On the formation of the Committee on Legal Statistics and Special Accounts of the Prosecutor General's Office of the Republic of Kazakhstan
Decree of the President of the Republic of Kazakhstan dated March 28, 2003 No. 1050.
In accordance with subparagraph 3) paragraph 2 of Article 17-1 of the Constitutional Law of the Republic of Kazakhstan "On the President of the Republic of Kazakhstan", in order to further improve the system of legal statistics and special accounting in the Republic of Kazakhstan, I decree:
1. To establish a state institution - the Committee on Legal Statistics and Special Accounts of the General Prosecutor's Office of the Republic of Kazakhstan (hereinafter referred to as the Committee) with the transfer to it of functions and powers for the management of property and affairs of the abolished Center for Legal Statistics and Information at the General Prosecutor's Office of the Republic of Kazakhstan.
2. To approve the attached Regulations on the Committee.

3. To amend the Decree of the President of the Republic of Kazakhstan dated January 22, 1999 No. 29 "On measures for further optimization of the system of state bodies of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 1999, No. 1, art. 2; 2001, No. 4-5, art. 43; 2002, No. 26, art. 272; N 45, V. 445) the following additions and amendments:
in appendix 2 to the above-mentioned Decree:
add the following lines:

2) to ensure the financing of the Committee's activities from the republican budget;
3) take other measures resulting from this Decree.
5. Control over the implementation of this Decree is entrusted to the Administration of the President of the Republic of Kazakhstan.
6. This Decree comes into force from the date of signing.

Regulations on the Committee on Legal Statistics and Special Accounts of the Prosecutor General's Office of the Republic of Kazakhstan

Chapter 1. General provisions
1. The Committee on Legal Statistics and Special Records of the General Prosecutor's Office of the Republic of Kazakhstan (hereinafter referred to as the Committee) is an agency that performs, within the competence of the General Prosecutor's Office of the Republic of Kazakhstan, the functions and powers of the state body for the formation of state legal statistics and the maintenance of special records.
2. The Committee carries out its activities in accordance with the Constitution of the Republic of Kazakhstan, the Constitutional Law of the Republic of Kazakhstan "On the Prosecutor's Office" (hereinafter referred to as the Constitutional Law), international treaties ratified by the Republic of Kazakhstan, laws, other regulatory legal acts, as well as this Regulation.
3. The Committee is a legal entity in the organizational and legal form of a state institution, has seals and stamps with its name in Kazakh and other languages, letterheads of the established sample, in accordance with the legislation of the Republic of Kazakhstan, accounts with treasury bodies.
4. The Committee enters into civil law relations on its own behalf.
5. The Committee has the right to act as a party to civil law relations on behalf of the State, if it is authorized to do so in accordance with the legislation of the Republic of Kazakhstan.
6. The Committee on issues of its competence, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, makes decisions issued by orders of the Chairman of the Committee and other acts provided for by the legislation of the Republic of Kazakhstan.
7. The structure and the staff limit of the Committee are approved in accordance with the legislation of the Republic of Kazakhstan.
8. Location of the legal entity: 34 Maskeu Street, Saryarka district, Astana, 010000.
9. The full name of the Committee is the state institution "Committee on Legal Statistics and Special Accounts of the Prosecutor General's Office of the Republic of Kazakhstan".
10. These Regulations are the constituent document of the Committee.
11. The Committee's activities are financed from the national budget.
12. The Committee is prohibited from entering into contractual relations with business entities for the performance of duties that are the Committee's authority.
If the Committee is granted the right by legislative acts of the Republic of Kazakhstan to carry out income-generating activities, then the income received from such activities is sent to the republican budget.
Chapter 2. Tasks, rights and duties of the Committee
13. Tasks:
1) effective and sufficient information provision to government agencies, individuals and legal entities on the state of law and order in the country based on common statistical principles and standards;
2) improvement and development of the state legal information statistical system.
