Decree of the President of the Republic of Kazakhstan dated October 28, 2005 No. 1664.

I DECREE:

     1. To approve the attached Regulations on the Plenipotentiary Representative of the Republic of Kazakhstan in the Permanent Council of the Collective Security Treaty Organization.

     2. The Government of the Republic of Kazakhstan should resolve the issues of financing and logistical support for the Plenipotentiary Representative of the Republic of Kazakhstan in the Permanent Council of the Collective Security Treaty Organization and his staff.

     3. This Decree shall enter into force from the date of signing.

Regulations on the Plenipotentiary Representative of the Republic of Kazakhstan in the Permanent Council of the Collective Security Treaty Organization

     This Regulation defines the status and powers of the Plenipotentiary Representative of the Republic of Kazakhstan in the Permanent Council of the Collective Security Treaty Organization (hereinafter - the CSTO).

1. General provisions

     1. The Plenipotentiary Representative of the Republic of Kazakhstan in the Permanent Council of the CSTO (hereinafter referred to as the Plenipotentiary Representative) is appointed and dismissed by the President of the Republic of Kazakhstan on the recommendation of the Minister of Foreign Affairs of the Republic of Kazakhstan.

     2. An authorized representative is ex officio equivalent to the Ambassador Extraordinary and Plenipotentiary of the Republic of Kazakhstan.

     The provisions of the Law of the Republic of Kazakhstan dated March 7, 2002 "On the Diplomatic Service of the Republic of Kazakhstan" apply to the Authorized Representative.

     3. The Authorized Representative carries out his activities in accordance with the Constitution of the Republic of Kazakhstan, the Charter of the Collective Security Treaty Organization, ratified by the Law of the Republic of Kazakhstan dated July 1, 2003, the Agreement on the Legal Status of the Collective Security Treaty Organization, ratified by the Law of the Republic of Kazakhstan dated July 2, 2003 (hereinafter - Agreement on the Legal Status of the CSTO), the Law of the Republic of Kazakhstan dated March 7, 2002 "On the Diplomatic Service of the Republic of Kazakhstan", the Regulation on the Permanent Council of the CSTO, approved by the decision of the Collective Security Council dated April 28, 2003 (hereinafter - Regulations on the Permanent Council), Regulations on the Diplomatic and Equivalent Representation of the Republic of Kazakhstan, approved by Decree of the President of the Republic of Kazakhstan dated February 4, 2004 No. 1287, these Regulations, as well as regulatory legal acts of the Republic of Kazakhstan, international treaties of the Republic of Kazakhstan, taking into account the legislation of the host state and the rules of the Collective Security Treaty Organization, as well as generally recognized norms of international law..

2. Main tasks, functions and the right of the Authorized Representative

     4. The main tasks of the Plenipotentiary Representative are:

     implementation of the foreign policy course of the Republic of Kazakhstan in the CSTO;

     Representation of the Republic of Kazakhstan in relations with the CSTO;

     provision of diplomatic means and methods to protect the political, military and technical interests of the Republic of Kazakhstan in relations with the CSTO;

     expression of the position of the Republic of Kazakhstan on the activities of the CSTO;

     assessment and analysis of the situation, prompt exchange of information on topical issues of national, regional and international security and preparation of relevant recommendations;

     participation in the organization of the implementation of decisions of the Collective Security Council, advisory and executive bodies of the CSTO, taking into account the position of the Republic of Kazakhstan;

     participation in the preparation of draft decisions for meetings of the CSTO bodies, taking into account the position of the Republic of Kazakhstan.

     5. The authorized representative, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, performs the following functions::

     contributes to the implementation of the foreign policy strategy of the Republic of Kazakhstan;

     submits proposals to interested state bodies of the Republic of Kazakhstan on issues of relations with the CSTO;

     conducts negotiations and contributes to maintaining official contacts with the CSTO bodies;

     promotes the implementation of goals and principles, as well as the implementation of decisions within the framework of cooperation between the Republic of Kazakhstan and the CSTO;

     prepares proposals aimed at coordinating foreign policy activities, developing multilateral military-political integration, developing and improving the collective security system and its regional structures;

