In accordance with article 8 of the Law of the Republic of Kazakhstan dated May 30, 2005 "On International Treaties of the Republic of Kazakhstan"
I DECREE:
1. To approve the attached draft Agreement between the Republic of Kazakhstan and the Russian Federation on the establishment of a Unified regional air Defense system of the Republic of Kazakhstan and the Russian Federation.
2. Authorize the Minister of Defense of the Republic of Kazakhstan, Adilbek Ryskeldinovich Dzhaksybekov, to sign on behalf of the Republic of Kazakhstan an Agreement between the Republic of Kazakhstan and the Russian Federation on the creation of a Unified regional air Defense System of the Republic of Kazakhstan and the Russian Federation, authorizing amendments and additions that are not fundamental.
3. This Decree shall enter into force from the date of signing.

The Republic of Kazakhstan and the Russian Federation, hereinafter referred to as the Parties, guided by the Agreement on the Establishment of a unified air defense system of the member States of the Commonwealth of Independent States dated February 10, 1995, the decision of the Collective Security Council of the Collective Security Treaty Organization on the development and improvement of air defense of the member States of the Collective Security Treaty Organization dated June 23, 2005, in accordance with the Concept of Further Development of the Commonwealth of Independent States, approved by the decision of the Council of Heads of State of the Commonwealth of Independent States of October 5, 2007, agreed on the following:
Article 1
The concepts used in this Agreement mean the following: the external border of the region is the borders of the Parties with other states within the region; troops (forces) The Unified regional air Defense System of the Republic of Kazakhstan and the Russian Federation - military management bodies, control points (command posts), as well as associations, formations and military units of the armed forces of the Parties involved in solving air defense tasks in the region; the period of increasing military threat is the period of time during which the threat of an armed attack on one of the Parties in the region has arisen and persists; region is the territory and airspace of the Parties within the Central Asian region of collective Security, within which troops (forces) allocated to the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation perform assigned tasks.
Article 2
The authorized bodies of the Parties for the implementation of this Agreement are: from the Kazakh Side - the Ministry of Defense of the Republic of Kazakhstan; from the Russian Side - the Ministry of Defense of the Russian Federation. In the event of a change in their authorized bodies, the Parties shall immediately inform each other about this through diplomatic channels.
Article 3
In order to solve the problems of air defense in the region, the Parties are creating a Unified regional Air Defense System of the Republic of Kazakhstan and the Russian Federation, which is an integral part of the unified air defense system of the member States of the Commonwealth of Independent States. The main tasks, principles of building and using the troops (forces) of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation are determined by the Regulations on the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation, attached to this Agreement and forming an integral part of it.
Article 4
The list of military command bodies, command posts, associations, formations and military units allocated to the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation is approved jointly by the Ministers of Defense of the Parties within three months from the date of entry into force of this Agreement. Changes may be made to this list as necessary.
Article 5
Troops (forces) The Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation is headed by a commander who, after the entry into force of this Agreement, is appointed by the President of the Republic of Kazakhstan and the President of the Russian Federation on the recommendation of the Ministers of Defense of the Parties.
Article 6
Authorized bodies of the Parties in peacetime together with the commander of the troops (forces) The Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation plan the use of troops (forces) of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation, organize their air defense combat duty and interaction.
Article 7
During the period of increasing military threat and in wartime, the Parties reserve the right to decide on the use of their troops (forces) and means in accordance with the procedure provided for by their legislation. A part of the troops (forces) from the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation may, by agreement of the Parties, be allocated to the coalition group of troops (forces) of the armed forces of the Republic of Kazakhstan and the Russian Federation.
Article 8
Coordination of joint actions of the troops (forces) of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation and other troops (forces) that are part of the Unified air defense system of the member States of the Commonwealth of Independent States in peacetime is carried out from the command post of the Commander-in-Chief of the Aerospace Defense Forces of the Armed Forces of the Russian Federation.
Article 9
The creation and operation of a Unified regional Air Defense System of the Republic of Kazakhstan and the Russian Federation does not change the existing procedure for financing the armed forces of the Parties within the framework of the unified air defense system of the member States of the Commonwealth of Independent States.
Article 10
The use and development of military infrastructure facilities, the creation of material reserves for the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation, as well as their maintenance in readiness for use in the interests of ensuring the security of the Parties is carried out on the basis of relevant international agreements between authorized bodies in accordance with the legislation of the Parties.
