Decree of the President of the Republic of Kazakhstan dated September 13, 2003 No. 1187

In accordance with Article 16 of the Decree of the President of the Republic of Kazakhstan, which has the force of law, dated December 12, 1995, No. 2679 "On the procedure for concluding, executing and denouncing international treaties of the Republic of Kazakhstan", I decree:

     1. To approve the Agreement between the Republic of Kazakhstan and Turkmenistan on cooperation in the protection of the state border, signed in Astana on July 5, 2001.

     2. This Decree comes into force from the date of signing.

     Agreement *between the Republic of Kazakhstan and Turkmenistan on cooperation in the protection of the State Border

     The Republic of Kazakhstan and Turkmenistan, hereinafter referred to as the Parties, guided by the principles and norms of international law, desire to develop friendly good-neighborly relations and promote mutual border security, reaffirming their commitment to the Charter of the United Nations, the principles of the Organization for Security and Co-operation in Europe, the provisions of the Helsinki Final Act, as well as the Declaration on Respect for Sovereignty., territorial integrity and inviolability of the borders of the CIS member States dated April 15, 1994, based on the Treaty on Friendly Relations and Cooperation between the Republic of Kazakhstan and Turkmenistan dated May 19, 1993,

     have agreed on the following:

Article 1

     The parties will organize cooperation on the protection of the Kazakh-Turkmen state border.

     The Parties grant powers to the heads of border agencies to resolve issues of interaction.

Article 2

     The protection of the Kazakh-Turkmen state border is carried out taking into account the security of the Parties, the prevention of unlawful changes in the established procedure for the passage of the Kazakh-Turkmen state border, designed to create and maintain a regime of favorable interaction in the political, economic, trade, cultural and humanitarian fields.    

Article 3

     The Parties undertake to establish and develop equal, partnership relations among themselves aimed at effectively solving the tasks of preventing the penetration of terrorist groups and other criminal elements across the Kazakh-Turkmen state border, illegal movement of weapons and ammunition, explosives, toxic, radioactive, psychotropic and narcotic substances, as well as other prohibited items and cargo.

Article 4

     In order to make timely decisions and measures to protect the Kazakh-Turkmen state border, the Parties will ensure continuous collection, processing and constant mutual exchange of information, analysis and forecasting of the situation on it, as well as the preparation of proposals for proactive measures.

Article 5

     Each of the Parties ensures the confidentiality of information transmitted by the other Party, if this information is confidential or the transmitting Party considers it undesirable to disclose its contents. The degree of confidentiality of information is determined by the transmitting Party.

     If it is necessary to transfer to a third Party the data and information received from one of the Parties under this Agreement, the mandatory consent of the Party that transferred this data and information is required.

Article 6

     In the interests of ensuring the protection of the Kazakh-Turkmen state border, the Parties cooperate in conducting operational search activities by authorized bodies of border agencies in accordance with their national legislation.

     The procedure for cooperation will be regulated by a separate protocol, which will be developed and signed 6 months after the signing of this Agreement and will be an integral part of it.

Article 7

     The procedure for opening checkpoints across the state border of the Parties and determining their status is carried out in accordance with a separate Agreement.

Article 8

     In order to fulfill mutual obligations stipulated by this Agreement, as well as resolve issues arising in the process of cooperation and interaction related to the protection of the Kazakh-Turkmen state border, the heads of the border agencies of the Parties will, if necessary, hold consultations, create joint working groups and carry out other necessary activities.

Article 9

     All disputes and disagreements arising between the Parties in the application and interpretation of the provisions of this Agreement, the Parties will resolve through consultations and negotiations.

Article 10

     This Agreement does not affect the obligations of the Parties under other international treaties and does not prevent the development and development of other mutually acceptable forms of cooperation between the Parties.

     This Agreement may be amended and supplemented with the consent of both Parties, which are formalized in separate Protocols that are integral parts of this Agreement.

Article 11

     This Agreement shall enter into force on the date of the last written notification by the Parties of the completion of the internal procedures necessary for its entry into force and shall remain in force until the expiration of six months from the date on which one of the Parties receives a written notification from the other Party of its intention to terminate it.

           Done in Astana on July 5, 2001, in two original copies, each in the Kazakh, Turkmen and Russian languages, all texts being equally authentic.      For the purposes of interpreting the provisions of this Agreement, the text in Russian will be used.