     Participates in the development of proposals for coordinating the efforts of the CSTO member states aimed at countering international terrorism, illicit trafficking in narcotic drugs and psychotropic substances, weapons, transnational organized crime, illegal migration and other security threats.;

     participates in the preparation of draft decisions and documents for sessions of the Collective Security Council and meetings of the Council of Ministers of Foreign Affairs of the CSTO, the Council of Ministers of Defense of the CSTO, the Committee of Secretaries of the CSTO Security Councils;

     makes proposals on holding appropriate consultations in case of developments affecting the interests and security of the Republic of Kazakhstan;

     prepares proposals for improving military-technical cooperation of the Republic of Kazakhstan within the framework of the CSTO;

     provides assistance to official delegations and representatives of the Republic of Kazakhstan, seconded in the CSTO, in carrying out the tasks assigned to them;

     participates in protocol and organizational events related to the participation of the President of the Republic of Kazakhstan, the Minister of Foreign Affairs of the Republic of Kazakhstan, the Minister of Defense of the Republic of Kazakhstan and other officials of the Republic of Kazakhstan in meetings of the CSTO bodies;

     collects information and studies the activities of the CSTO and informs interested ministries and departments of the Republic of Kazakhstan;

     distributes information on the foreign, domestic and defense policy of the Republic of Kazakhstan to the CSTO;

     Carries out general supervision and control over the implementation of decisions of the Collective Security Council and decisions of the Council of Ministers of Foreign Affairs of the CSTO, the Council of Ministers of Defense of the CSTO and the Committee of Secretaries of the CSTO Security Councils.;

     considers issues related to the organizational and financial activities of the CSTO and prepares proposals for its improvement;

     provides information to the CSTO bodies on the legislation of the Republic of Kazakhstan on defense and security issues, as well as on international treaties and other international legal acts of a military and political nature concluded by the Republic of Kazakhstan with non-CSTO member states and international organizations;

     facilitates the implementation of working contacts of the CSTO Secretary General in the Republic of Kazakhstan.

     6. The authorized representative has the right in accordance with the legislation of the Republic of Kazakhstan:

     to carry out acts related to the conclusion of international treaties within the framework of the CSTO within the limits of the powers granted.;

     to make proposals on issues of relations with the CSTO in accordance with the established procedure;

     receive, in accordance with the established procedure, the necessary materials and documents from the state bodies of the Republic of Kazakhstan on issues within its competence.;

     manage the limit of funds (expenses) provided for in the financing plan;

     independently make decisions on issues of labor relations with service personnel, approve the schedule of annual paid vacations for staff members.

     7. The authorized Representative is personally responsible for the objectivity, reliability and completeness of the information provided by him.

3. Organization of the authorized representative's activity

     8. The Plenipotentiary representative shall assume his duties upon receipt by the Secretary General of the CSTO of the official notification of the Ministry of Foreign Affairs of the Republic of Kazakhstan on his appointment.

     9. The powers of the Authorized Representative shall be terminated from the date of the official notification to the Secretary General by the Ministry of Foreign Affairs of the Republic of Kazakhstan of his withdrawal.

     10. The Plenipotentiary Representative participates in meetings of the Permanent Council of the Collective Security Treaty Organization (hereinafter referred to as the Permanent Council). If an Authorized Representative is unable to participate in a meeting of the Permanent Council, his/her powers to participate in meetings may be temporarily delegated to another representative of the Republic of Kazakhstan, which is officially notified to the Secretary General of the CSTO.

4. Office of the Authorized Representative

     11. The office of the Plenipotentiary Representative is being formed to implement the tasks and functions of the Plenipotentiary Representative.

     12. The Authorized representative and staff members enjoy privileges and immunities granted to the extent specified in section III of the Agreement on the Legal Status of the CSTO.

     13. The structure and staffing of the office of the Plenipotentiary Representative are approved by the Ministry of Foreign Affairs of the Republic of Kazakhstan within the limits of the funds (expenses) provided for in the republican budget for the maintenance of the Plenipotentiary Representative.

     14. The official duties of the staff are determined by the Authorized Representative.

     15. The staff of the Authorized Representative's office are responsible for their activities in accordance with the procedure established by the legislation of the Republic of Kazakhstan.

     16. Employment relations in the office of the Authorized Representative are regulated by the legislation of the Republic of Kazakhstan, taking into account the norms of international law and the legislation of the host State.

5. Ensuring the activity of an authorized representative

     17. In accordance with the Regulations on the Permanent Council, financial support for the Plenipotentiary Representative and his staff is provided from the republican budget.

     Remuneration of the Authorized Representative and staff of his office is carried out in accordance with the procedure and conditions provided for the staff of the Embassy of the Republic of Kazakhstan in the Russian Federation.

     The cost estimate of the Authorized Representative is approved by the Government of the Republic of Kazakhstan within the limits of the funds provided by the republican budget for the relevant year.

     18. The authorized Representative is provided with transport, office premises and other necessary property, as well as open and closed communication channels.

     19. The procedure for the possession, use and disposal by the Authorized Representative of the property assigned to him is established by the legislation of the Republic of Kazakhstan.