14. Authority:
1) rights:
receive free of charge from subjects of legal statistics and special accounting legal statistical information on issues of state legal statistics and special accounting, departmental reports, documents and forms of primary accounting, as well as other information for the production of statistical information and special accounting;
require subjects of legal statistics and special accounting to ensure the completeness and reliability of primary accounting and reporting acts, and to submit them within the time limits set by regulatory legal acts of the Prosecutor General of the Republic of Kazakhstan (hereinafter referred to as the Prosecutor General);
to monitor the integrity, objectivity, reliability and sufficiency of legal statistical information provided by subjects of legal statistics and special accounting, without interfering in their activities not related to the formation of state legal statistics and the maintenance of special accounting;
to verify compliance with the rule of law, analyze the state of legality, and evaluate acts that have entered into force in the field of state legal statistics and special accounting;
to submit acts of the Prosecutor's Office in accordance with the procedure determined by the Constitutional Law and other laws of the Republic of Kazakhstan, as well as by the Prosecutor General.;
to make suggestions and recommendations to government agencies based on the results of information and analytical activities;
provide access to legal statistical information in ways not prohibited by the legislation of the Republic of Kazakhstan;
to organize the publication of statistical collections and otherwise use legal statistical information for practical and scientific research purposes;
to refuse registration of acts on the appointment of inspections, preventive control with visits to the subject (object) of control and supervision and other forms of state control, as well as supervision provided for by the laws of the Republic of Kazakhstan, subject to registration with the Committee, in cases of violations of the legislation of the Republic of Kazakhstan during their appointment;
to exercise other rights stipulated by the laws of the Republic of Kazakhstan;
2) responsibilities:
to collect, process, accumulate, compile and update information in the field of state legal statistics and special accounting;
to provide, free of charge, legal statistical information, information from special records of subjects of legal statistics and special records within the limits, volumes and deadlines established by regulatory legal acts of the Republic of Kazakhstan;
provide legal statistical information to government agencies;
to provide information and reference services to individuals and legal entities within the limits, volumes and terms established by regulatory legal acts of the Republic of Kazakhstan, at the expense of their funds received by the republican budget in accordance with the legislation of the Republic of Kazakhstan.;
to ensure the safety of the information received, which constitutes state secrets, personal data and other legally protected secrets.;
to ensure the protection of information systems from unauthorized access, damage or destruction of data on objects of legal statistics and special accounting;
to respect the rights and legitimate interests of individuals and citizens, legal entities and the state when forming state legal statistics and maintaining special records;
coordinate and approve the programs of the conducted legal statistical observations with the central executive body responsible for the management of state statistics;
to provide, at the request of the authorized financial monitoring body, information from its own information systems in accordance with the legislation of the Republic of Kazakhstan on countering the legalization (laundering) of proceeds from crime and the financing of terrorism.;
perform other duties stipulated by the laws of the Republic of Kazakhstan.
