On the creation of the special economic zone "Saryarka"

     In accordance with paragraph 8 of Article 7 of the Law of the Republic of Kazakhstan dated July 21, 2011 "On Special economic zones in the Republic of Kazakhstan", I HEREBY DECREE:

     1. To create a special economic zone "Saryarka" (hereinafter referred to as the FEZ) for the period until December 1, 2036.

     2. Approve the attached documents:

     1) Regulations on the FEZ;

     2) target indicators of the functioning of the FEZ and the critical level of failure to achieve the target indicators.

     3. The Government of the Republic of Kazakhstan should ensure the adoption of:

     1) relevant regulatory legal acts arising from this Decree;

     2) other measures for the implementation of this Decree.

     4. Control over the implementation of this Decree is entrusted to the Administration of the President of the Republic of Kazakhstan.

     5. This Decree shall enter into force from the date of signing.

Regulations on the special economic zone "Saryarka"1. General provisions

     1. The special Economic Zone "Saryarka" (hereinafter referred to as the FEZ) is located on the territory of the city of Karaganda and the adjacent lands of the Bukhar-Zhyrau district of the Karaganda region according to the attached plan.

     The territory of the FEZ is 595.01 hectares and is an integral part of the territory of the Republic of Kazakhstan. The territory of the FEZ includes the Metallurgy-Metalloobrabotka Industrial Park with an area of 534.9 hectares and the Silicon Valley subzone No. 1 with an area of 60.11 hectares.

     2. The FEZ is created in order to:

     1) the development of the metallurgical industry and the metalworking industry, in particular the production of finished products by attracting manufacturers of world brands;

     2) development and implementation of breakthrough investment projects for the creation and development of the metallurgical industry and the world-class metalworking industry for deep processing of raw materials and the production of a wide range of competitive products with high added value;

     3) improving the quality and expanding the range of products;

     4) the integration of Kazakh products into the global production and marketing system, the creation of innovative, competitive domestic products in accordance with international standards;

     5) creation of highly efficient and innovative industries, including high-tech and competitive industries, development of new types of products;

     6) development and implementation of scientific research and scientific and technical innovation projects for the creation and improvement of production facilities and technologies for deep processing of raw materials;

     7) creating a favorable investment climate and attracting domestic and foreign investments for the implementation of investment projects;

     8) attracting investments in the construction and integrated development of the metallurgical industry based on public-private partnership mechanisms;

     9) accelerated development of the region to enhance the integration of the republic's economy into the system of global economic relations;

     10) improving the legal norms of market relations, introducing modern management and management methods;

     11) solving social problems and increasing employment.

     3. The activities of the FEZ are regulated by the Constitution of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan dated July 21, 2011 "On Special Economic Zones in the Republic of Kazakhstan", this Regulation and other regulatory legal acts of the Republic of Kazakhstan.

     4. The types of activities on the territory of the FEZ are:

     1) manufacturing industry, except for:

     food production;

     Beverage production;

     production of tobacco products;

     production of wooden and cork products, except furniture;

     production of straw products and materials for weaving;

     printing and reproducing recorded materials;

     Furniture production;

     repair and installation of machinery and equipment;

     2) construction and commissioning of facilities intended directly for carrying out the types of activities provided for in subparagraph 1) of this paragraph, within the limits of the design and estimate documentation.

2. FEZ management

     5. The management of the FEZ is carried out in accordance with the Law of the Republic of Kazakhstan dated July 21, 2011 "On Special economic zones in the Republic of Kazakhstan".

     6. The management of the FEZ is carried out by a management body - a management company created in the organizational and legal form of a joint-stock company to ensure the functioning of the FEZ.

3. Taxation on the territory of the FEZ

     7. FEZ participants are subject to taxes and other mandatory payments to the budget in accordance with the Code of the Republic of Kazakhstan dated December 10, 2008 "On Taxes and Other Mandatory Payments to the Budget (Tax Code)".

4. Customs regulation

     8. Customs regulation on the territory of the FEZ is carried out in accordance with the provisions of the customs legislation of the Customs Union and (or) the Code of the Republic of Kazakhstan dated June 30, 2010 "On Customs Affairs in the Republic of Kazakhstan" (hereinafter referred to as the Code).

     9. The customs procedure of the free customs zone is applied throughout the territory of the FEZ.

     Goods intended for placement and (or) use on the territory of the FEZ by persons engaged in priority activities on the territory of the FEZ in accordance with the agreement on carrying out activities as a participant in the FEZ are placed under the customs procedure of the free customs zone.

     10. The territory of the FEZ is a customs control zone. The borders of the FEZ along its perimeter are equipped with special fences for the purpose of customs control.

     11. Temporary storage facilities for goods may be established on the territory of the FEZ in accordance with the procedure established by the customs legislation of the Customs Union and (or) the Code.

     12. Goods placed under the customs procedure of the free customs zone, as well as goods of the Customs Union not placed under the customs procedure of the free customs zone, and foreign goods placed under other customs procedures may be placed and used on the territory of the FEZ.

     13. Goods imported into the territory of the FEZ and placed under the customs procedure of the free customs zone are considered to be located outside the customs territory of the Customs Union for the purposes of applying customs duties, taxes, and non-tariff regulatory measures.

     14. Customs operations related to temporary storage, customs declaration, customs clearance and release of goods, as well as customs control on the territory of the FEZ, are carried out in accordance with the procedure established by the customs legislation of the Customs Union and (or) the Code.

5. Environmental protection

     15. Activities on the territory of the FEZ are carried out in compliance with the requirements of the Environmental Code of the Republic of Kazakhstan dated January 9, 2007 and international environmental and environmental standards.

6. Guarantees of legal protection of FEZ participants

     16. FEZ participants are guaranteed protection of their rights and interests, which is provided by the Constitution of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan dated July 21, 2011 "On Special Economic Zones in the Republic of Kazakhstan", the Law of the Republic of Kazakhstan dated January 8, 2003 "On Investments" and other regulatory legal acts of the Republic of Kazakhstan, as well as international treaties ratified by the Republic of Kazakhstan.

7. The procedure and timing of the abolition of the FEZ

     17. The FEZ is abolished after the expiration of the period for which it was created. The FEZ is abolished by the Decree of the President of the Republic of Kazakhstan on the proposal of the Government of the Republic of Kazakhstan.

     18. The early abolition of the FEZ is carried out in accordance with the Law of the Republic of Kazakhstan dated July 21, 2011 "On Special economic zones in the Republic of Kazakhstan".

8. Final provisions

     19. The activities of the FEZ, which are not regulated by this regulation, are carried out in accordance with the current legislation of the Republic of Kazakhstan and the Customs Union.