Article 11
The Parties shall ensure the protection of classified information obtained by them during the implementation of this Agreement in accordance with the Agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on Mutual Protection of Classified Information dated July 7, 2004. Each of the Parties, in accordance with its legislation, also ensures the safety and protection of information created in the course of this cooperation. The Parties limit as much as possible the circle of persons who have access to such information. In the event of termination of this Agreement, the Parties shall not disclose classified information and other information received by them during its implementation that is not subject to dissemination.
Article 12
Disagreements and disputes between the Parties that may arise in the interpretation and application of this Agreement shall be resolved through consultations and negotiations.
Article 13
This Agreement may be amended and supplemented by mutual agreement of the Parties, which are formalized in separate protocols that are an integral part of this Agreement.
Article 14
This Agreement shall enter into force on the date of receipt, through diplomatic channels, of the last written notification that the Parties have completed the internal procedures necessary for its entry into force. This Agreement is concluded for a period of five years. In the future, its validity is automatically extended for subsequent five-year periods, unless either Party notifies the other Party in writing through diplomatic channels of its intention to terminate it at least six months before the expiration of the current five-year period.
Committed in the city ____________ "___" ___________ 20__ in two original copies, each in Kazakh and Russian, all texts being equally authentic. In case of discrepancies in the interpretation of the provisions of this Agreement, the Parties will refer to the text in Russian.

Provisions on the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation
This Regulation defines the main tasks, principles of construction and application of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation.
1. Tasks solved by the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation
1. In peacetime, the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation is charged with solving the following tasks: 1) continuous radio engineering, radar reconnaissance and radio intelligence, timely disclosure of the preparation and launch of an enemy air attack; 2) protection and protection of airspace at the junctions of the state borders of the Parties; 3) control over compliance with the order use of the airspace of the Parties in the region; 4) forcing aircraft performing flights in violation of established rules to stop violations or to stop such flights; 5) notifying the troops (forces) of the armed forces of the Parties about overflights of reconnaissance space assets and issuing information about the air situation in the notification networks; 6) carrying out radar control of airspace and transmitting data on the movement of aircraft and other air objects to the air traffic management authorities of the Parties in the Central Asian region of collective security in cases stipulated by the rules for the use of the airspace of the Parties, as well as providing assistance to aircraft in the event of force majeure in flight. 2. Representatives of the Chairman of the Coordinating Committee on Air Defense under the Council of Defense Ministers of the Commonwealth of Independent States, as well as the Chief of the Joint Staff of the Collective Security Treaty Organization, may be sent to the headquarters of the Air Defense Forces of the Republic of Kazakhstan and the Aerospace Defense Forces of the Armed Forces of the Russian Federation in coordination with the relevant Minister of Defense. 3. Commander of the troops (forces) The Unified Regional Air Defense System is guided in its activities by the decisions of the Council of Heads of State of the Commonwealth of Independent States and the Council of Defense Ministers of the Member States of the Commonwealth of Independent States, as well as this Agreement. 4. During the period of increasing military threat and in wartime, troops (forces) The Unified regional Air Defense System of the Republic of Kazakhstan and the Russian Federation performs tasks according to a single plan and plan in accordance with the plans for the use of the armed forces of the Republic of Kazakhstan and the Russian Federation.
2. Principles of construction and application of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation

The construction and application of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation is based on the following principles: 1) coordination of joint actions of the troops (forces) of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation in peacetime; 2) maintaining the direct subordination of the troops (forces) of the Unified Regional System and Air Defense of the Republic of Kazakhstan and the Russian Federation national commands; 3) the use of troops (forces) of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation according to a single plan and plan in wartime; 4) the unity of approaches to determining the requirements for combat readiness and training of troops (forces) of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation, the organization of their operational and combat training; 5) development of the regulatory legal framework that ensures the functioning of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation.
