In accordance with Article 2 of the Law of the Republic of Kazakhstan dated December 10, 1993 Z933600_ "On the temporary delegation of additional powers to the President of the Republic of Kazakhstan and heads of local administrations", I decree:
1. To ratify the Agreement between the Government of the Republic of Kazakhstan and the Government of the Socialist Republic of Vietnam on Trade and Economic Cooperation, signed in Almaty on February 1, 1994.
2. This Decree shall enter into force from the date of publication.

The Government of the Republic of Kazakhstan and the Government of the Socialist Republic of Vietnam, hereinafter referred to as the "Parties", in order to strengthen and develop trade and economic cooperation between the Republic of Kazakhstan and the Socialist Republic of Vietnam, guided by the principles of equality, mutual benefit and international law in the implementation of mutual trade and economic relations, have agreed as follows:
Article 1
1. The Parties, within the framework of the laws and regulations in force in each country, will take the necessary measures to develop and deepen trade and economic cooperation between the Republic of Kazakhstan and the Socialist Republic of Vietnam and will create appropriate favorable conditions for this purpose.
2. The Parties will promote the development of economic and trade relations in areas of mutual interest between the participants in the foreign economic activity of the two countries, hereinafter referred to as "entities", in accordance with the legislation in force in each country and the provisions of this Agreement.
Article 2 The Parties shall grant each other the most-favored-nation treatment in respect of customs duties and other charges, as well as the manner in which such customs duties and other charges are levied on the import and export of goods.
The Parties will provide each other with non-discriminatory treatment regarding the application of quantitative restrictions and the issuance of licenses for exported and imported goods in mutual trade.
However, the above provisions do not apply to:
a) advantages that each of the Parties has provided or may provide to neighboring countries to facilitate cross-border trade;
b) advantages that are provided or may be provided as a result of the participation of any of the Parties in free trade zones, customs unions or other regional agreements.
Article 3 The provisions of this Agreement do not limit the right of each of the Parties to take measures to ban or restrict the export, import and transit of goods aimed at:
- protection of national security;
- protection of human life and health, prevention of animal and plant diseases;
- protection of national artistic, historical and archaeological values.
Such prohibitions and restrictions should not, however, constitute a means of unjustifiable discrimination or disguised restrictions on trade between the two countries.
Article 4 The supply of goods and services will be carried out on the basis of contracts concluded between the subjects of the Republic of Kazakhstan and the subjects of the Socialist Republic of Vietnam in accordance with the legislation of each country and the provisions of this Agreement.
Article 5 Prices of goods and services in trade and economic relations will be agreed in contracts between the subjects of the two countries on the basis of current world prices and conditions accepted in international trade and financial practice.
Article 6 Settlements and payments for goods and services in trade and economic relations between the Republic of Kazakhstan and the Socialist Republic of Vietnam will be carried out in freely convertible currency through banks authorized to engage in international banking operations and in accordance with the legislation of each country, unless the Parties agree otherwise.
Article 7 In order to review the implementation of this Agreement, authorized representatives of the Parties will meet alternately in Almaty and Hanoi and, if necessary, take appropriate measures.
Article 8 Disputes between the entities of both countries will be resolved in accordance with the agreements contained in the contracts or separate written agreements between the Signatories.
Article 9 This Agreement may be amended or supplemented in writing by agreement of the Parties.
Article 10 This Agreement shall enter into force on the day when the Parties notify each other of the fulfillment of the requirements necessary for its entry into force in accordance with the legislation of each country and will remain in force until one of the Parties notifies the other Party of its intention to terminate no later than 6 months in advance. this Agreement.
Upon termination of this Agreement, its provisions will apply to all obligations assumed during the period of validity of this Agreement until they are fully fulfilled.
Done in Almaty on February 1, 1994, in two original copies, each in the Kazakh and Vietnamese languages, both texts being equally authentic.
Each copy of this Agreement is accompanied by its official translation in Russian, which the Parties will follow in case of disagreement on the interpretation of its individual provisions.
