On the ratification of the Agreement on the Supply of Goods for the Provision of National Hydrometeorological Services of the Member States of the Commonwealth of Independent States

In accordance with article 2 of the Law of the Republic of Kazakhstan dated December 10, 1993 "On the temporary delegation of additional powers to the President of the Republic of Kazakhstan and heads of local administrations", I decree:
1. To ratify the Agreement on the Supply of Goods for the Provision of National Hydrometeorological Services of the Member States of the Commonwealth of Independent States, signed in Moscow on September 9, 1994.
2. This Decree shall enter into force from the date of publication.

It shall enter into force from the moment of signature, and for the Parties whose legislation requires the ratification or approval of such agreements, from the date of their deposit of instruments of ratification or notifications to the depositary.: Republic of Azerbaijan, Republic of Armenia, Republic of Belarus, Georgia, Republic of Kazakhstan, Kyrgyz Republic, Republic of Moldova, Russian Federation, Republic of Tajikistan, Turkmenistan, Republic of Uzbekistan, Ukraine
Notifications have been submitted:
The Republic of Uzbekistan - deposited on March 24, 1997; the Republic of Tajikistan - deposited on July 22, 1997; Turkmenistan - deposited on August 18, 1999; the Republic of Armenia - deposited on April 27, 2000; the Republic of Moldova - deposited on January 24, 2001.
The instruments of ratification have been handed over:
Ukraine - deposited on May 26, 1997; the Republic of Belarus - deposited on December 18, 1997; the Republic of Kazakhstan - deposited on January 15, 1999.
The Agreement entered into force from the moment of signing.

The Republic of Uzbekistan - September 9, 1994 (from the moment of signing); the Republic of Tajikistan - September 9, 1994 (from the moment of signing); Turkmenistan - September 9, 1994 (from the moment of signing); The Republic of Armenia - September 9, 1994 (from the moment of signing); Ukraine - May 26, 1997; the Republic of Belarus - December 18, 1997; the Republic of Kazakhstan - January 15, 1999; the Republic of Moldova - January 24, 2001.

The Governments of the States Parties to this Agreement, hereinafter referred to as the Parties, based on the Agreement on Cooperation in the Field of Hydrometeorology dated February 8, 1992, taking into account the prevailing situation in the territories of the States - the members of the Commonwealth of Independent States, specializing in the production of hydrometeorological instruments, aware of the need to comply with the agreed methodology of observations, technology for collecting, distributing and storing hydrometeorological information and data on the state of the natural environment, including in the event of natural disasters, as well as the implementation of relevant government programs, international obligations under the World Meteorological Organization, agreed as follows:
Article 1
The subject of this Agreement is hydrometeorological instruments, equipment, spare parts for them, consumable aerological materials (related to raw materials), hereinafter referred to as "goods", used by national hydrometeorological services to ensure operational observations of the state of the atmosphere, soil, water resources, collection, distribution. and storage of relevant information, according to the attached "Product List".
Article 2
The volume of goods to be exported (imported) is determined by bilateral agreements (contracts) between the national hydrometeorological services of the member States of the Commonwealth of Independent States. Goods exported (imported) under the conditions provided for in this Agreement must be used by national hydrometeorological services exclusively for the purposes specified in Article 1 of this Agreement.
Article 3
Goods supplied in accordance with this Agreement on the basis of bilateral agreements (contracts) are exempt from customs duties and taxes, as well as are not subject to licensing and quotas. Export (import) restrictions established for economic policy reasons by acts of national legislation do not apply to these goods.
Article 4
A Party that has identified violations of the terms of this Agreement by the other Party has the right to unilaterally impose tariff and non-tariff regulation measures on the export and import of goods to be used in accordance with Article 1 of this Agreement.
Article 5
This Agreement is open for accession by other member States of the Commonwealth of Independent States that fully share its goals and principles.
Article 6
The Party has the right to withdraw from this Agreement by notifying the depositary, the Government of the Republic of Belarus, of its decision in writing, at least twelve months before the expected withdrawal.
Article 7
This Agreement shall enter into force from the date of signature, and for the Parties whose legislation requires the ratification or approval of such agreements, from the date of their deposit of instruments of ratification or notifications to the depositary.
Done in Moscow on September 9, 1994, in one original copy in the Russian language. The original copy is kept in the archives of the Government of the Republic of Belarus, which will send a certified copy to each signatory State of this Agreement.