3. Fundamentals of the application of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation

In peacetime, the tasks assigned to the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation are solved by troops (forces) The Unified regional Air Defense System of the Republic of Kazakhstan and the Russian Federation in accordance with the action plan of the air defense troops (forces) on duty of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation, which is approved by the Ministers of Defense of the Parties. 7. When reconnaissance means reveal a mass flight of enemy air attack assets in the direction of the external border of the region, the air defense forces and assets on duty are transferred to readiness No. 1, the authorized bodies of the Parties notify each other of the situation and tasks set, acting in accordance with the instructions of higher-ranking officials to whom they report, the current situation, and the action plan of those on duty air defense of the troops (forces) of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation. 8. The procedure for dealing with the threat of aircraft violating the external border of the region is as follows: 1) if an unidentified aircraft is detected approaching the external border of the region, the authorized bodies of the Parties shall take measures to establish communication with it, and also assign the task to subordinate formations, military units and units of radio engineering troops, intelligence and electronic warfare to establish its classification. When establishing communication, the authorized bodies of the Parties shall warn the aircraft crew of a possible entry or fact of entry into the airspace of the Parties by transmitting established international commands (phrases) and issue commands to prevent violations of the external border of the region or to terminate the flight in their airspace. If it is necessary to assist the specified aircraft in stopping violations of the external border of the region (due to unintended actions of the aircraft crew or as a result of emergency circumstances in flight), the operational officers on duty give the command to lift the required number of aircraft crews (helicopters) in the air to take this aircraft outside the airspace of the Parties or land on the nearest a (dedicated) airfield on the territory of the Republic of Kazakhstan or the Russian Federation; 2) upon receiving information about the fact that an aircraft has crossed the external border of the region, which has not been detected by radar means, the necessary number of radio engineering units is put on alert No. 1 to enhance radar reconnaissance. In the future, the air defense forces on duty will act in accordance with the requirements of subparagraph 1) of this paragraph.; 3) if the air defense forces and facilities of the Republic of Kazakhstan or the Russian Federation detect an unidentified aircraft violating the external border of the region, violating the procedure for using the airspace of the Republic of Kazakhstan or the Russian Federation, or an aircraft flying towards the external border of the region, the authorized bodies of the Parties shall inform each other about this and organize the issuance of radar information through the channels of interaction. 9. The procedure for the use of weapons and military equipment by the air defense forces on duty against an aircraft violating the external border of the region is determined by the legislation of the Party over whose territory the aircraft is located. 10. The air defense crews of aircraft (helicopters) of the armed forces of one Party on duty in the air space of the other Party are lifted into the air to solve the tasks of combat duty in the airspace of the other Party by an agreed decision of the operational duty officer of the main command post of the Air Defense Forces of the Armed Forces of the Republic of Kazakhstan and the commander of the duty forces of the command post of the Aerospace Defense Forces of the Armed Forces of the Russian Federation. Mutual information is provided to each other about all cases of lifting of aircraft (helicopter) crews on duty. 11. In peacetime, the authorized bodies of the Parties shall manage the daily activities of the troops (forces) of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation, their training and comprehensive support.
4. Duties of the commander of the troops (forces)The Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation
12. Duties of the commander of the troops (forces) The Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation includes: 1) the development of an action plan for the air defense duty forces of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation; 2) leadership of the troops (forces) The Unified regional Air Defense System of the Republic of Kazakhstan and the Russian Federation, included in the regional grouping of troops (forces) of the Republic of Kazakhstan and the Russian Federation, carried out in accordance with the unified operational plan for the use of troops (forces) of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation; 3) organization, together with the authorized bodies of the Parties, of interaction of the troops (forces) of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation with other troops (forces) of the armed forces of the Parties in the region; 4) participation in the organization of combat duty for the air defense of troops (forces) The armed Forces of the Parties in the region and the development of an air defense combat duty schedule with radar and automation systems enabled for units and subunits of the radio engineering forces that are part of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation; 5) coordination of joint actions of the troops (forces) of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation Federations; 6) preparation of proposals for the further development of the troops (forces) of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation and increasing their combat readiness jointly with the authorized bodies of the Parties; 7) preparation of proposals for the organization and conduct of training events for the troops (forces) of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation. 13. The authorized bodies of the Parties determine the organizational and staff structure of the command of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation, which is the operational control body of the troops (forces) The Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation with the provision of functions for the development of planning documents for the use of forces and means of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation, as well as training and performing air defense tasks. The creation of this structure will be carried out at the expense and within the established staffing levels of the authorized bodies of the Parties. 14. The duties of officials of the command of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation are coordinated with the Commander-in-Chief of the Air Defense Forces of the Armed Forces of the Republic of Kazakhstan, Commander-in-Chief of the Aerospace Defense Forces of the Armed Forces of the Russian Federation and approved by the Commander of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation. 15. The location of the command of the Unified Regional Air Defense System of the Republic of Kazakhstan and the Russian Federation is the Republic of Kazakhstan, Almaty.
