On signing the Protocol to the Agreement between the Republic of Tajikistan, the Kyrgyz Republic, the Republic of Kazakhstan and the Ismaili Imamate on the Establishment of the University of Central Asia

 To be published in the Acts of the President and Government of the Republic of Kazakhstan    

      I DECREE:

     1. To approve the draft Protocol to the Agreement between the Republic of Tajikistan, the Kyrgyz Republic, the Republic of Kazakhstan and the Ismaili Imamate on the establishment of the University of Central Asia.

     2. To authorize the Minister of Education and Science of the Republic of Kazakhstan, Tuimebayev Zhanseit Kanseituly, to sign on behalf of the Republic of Kazakhstan the Protocol to the Agreement between the Republic of Tajikistan, the Kyrgyz Republic, the Republic of Kazakhstan and the Ismaili Imamate on the establishment of the University of Central Asia.

     3. This Decree shall enter into force from the date of signing.

 DRAFT PROTOCOL to the Agreement between the Republic of Tajikistan, the Kyrgyz Republic, the Republic of Kazakhstan and the Imamat Ismailov on the establishment of the University of Central Asia

     The Republic of Kazakhstan and the Ismaili Imamate (hereinafter referred to as the "Parties"), in order to apply the terms used in the Agreement between the Republic of Tajikistan, the Kyrgyz Republic, the Republic of Kazakhstan and the Ismaili Imamate on the Establishment of the University of Central Asia (hereinafter referred to as the Agreement), have agreed as follows:

 Article 1

     The term "taxes" used in the Agreement and the Charter of the University of Central Asia (Annex A to the Agreement), for the Kazakh Side, means taxes and other mandatory payments to the budget established by  The Code of the Republic of Kazakhstan "On Taxes and other mandatory payments to the Budget" (Tax Code).

 Article 2

     This Protocol is an integral part of the Agreement.

 Article 3

     This Protocol may be signed unilaterally by the Republic of Kazakhstan in Astana (Kazakhstan) and the Ismaili Imamate in Paris (French Republic), followed by sending a signed copy for signature to the other Party. The day of signing of this Protocol is considered to be the day of signing by the last Signatory Party.

 Article 4

     This Protocol shall enter into force on the date of receipt by the Ismaili Imamate of a written notification from the Kazakh Side of its ratification by the Republic of Kazakhstan.

 Article 5

     This Protocol is drawn up in two copies, each in Kazakh, English and Russian, and all texts have the same validity.      In case of discrepancies in the interpretation of the provisions of this Protocol, the Parties shall refer to the English text.