15. Functions:
1) formation of state legal statistics;
2) maintaining special records, with the exception of operational, departmental records and records of persons cooperating on a confidential basis with bodies engaged in operational search and counterintelligence activities;
3) the introduction of information and communication technologies in the processes of investigation of criminal cases, proceedings on cases of administrative offenses, registration and (or) accounting of forms of state control, as well as supervision provided for by the laws of the Republic of Kazakhstan;
4) supervising the integrity, objectivity, reliability, and sufficiency of information from state legal statistics and special records provided by subjects of legal statistics and special records, as well as determining the methodology for collecting, registering, processing, accumulating, compiling, and storing information in this area;
5) carrying out information and analytical activities in the field of legal statistics and special accounting;
6) monitoring and reconciliation of legal statistical information;
7) analysis of appeals, messages, requests, responses and proposals from individuals and legal entities submitted to government agencies (with the exception of appeals submitted to the President of the Republic of Kazakhstan and his Administration, the Security Council of the Republic of Kazakhstan, the Parliament of the Republic of Kazakhstan and its deputies, the Constitutional Court of the Republic of Kazakhstan, the Supreme Judicial Council of the Republic of Kazakhstan, on Human Rights in the Republic of Kazakhstan, to the Office of the Government of the Republic of Kazakhstan);
8) coordination of registration and accounting of forms of state control, as well as supervision provided for by the laws of the Republic of Kazakhstan;
9) ensuring the protection of the rights of audited entities, including private business entities, from illegal inspections, preventive control with visits to the subject (object) of control and supervision and other forms of state control, as well as supervision provided for by the laws of the Republic of Kazakhstan, during their registration with the Committee;
10) registration and (or) accounting of forms of state control, as well as supervision provided for by the laws of the Republic of Kazakhstan;
11) making proposals to improve the procedure for state control and supervision in the regulatory state bodies;
12) ensuring the protection of the rights and legitimate interests of individuals and legal entities at the stages of receiving, registering, and considering their appeals, messages, requests, responses, and proposals within the scope of their competence;
13) consideration of appeals from individuals and legal entities within the scope of their competence;
14) conducting an operational assessment on the consideration of appeals;
15) provision of public services to individuals and legal entities;
16) conducting legal statistical observations;
17) performing the function of an operator of information systems for the formation of state legal statistics and maintaining special records, information exchange systems for law enforcement, special state and other bodies responsible for:
ensuring compliance with uniform requirements in the field of information and communication technologies and information security;
implementation of operation, maintenance, development, monitoring;
to ensure uninterrupted and proper functioning, as well as protection;
ensuring the security of electronic information resources storage;
ensuring prompt response to identified deficiencies and taking measures to eliminate them;
18) identification of officials responsible for the functioning, administration, and use of information systems for the formation of state legal statistics and the maintenance of special records, information exchange systems for law enforcement, special state and other bodies;
19) ensuring the functioning of geographical information maps of the state legal information statistical system;
20) receiving, issuing, storing, destroying and reviewing terminated criminal cases;
21) publication of information about persons brought to criminal responsibility for committing offenses against the sexual integrity of minors;
22) development of statistical principles and standards, methods in the field of state legal statistics and special accounting;
23) development of normative legal acts on issues of legal statistics and special accounting, mandatory for all subjects of legal statistics and special accounting;
24) development of instructions for the reception, issuance, storage, destruction by the divisions of the archival work of the Committee of terminated criminal cases and familiarization with them;
25) development of forms of acts of state control, on the results of preventive control with a visit to the subject (object) of control and supervision and (or) inspection and instructions on the elimination of identified violations provided for by the Business Code of the Republic of Kazakhstan, with the exception of the act (notifications) on the appointment, results of inspections carried out by state revenue bodies;
26) development of forms of legal statistics reports and instructions on their formation;
27) development of rules for maintaining, using and storing special records, with the exception of operational and departmental records;
28) development of a draft subordinate regulatory legal act defining the procedure for the provision of public services;
29) development of rules for receiving and registering applications, reports or reports on criminal offenses, as well as the procedure for maintaining a Unified register of pre-trial investigations;
30) development of rules for maintaining a Unified Register of Administrative proceedings;
