In accordance with Article 15 of the Law of the Republic of Kazakhstan dated May 30, 2005 "On International Treaties of the Republic of Kazakhstan", I HEREBY DECREE: 1. To approve the Agreement on Personnel Training for Law enforcement, fire fighting, emergency rescue agencies and special services of the member States of the Collective Security Treaty Organization, signed in Moscow on September 5, 2008. 2. The Government of the Republic of Kazakhstan shall take measures within one month, following from Article 3 of the above-mentioned Agreement. 3. This Decree shall enter into force from the date of signing.

The member States of the Collective Security Treaty Organization, hereinafter referred to as the Parties, guided by the purposes and principles of the Collective Security Treaty Organization (hereinafter - Organization), considering the field of personnel training for law enforcement, fire-fighting, emergency rescue agencies and special services to be one of the most important factors in ensuring effective cooperation between the Parties in countering security challenges and threats, as well as the development of allied relations between them, striving to ensure that the level of personnel training for law enforcement, fire-fighting, emergency rescue agencies and special services of the Parties that meet the requirements facing the multilateral forces of the collective security system, have agreed on the following:
Article 1
The following terms used in this Agreement mean: "educational institutions" - educational institutions of higher, secondary and additional professional education, including postgraduate education, which provide training for law enforcement, fire, emergency rescue agencies and special services of the Parties.; "personnel training" is the training of specialists in higher and secondary vocational education programs, retraining and advanced training of specialists in additional professional education programs, as well as the training of scientific and scientific-pedagogical personnel in postgraduate professional education programs.; "law enforcement, fire-fighting, emergency rescue agencies and special services" - specially authorized bodies of the Member States of the Organization, whose main (special) functions are to ensure legality, state (national) security, law and order, combating crime, including drug trafficking and other offenses, as well as the implementation of intelligence, counterintelligence activities and other special functions; "sending Party" - the Party sending employees of law enforcement, fire-fighting, emergency rescue agencies and special services for training in educational institutions of other Parties; "receiving Party" - the Party receiving employees of law enforcement, fire-fighting, emergency rescue agencies and special services of other Parties for their training in their educational institutions; "transmitting "Party" is a Party that transfers educational manuals, educational literature and elements of the educational and material base to the other Party.
Article 2
The Parties aim to cooperate in training personnel for law enforcement, fire-fighting, emergency rescue agencies and special services, as well as their troops and military formations of the Organization's Member States in agreed specialties and training programs.
Article 3
The Parties shall cooperate through their law enforcement, fire-fighting, emergency rescue agencies and special services in accordance with this Agreement in compliance with the national legislation of the Parties and international treaties to which they are parties. The list of law enforcement, fire-fighting, emergency rescue agencies and special services for which personnel are being trained in accordance with this Agreement shall be transmitted by each Party to the depositary upon notification of its implementation of the internal procedures necessary for the entry into force of the Agreement. Each of the Parties shall notify the depository in writing within one month of changes in the list of law enforcement, fire-fighting, emergency rescue agencies and special services.
Article 4
Personnel training is carried out on the basis of contracts concluded by law enforcement, fire, emergency rescue agencies and special services of the Parties, taking into account the restrictions related to ensuring secrecy, security of official information of limited distribution and classified information of the host Party, as well as the Agreement on Mutual Security of classified information within the framework of the Collective Security Treaty Organization of 18 June 2004: a) separately at special faculties (courses, groups) of educational institutions; b) together with employees of law enforcement, fire fighting, emergency rescue agencies and special services of the receiving Party. The organization of joint and separate training is determined by the host Party. The training of personnel and methodological support of the educational process is carried out in Russian.
Article 5
Personnel training is carried out: - on a paid basis at the expense of the sending Party; - on a preferential or gratuitous basis according to quotas established by the receiving Party. When preparing on a preferential basis, the receiving Party bears the tuition fees, the sending Party bears the maintenance costs, including accommodation and meals. When preparing for free, the host Party assumes the costs of tuition and maintenance, including payment for accommodation and meals. Financial and other types of training support are provided on the basis of contracts.
