On ensuring the independence of the foreign economic activity of the Kazakh SSR
Decree of the President of the Kazakh Soviet Socialist Republic No. 411 dated August 31, 1991
In order to ensure the independence of the Republic in foreign economic activity:
1. To establish that on the territory of the republic the activities of subjects of foreign economic relations are determined and regulated by the laws and regulations of the Kazakh SSR.
2. The Ministry of Foreign Economic Relations of the Kazakh SSR must re-register Soviet and foreign participants in the republic's foreign economic activity before November 1, 1991.
3. To establish that since September 1, 1991, quotas and licensing of exports and imports of products (works, services), including barter operations, on the territory of the republic are the exclusive prerogative of the Kazakh SSR.
5. To determine that decisions on the opening and functioning of trade, economic and other representative offices of the Kazakh SSR abroad and foreign representative offices in the republic are taken by the Cabinet of Ministers of the Kazakh SSR.
6. Transform the Kazakh Republican Bank of Vnesheconombank of the USSR into joint-stock commercial Vnesheconombank of the Kazakh SSR (Kazvnesheconombank).
Kazvnesheconombank and the executive committees of the regional and Alma Ata City Councils of People's Deputies will establish a network of Kazvnesheconombank institutions by January 1, 1992.
7. Participants in foreign economic relations of the Kazakh SSR before October 1, 1991: - to open foreign currency accounts in Kazvnesheconombank or in other banks of the republic authorized to maintain foreign currency accounts;
- transfer to the specified accounts all foreign currency funds held in banks outside the republic, as well as abroad, except in cases authorized by the Government of the Republic.
8. To determine that a single republican foreign exchange market is functioning in the Kazakh SSR. The procedure for working in the foreign exchange market is established by the National State Bank of the Kazakh SSR.
9. To suspend from October 1, 1991, on the territory of the Kazakh SSR, the Decree of the President of the USSR dated November 2, 1990 "On the special procedure for the use of foreign exchange resources in 1991." The Cabinet of Ministers of the Kazakh SSR, together with the National State Bank of the Kazakh SSR and the Main State Tax Inspectorate of the Kazakh SSR, shall, by the specified deadline, establish standards, the procedure for the formation and disbursement of funds to the foreign exchange funds of the republic, local Councils of People's Deputies, enterprises, organizations and other participants in foreign economic activity.
10. To the Cabinet of Ministers of the Kazakh SSR before January 1, 1992:
- create the State Customs Service of the Kazakh SSR;
- coordinate with the republics and states a mechanism for distributing revenues from export-import taxes, customs duties and duties, unscheduled customs revenues, as well as a transport scheme that ensures foreign economic relations;
- take measures to eliminate double taxation in trade with neighboring foreign countries or their individual regions. This Decree comes into force from the date of publication.