31) development of rules for registration of acts on appointment, additional acts on extending the terms of preventive control with a visit to the subject (object) of control and supervision and (or) verification, refusal to register and cancellation, notifications of suspension, resumption, extension of the terms of preventive control with a visit to the subject (object) of control and supervision and (or) inspections, changes in the composition of participants and the submission of information accounting documents on preventive control with a visit to the subject (object) of control and supervision and (or) inspections and their results;
32) development of rules for registration, accounting of appeals received by state bodies, local governments, legal entities with one hundred percent state participation, as well as maintenance of the Electronic Appeals information analytical system;
33) development of rules for the formation, access, use, storage, protection and destruction of information from the information exchange system of law enforcement, special state and other bodies;
34) development of rules and grounds for obtaining information by law enforcement, special state bodies of the Republic of Kazakhstan and military intelligence bodies of the Ministry of Defense of the Republic of Kazakhstan necessary for conducting secret investigative actions and operational search activities, as well as for solving other tasks assigned to them, from the information exchange system of law enforcement, special state and other bodies determined by joint regulatory legal acts of the Prosecutor General, The Minister of Defense of the Republic of Kazakhstan and the first heads of law enforcement and special state bodies of the Republic of Kazakhstan;
35) development of rules and grounds for obtaining information by other bodies necessary for solving the tasks assigned to them from the information exchange system of law enforcement, special state and other bodies defined by joint regulatory legal acts of the Prosecutor General and the first heads of other bodies;
36) development of a list of Internet resources and information systems integrated with the information exchange system of law enforcement, special state and other bodies;
37) development of a list of personal data necessary and sufficient for the performance of tasks by the prosecutor's office;
38) development of instructions on information and reference services for individuals and legal entities by bodies of legal statistics and special accounting;
39) implementation of international cooperation in the field of legal statistics and special accounting;
40) interaction with subjects of legal statistics and special accounting in the framework of the implementation of the tasks of the Committee;
41) control over the work of the territorial and equivalent bodies of the Committee (hereinafter referred to as territorial bodies), providing them with practical and methodological assistance in carrying out accounting, statistical, informational, analytical, and supervisory activities;
42) other functions assigned to him by the laws of the Republic of Kazakhstan and acts of the President of the Republic of Kazakhstan.
Chapter 3. Status and powers of the Head of the Committee
16. The management of the Committee is carried out by the Chairman, who is personally responsible for the fulfillment of the tasks assigned to the Committee and the exercise of his powers.
17. The Chairman of the Committee is appointed and dismissed by the President of the Republic of Kazakhstan upon the recommendation of the Prosecutor General.
18. The Chairman of the Committee has deputies, including the first, who are appointed and dismissed by the Prosecutor General on the recommendation of the Chairman of the Committee.
19. Powers of the Chairman of the Committee:
1) organizes and directs the work of the Committee, monitors the activities of its territorial bodies;
2) determines the powers of the structural divisions of the Committee and its territorial bodies;
3) in accordance with the legislation of the Republic of Kazakhstan, appoints and dismisses prosecutors and other employees of the Committee, heads of territorial bodies and their deputies.;
4) in accordance with the procedure established by the legislation of the Republic of Kazakhstan, resolves issues of encouraging prosecutors and other employees of the Committee and its territorial bodies, providing them with financial assistance, imposing and removing disciplinary penalties;
5) represents the Committee in government agencies and other organizations;
6) informs the Prosecutor General about the activities of the Committee;
7) approves the regulations on the structural divisions of the Committee and its territorial bodies;
8) approves the staffing table within the limits of the approved structure and number;
9) exercises other powers in accordance with the legislation of the Republic of Kazakhstan.
The powers of the Chairman of the Committee during his absence are performed by the person replacing him, in accordance with the legislation of the Republic of Kazakhstan.
20. The Chairman of the Committee determines the powers of his deputies in accordance with the legislation of the Republic of Kazakhstan.
Chapter 4. Property of the Committee
21. The Committee may have separate property on the right of operational management in cases stipulated by the legislation of the Republic of Kazakhstan.
The Committee's property is formed at the expense of property transferred to it by the owner, as well as property (including monetary income) acquired as a result of its own activities, and other sources not prohibited by the legislation of the Republic of Kazakhstan.
22. The property assigned to the Committee belongs to republican ownership.
23. The Committee has no right to independently alienate or otherwise dispose of the property assigned to it, acquired at the expense of funds provided to it under the financing plan, unless otherwise established by the legislation of the Republic of Kazakhstan.
Chapter 5. Reorganization and liquidation of the Committee
24. The reorganization and liquidation of the Committee are carried out in accordance with the legislation of the Republic of Kazakhstan.