Article 6
The sending Party submits applications for training to the receiving Party before January 15 of the year of the beginning of training. By May 15 of the year of the start of training, the receiving Party informs the sending Party about the number of employees of law enforcement, fire, emergency rescue agencies and special services accepted for training, including quotas for preferential and gratuitous training, indicating educational institutions, specialties, training programs and the number of places provided for each specialty, training program. Law enforcement, fire fighting, emergency rescue agencies and special services of the receiving Party establish recommendations (requirements) for the selection of candidates for training.
Article 7
The selection of candidates for training and their medical examination is carried out by the sending Party, based on the conditions of admission to educational institutions and the recommendations of the receiving Party. Candidates for training together with employees of law enforcement, fire, emergency rescue agencies and special services of the receiving Party are enrolled in educational institutions based on the results of entrance tests, which are taken, if necessary, with the participation of representatives of the receiving Party on the territory of the sending Party. At the same time, all expenses related to the secondment of representatives of the receiving Party are borne by the sending Party. Candidates who do not meet the requirements of the host Country for training together with employees of law enforcement, fire, emergency rescue agencies and special services of the host Country may be sent by agreement of the Parties to study at special faculties (departments, groups). The order of study at special faculties (in departments, groups) is determined by contracts. Candidates who are recognized by the results of a medical examination and testing conducted by the receiving Party as unsuitable for training in a specific specialty or training program may, by agreement of the Parties, be sent to other educational institutions, other specialties, or seconded to the sending Party. If necessary, by agreement of the Parties, preparatory courses for additional study of the Russian language and general education subjects may be organized for employees of law enforcement, fire, emergency rescue agencies and special services of the sending Party.
Article 8
Employees of law enforcement, fire, emergency rescue agencies and special services are granted the right to continue their studies and graduate from the educational institutions of the Parties to which they entered before the entry into force of this Agreement, on the terms of previously concluded contracts.
Article 9
The Parties mutually recognize the equivalence of the host Party's documents on graduation from educational institutions, as well as on the award of academic degrees and titles.
Articles 10
The Parties provide mutual assistance in the development of national educational institutions for the training of law enforcement, fire, emergency rescue agencies and special services. For these purposes, the transfer of teaching aids, educational literature and elements of the educational and material base (models, stands, simulators, etc.) is carried out on a paid basis at the internal rates of the transferring Party or at the residual value. The transfer procedure is determined in accordance with the national legislation of the transferring Party. To achieve the objectives of the training, the Parties, if necessary, carry out joint preparation and publication of scientific, educational, informational, reference and other materials.
Article 11
The referral of specialists from one Party to teach in educational institutions of the other Party is carried out on the basis of contracts.
Article 12
Issues related to the specifics of personnel training for law enforcement, fire, emergency rescue agencies and special services not provided for in this Agreement are specified in contracts.
Article 13
The obligations of the Parties under this Agreement do not affect the obligations of the Parties under other international treaties to which they are parties.
Article 14
This Agreement may be amended and supplemented by mutual agreement of the Parties, which are formalized in separate protocols and are its integral parts.
Article 15
Disputes and disagreements regarding the interpretation and application of the provisions of this Agreement are resolved through consultations and negotiations between the Parties concerned.
Article 16
This Agreement shall enter into force on the date of receipt by the depositary of the fourth written notification that the signatory Parties have completed the internal procedures necessary for its entry into force. For the parties who have completed the necessary internal procedures later, this Agreement shall enter into force on the date of delivery of the relevant written notification to the depositary.
Article 17
Each Party may withdraw from this Agreement by sending a written notification to the depositary no later than six months before the withdrawal date, having settled the financial and other obligations that have arisen during the validity of this Agreement.
Done in Moscow on September 5, 2008, in one original copy in the Russian language. The original copy of this Agreement shall be kept at the Secretariat of the Organization, which will send a certified copy to each Signatory of this Agreement.

Reservation of the Republic of Uzbekistan to the Agreement on Personnel Training for Law Enforcement, Fire, Emergency Rescue Agencies and Specialized Services of the Member States of the Collective Security Treaty Organization
The Republic of Uzbekistan will train personnel for law enforcement, fire, emergency rescue agencies and special services, as well as their troops and military formations on a bilateral basis.
