     In order to further deepen economic integration and develop equal and mutually beneficial cooperation between the Republic of Kazakhstan and the Kyrgyz Republic

I decree:      

1. To approve the Agreement between the Republic of Kazakhstan and the Kyrgyz Republic on Economic Cooperation for 2001-2005, signed in Bishkek on July 24, 2001.      

2. This Decree comes into force from the date of signing.

Agreement *between the Republic of Kazakhstan and the Kyrgyz Republic on Economic Cooperation for 2001-2005

     The Republic of Kazakhstan and the Kyrgyz Republic, hereinafter referred to as the Parties, guided by the Treaty of Eternal Friendship between the Republic of Kazakhstan and the Kyrgyz Republic dated April 8, 1997, considering that interstate integration is one of the most important elements of economic development, based on the need to further strengthen and develop equal and mutually beneficial trade, economic and industrial relations, giving them of a long-term and sustainable nature, effective use of the economic potential of the Parties,      We have agreed on the following:

Article 1

     The Parties shall implement the Program of Economic Cooperation between the Republic of Kazakhstan and the Kyrgyz Republic for 2001-2005 (hereinafter referred to as the Program), which is an integral part of this Agreement.

Article 2

     The Parties shall carry out economic cooperation by developing mutually beneficial economic relations between the economic entities of the Parties, regardless of their forms of ownership, in accordance with international treaties to which the Parties are parties and the provisions of national legislation.      The Parties will create favorable conditions for assisting investors in the implementation of investment projects in the territory of the Parties, the creation of joint production structures, and mutual participation in privatization in accordance with the national laws of the Parties.

Article 3

     The Governments of the Parties will coordinate the implementation of the Program, monitor the progress of its implementation and, if necessary, make changes and additions to it.

Article 4

     In case of disputes and disagreements in the interpretation or application of the provisions of this Agreement, the Parties will resolve them through consultations and negotiations.

Article 5

     By mutual agreement of the Parties, amendments and additions may be made to this Agreement, which are formalized in separate protocols that are integral parts of this Agreement.

Article 6

     This Agreement does not affect the rights and obligations of the Parties arising from other international treaties to which they are parties.

Article 7

     This Agreement shall enter into force on the date of receipt of the last written notification that the Parties have completed the internal procedures necessary for its entry into force.

     This Agreement is concluded until December 31, 2005, unless either Party notifies the other Party in writing of its intention to terminate it. This Agreement shall expire six months after the date of receipt of such notification.      Upon termination of this Agreement, its provisions will remain in force with respect to projects under implementation.

     Done in Bishkek on July 24, 2001, in two original copies, each in the Kazakh, Kyrgyz and Russian languages, all texts being equally authentic.      In case of disagreement in the interpretation of the provisions of this Agreement, the Parties will refer to the text in Russian.

Economic Cooperation Program between the Republic of Kazakhstan and the Kyrgyz Republicin 2001-2005

     The development of economic ties between the Republic of Kazakhstan and the Kyrgyz Republic is conditioned by the production, scientific and technical ties that have historically developed between the leading sectors of the economy of the two states, and the objective need to preserve and further develop them on a mutually beneficial and equitable basis.      A significant share of chemical and petrochemical products, coal, metallurgical products and mineral products consumed by the economy of the Kyrgyz Republic is supplied from the Republic of Kazakhstan.      In turn, the Republic of Kazakhstan imported from the Kyrgyz Republic products from the electric power industry, the electrical industry, vegetable growing, certain types of the construction industry and the food industry.      At the same time, in recent years there has been a weakening of economic and cooperative ties, a significant drop in production volumes, and a reduction in mutual trade.      Bilateral economic relations do not fully utilize the opportunities for cooperation in the field of fuel and energy and agro-industrial complexes, mechanical engineering and light industry, transport and communications, in the development and implementation of targeted programs aimed at solving problems of mutual interest in the production of various types of products, including technically complex and knowledge-intensive, as well as in conducting fundamental research.      The existing problems in economic relations require the adoption of necessary constructive measures and decisions to develop a long-term strategy and priority areas of mutually beneficial economic cooperation, the formation and implementation of which is provided for in this Program.      The basis for this work is the Treaty of Eternal Friendship between the Republic of Kazakhstan and the Kyrgyz Republic dated April 8, 1997 and the Agreement between the Government of the Republic of Kazakhstan and the Government of the Kyrgyz Republic on Free Trade dated June 22, 1995.

I. The main goals and objectives of the Program

     The Program of Economic cooperation between the Republic of Kazakhstan and the Kyrgyz Republic for 2001-2005 (hereinafter referred to as the Program) was developed in order to implement a set of measures to develop mutually beneficial economic ties, achieve significant progress in cooperation and interaction between the leading sectors of the economy of the two states, and increase mutual trade on this basis.      To achieve these goals, it is envisaged to ensure the sustainable development of economic cooperation between the States by: - identifying the economic complementarity of the two States;      - formation of targeted intergovernmental and interdepartmental economic cooperation programs; - development of industrial and technological ties between enterprises in the field of introducing the latest scientific achievements and advanced technologies, improving the quality and competitiveness of products; - mutually beneficial and effective cooperation in economic sectors; - formation and improvement of a common information space; - harmonization and unification of the legislative framework in the field of economic relations.

II. Development of economic cooperation

     The implementation of the Program will ensure the further development of the economic integration of the Republic of Kazakhstan and the Kyrgyz Republic.      Common issues of economic cooperation between the Parties include: convergence of conceptual approaches regarding the structural restructuring of the economies of both countries; deepening cooperation between the Parties in matters of monetary policy, investment, stock market, consumer protection.      The main forms of interaction in the sectors are intersectoral cooperation, involving: the development and implementation of a set of joint measures in the field of exploration, taking into account the possibilities of creating joint ventures; the rational use of water and energy resources, taking into account the mutual interests of the Republic of Kazakhstan and the Kyrgyz Republic; the development of cooperation in the field of environmental protection and improvement, rational and resource-saving use of natural resources;      mutually beneficial development and cooperation in the fields of mechanical engineering, chemical industry, transport and communications; further development of the exchange of necessary industrial, technical, instructional, methodological and scientific information in the field of economic cooperation, environmental protection, monitoring and forecasting of seismic hazards, fundamental and applied research of mutual interest.

III. Program implementation Management

     In order to implement this Program, the Governments of the Parties will prepare and adopt it at the next meeting of the Intergovernmental Kazakh-Kyrgyz Joint Commission on Trade, Economic, Scientific and Technical Cooperation (hereinafter referred to as the Commission) during the current year an appropriate Action plan.      The implementation of this Program will be monitored by the Commission.      The Commission makes decisions regarding: - coordination of the activities of state bodies for the implementation of the Program, monitoring its implementation and making appropriate changes to the Program, if necessary; - organization of the preparation of draft intergovernmental agreements on issues related to the implementation of the Program, monitoring the implementation of joint projects and programs in promising areas of mutual economic cooperation, and other issues, related to the execution of the Program.
