I DECREE:
1. To approve the attached draft Agreement between the Republic of Kazakhstan and the Portuguese Republic on visa exemption for holders of diplomatic passports.
2. Secretary of State of the Republic of Kazakhstan — Minister of Foreign Affairs of the Republic of Kazakhstan Saudabayev Kanat Bekmurzaevich to sign on behalf of the Republic of Kazakhstan an Agreement between the Republic of Kazakhstan and the Portuguese Republic on the exemption of holders of diplomatic passports from visas with the right to make amendments and additions to it that are not of a fundamental nature.
3. This Decree shall enter into force from the date of signing.

The Republic of Kazakhstan and the Portuguese Republic, hereinafter referred to as the "Parties", wishing to strengthen friendly relations and cooperation between the two States, wishing to facilitate the travel of their citizens with diplomatic passports, have agreed as follows:
Article 1 Aims
This Agreement establishes the legal norms for visa exemption for holders of diplomatic passports of the Parties.
Article 2 Definitions
For the purposes of this Agreement, the following provisions mean: a) "valid passport" - a diplomatic passport of the Parties, which at the time of departure from the territory of one of the Parties is valid for at least three months; b) "family member" - spouse, as well as children and dependents of holders of valid passports of the Parties..
Article 3 Short-term stay
1. Citizens of the Republic of Kazakhstan who hold valid passports of the Republic of Kazakhstan may enter and stay in the territory of the Portuguese Republic without a visa for a maximum period of up to 90 (ninety) days within a six-month period from the date of first entry into the external border of the free movement zone established by the States that are parties to the Convention on the Application of the Schengen Agreement of June 14. 1985, adopted on June 19, 1990. 2. Citizens of the Portuguese Republic who hold valid passports of the Portuguese Republic may enter and stay in the territory of the Republic of Kazakhstan without a visa for a maximum period of up to 90 (ninety) days within a six-month period from the date of first entry.
Article 4 Entry and stay
1. Holders of valid passports appointed to the diplomatic mission or consular office of the Republic of Kazakhstan in the Portuguese Republic or to an international organization in the Portuguese Republic, as well as their family members holding valid passports, may enter and stay in the territory of the Portuguese Republic without a visa for the period of their appointment. 2. Holders of valid passports appointed to the diplomatic mission or consular office of the Portuguese Republic in the Republic of Kazakhstan or to an international organization in the Republic of Kazakhstan, as well as their family members holding valid passports, may enter and stay in the territory of the Republic of Kazakhstan without visas for the period of their appointment. 3. For the purposes specified in the preceding paragraphs, each of the Parties is obliged to inform in writing and through diplomatic channels about the arrival of holders of valid passports assigned to a diplomatic mission or international organizations in the territory of the Parties, as well as their family members holding valid passports accompanying them, prior to the date of their arrival in the territory of the other Party.
Article 5Compliance with national legislation
1. Visa exemption does not release a person from the obligation to comply with the national legislation of the Parties upon entry, stay and exit from the territory of the State of residence of holders of valid passports in accordance with the provisions established in this Agreement. 2. This Agreement does not exclude the right of the competent authorities of each of the Parties to refuse entry or stay to citizens of the other Party in accordance with its national legislation.
Article 6 Information about passports
1. The Parties shall exchange through diplomatic channels samples of valid passports no later than 30 (thirty) days after the date of entry into force of this Agreement. 2. If one of the Parties introduces new diplomatic passports or modifies them, it must inform the other Party by sending through diplomatic channels a sample of the new or modified passport no later than 30 (thirty) days prior to the date of commencement of their use.
Article 7 Dispute settlement
Any disputes arising from the interpretation or use of this Agreement shall be resolved by the Parties through negotiations and through diplomatic channels.
Article 8 Suspension of action
1. Each of the Parties may suspend the operation of this Agreement in whole or in part in order to ensure public order, public health or national security. 2. The other Party shall be notified in writing through diplomatic channels of the suspension of this Agreement no later than 3 (three) days prior to its application.
Article 9references
By mutual agreement of the Parties, amendments may be made to this Agreement, which are its integral parts and are formalized by separate protocols that enter into force in accordance with the procedure provided for in Article 11 of this Agreement.
Article 10The duration and termination
1. This Agreement is concluded for an indefinite period. 2. Either Party may terminate this Agreement at any time by sending a written notification through diplomatic channels. 3. This Agreement shall terminate upon the expiration of 3 (three) months after receipt of the written notification provided for in paragraph 2 of this Article.
Article 11 Entry into force
This Agreement shall enter into force 30 (thirty) days after the date of receipt through diplomatic channels of the last written notification by the Parties of the completion of the internal procedures necessary for its entry into force.
Article 12 Registration
After the entry into force of this Agreement, the Portuguese Side shall forward it to the United Nations Secretariat for registration in accordance with Article 102 of the Charter of the United Nations and notify the Republic of Kazakhstan of its registration number.
Committed in the city ___________, "____" ___________ 2010 in two original copies, each in Kazakh, Portuguese, English and Russian, all texts being equally authentic. In case of disagreement in the interpretation of this Agreement, the Parties will refer to the English text.
