About the Agency of the Republic of Kazakhstan for Consumer Protection

Decree of the President of the Republic of Kazakhstan dated November 13, 2013 No. 691

In accordance with subparagraph 3) Article 44 of the Constitution of the Republic of Kazakhstan

I DECREE:      

1. Reorganize The Ministry of Health of the Republic of Kazakhstan by separating the Agency of the Republic of Kazakhstan for Consumer Rights Protection (hereinafter referred to as the Agency) with the transfer to it of functions and powers in the field of: 1) consumer rights protection – from the Agency of the Republic of Kazakhstan for Protection of Competition (Antimonopoly Agency); 2) sanitary and epidemiological welfare of the population – from the Ministry of Health of the Republic of Kazakhstan;      3) monitoring and supervision of compliance with the requirements established by technical regulations and regulatory documents on products and services sold to consumers, as well as in the field of food safety at the stage of its implementation, from the Ministry of Industry and New Technologies of the Republic of Kazakhstan.      

2. The Government of the Republic of Kazakhstan: 1) to abolish the Committee for State Sanitary and Epidemiological Supervision of the Ministry of Health of the Republic of Kazakhstan (hereinafter referred to as the Committee); 2) to ensure the transfer of the appropriate staffing of the abolished Committee and the above-mentioned state bodies to the newly formed Agency; 3) to designate the Agency as the legal successor for the rights and duties of the abolished Committee;      4) to designate the Agency as the authorized body for consumer rights protection and sanitary and epidemiological welfare of the population, as well as to assign it functions for the implementation of intersectoral coordination of state bodies to ensure the implementation of state policy in the field of consumer rights protection and sanitary and epidemiological welfare of the population; 5) by the end of 2013 to develop proposals for improving the main directions of state policy in the field of 6) take other necessary measures to implement this Decree.    

3. Add to Decree of the President of the Republic of Kazakhstan dated January 22, 1999 No. 6 "On the Structure of the Government of the Republic of Kazakhstan" the following addition:      Paragraph 1 should be supplemented with the following line: "Agency of the Republic of Kazakhstan for Consumer Rights Protection".    

4. Control over the implementation of this Decree is entrusted to the Administration of the President of the Republic of Kazakhstan.      

5. This Decree shall enter into force from the date of signing.
