On improving the bodies of external state financial control in the regions

Decree of the President of the Republic of Kazakhstan dated May 2, 2011 No. 67.

     In order to improve the system of state financial control, I DECREE:

     1. To recommend maslikhats of regions (capital, cities of republican significance), district (cities of regional significance) to abolish audit commissions and their offices.

     2. Akims of regions, the capital, cities of national importance:

     1) at the expense of local budgets, taking into account the staffing of the abolished audit commissions of maslikhats, ensure the establishment of state institutions - audit commissions, which are state bodies, in accordance with the annex to this Decree;

     2) jointly with the maslikhats of the regions, the capital, and cities of republican significance, take other measures arising from this Decree.

     3. Define:

     1) the main task of the created audit commissions is the implementation of external state financial control over the execution of local budgets;

     2) the right of maslikhats of all levels to make proposals for the inclusion of control objects in the work plans of the audit commissions;

     3) that the audit commissions that are being established annually submit an annual report on the implementation of the local budget to the maslikhats of the relevant administrative-territorial units;

     4) that the appointment for a period of 5 years and dismissal of the chairmen and members of the audit commissions being created are carried out by maslikhats of regions, the capital, cities of republican significance, taking into account the qualification requirements established by legislative acts of the Republic of Kazakhstan;

     5) coordination of the activities of the audit commissions being created (methodology, advanced training, retraining) with the Accounting Committee for Control over the Execution of the Republican Budget.

     4. To approve the attached staffing limits for the audit commissions of the regions, the capital, and cities of national significance.

     5. To the Government of the Republic of Kazakhstan jointly with the Accounts Committee for Control over the Execution of the Republican Budget:

     1) within one month, develop and submit for consideration by the Mazhilis of the Parliament of the Republic of Kazakhstan a draft law aimed at implementing this Decree and regulating the mechanism of interaction and separation of powers between the bodies of external state financial control;

     2) take other measures resulting from this Decree.

     6. To make additions and amendments to the following decrees of the President of the Republic of Kazakhstan:

     1) abrogated by Decree of the President of the Republic of Kazakhstan dated December 29, 2015 No. 152 (effective from 01.01.2016);

     2) abrogated by Decree of the President of the Republic of Kazakhstan dated 05.05.2018 No. 681;

     3) to the Decree of the President of the Republic of Kazakhstan dated December 28, 2007 No. 501 "On measures to optimize positions of civil servants" (SAPP of the Republic of Kazakhstan, 2007, No. 49, Article 599; 2008, No. 9, Article 89; 2009, No. 12, Article 69; 2010, No. 51, V. 466):

     in the register of positions of administrative civil servants by category, approved by the said Decree:

     in the "Category Group D" section:

     add the following line to the title:

     "Audit commissions of regions, capitals, cities of national importance";

     Categories D-1 and D-2 should be formulated as follows:

     "Category D-1

     Chief of Staff of the Maslikhat of the region

     Category D-2

     Deputy Chief of Staff of the Akim of the region

     Deputy Chief of Staff of the maslikhat of the region".

     7. Control over the implementation of this Decree is entrusted to the Administration of the President of the Republic of Kazakhstan.

     8. This Decree shall enter into force from the date of signature, with the exception of paragraphs 1, 2 and 6 of this Decree, which shall enter into force as soon as the necessary legislative framework is adopted, but no later than June 30, 2011.
