In accordance with subparagraph 10) of Article 19 of the Constitutional Law of the Republic of Kazakhstan "On the President of the Republic of Kazakhstan" and in order to implement interdepartmental coordination on the stability and effective development of the energy sector in the Republic of Kazakhstan, I HEREBY DECREE:

1. To form the Energy Council under the President of the Republic of Kazakhstan (hereinafter referred to as the Council).

2. Approve the attached documents:

1) Regulations on the Council;

2) the composition of the Council.

3. The Government of the Republic of Kazakhstan shall take the necessary measures resulting from this Decree.

4. This Decree shall enter into force from the date of signing.

Regulations on the Energy Council under the President of the Republic of Kazakhstan

Chapter 1. General provisions

The footnote. The title of Chapter 1 is as amended by Decree of the President of the Republic of Kazakhstan dated 30.09.2022 No. 1028.

1. The Energy Council under the President of the Republic of Kazakhstan (hereinafter referred to as the Council) is established for the stable and efficient development of the energy sector in the Republic of Kazakhstan.

2. The Council is an advisory body under the President of the Republic of Kazakhstan.

3. In its activities, the Council is guided by the Constitution of the Republic of Kazakhstan, the laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan and other regulatory legal acts of the Republic of Kazakhstan, as well as this Regulation on the Council.

Chapter 2. Tasks and rights of the Council

4. The main objectives of the Council are:

1) development of proposals on strategic directions for the development of the energy sector of the Republic of Kazakhstan;

2) development of proposals for cooperation with foreign partners working in the largest oil and gas fields of the Republic of Kazakhstan.

5. The Council, in accordance with the established procedure and on issues within its competence, has the right:

1) submit proposals on strategic directions for the development of the energy sector of the Republic of Kazakhstan for consideration by the President of the Republic of Kazakhstan;

2) to form working groups to resolve issues within the competence of the Council;

3) request the necessary information from government agencies, departments and organizations on issues within the competence of the Council;

4) involve specialists from interested government agencies and consultants in order to implement the tasks set out in paragraph 4 of these Regulations;

5) exercise other rights necessary to ensure the effective functioning of the Council within its competence.

Chapter 3. Formation and organization of the Council's activities

6. The composition of the Council is approved by the President of the Republic of Kazakhstan.

7. The Council is headed by the Chairman of the Council. Chairman of the Council:

1) carries out the general management of the Council's activities;

2) preside over the meetings of the Council;

3) determines the place and time of the meetings of the Council;

4) exercises general control over the implementation of the Council's decisions;

5) Excluded by Decree of the President of the Republic of Kazakhstan dated 06/29/2024 No. 591.

During the absence of the Chairman, his functions are performed by a deputy to whom the Chairman has delegated the appropriate powers.

8. Members of the Council may:

1) to make proposals on the agenda of the Council meeting and the procedure for discussing issues;

2) participate in the preparation of materials for the meetings of the Council and its draft decisions.

8-1. Secretary of the Council:

1) formulates a draft agenda for Council meetings;

2) organizes the preparation of materials for the meetings of the Council, as well as draft minutes of the meetings of the Council;

3) performs other functions on behalf of the Chairman of the Council.

9. Meetings of the Council are held as necessary within the time limits determined by the Chairman of the Council, but at least once every six months.

By decision of the Chairman of the Council, issues may be submitted and considered by absentee voting. Absentee voting is conducted on paper. For projects marked "For official use", as well as those containing state secrets, voting is carried out in compliance with the requirements for the protection of state secrets.

The term of absentee voting of the Council members should not exceed 1 (one) business day from the date of sending materials on the draft decision for voting.

If there are comments on the draft decision sent for absentee voting, the members of the Council shall inform the working body of the Council in writing before the end of the absentee voting period.

In case of failure to provide a response within the prescribed period, it is considered that the member of the Council voted for the adoption of the draft decision "by default".

A meeting of the Council is considered competent if at least half of its members are present at the meeting.

Members of the Council may not delegate their powers to other officials.

10. The working body of the Council is the Ministry of Energy of the Republic of Kazakhstan.

11. The Council's working body:

1) ensures the organization of the meetings of the Council and prepares the relevant materials for the meetings of the Council;

2) notify the members of the Council of the place, time, and agenda of the next meeting of the Council and provide them with the necessary materials in a timely manner;

3) coordinates the minutes of the Council meeting;

4) within two weeks from the date of the adoption of the Council's decisions, send a copy of the protocol and other necessary materials to the members of the Council and other interested state bodies and other organizations.;

5) monitors and analyzes the implementation and application of the recommendations of the Council.

12. Following the results of the meetings of the Council, decisions are made, formalized by the minutes, which are signed by all members of the Council who attended the meeting.

13. Decisions of the Council are taken by open or absentee voting by a majority vote of the total number of Council members present at the meeting or participating in absentee voting. The Council's decisions are advisory in nature. If the votes are equal, the chairman's vote is decisive. .

The members of the Council have the right to express their dissenting opinion in writing, which is attached to the minutes.

14. The decisions of the Council may be published in the mass media or brought to the attention of energy industry entities in any other way in accordance with the current legislation of the Republic of Kazakhstan. The list and amount of information to be published or transmitted to the subjects of the energy industry are determined by the Council.

Chapter 4. Termination of the Council's activities

15. The basis for the termination of the Council's activities is a decision

The President of the Republic of Kazakhstan.
