. 1514 "On Amendments to Decree of the President of the Republic of Kazakhstan dated October 12, 2000 No. 471";

5) Subparagraph 2) of paragraph 1 of Decree of the President of the Republic of Kazakhstan dated August 23, 2007 No. 387 "On Amendments and additions to Certain Decrees of the President of the Republic of Kazakhstan on judicial administration" (SAPP of the Republic of Kazakhstan, 2007, No. 30, art. 330);

6) subparagraph 2) of paragraph 1 of Decree of the President of the Republic of Kazakhstan dated April 9, 2010 No. 970 "On Amendments and additions to certain Decrees of the President of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 2010, No. 27, art. 205).

9. This Decree shall enter into force from the date of signing.
