2. This Decree shall enter into force ten days after the first official publication.

The standard provision on the activities of the commandant's office of the area
1. General provisions
1. The Commandant's Office of a locality is a temporary special body established by the President of the Republic of Kazakhstan in an area where a state of emergency has been imposed to ensure a state of emergency in cooperation with central and local executive bodies.
2. The District Commandant's Office carries out its activities in accordance with the Constitution and laws of the Republic of Kazakhstan, acts of the President and Government of the Republic of Kazakhstan, other regulatory legal acts, as well as this Regulation on the activities of the district Commandant's Office (hereinafter referred to as the Regulation).
3. The commandant's office of the locality, within its competence on issues of ensuring the state of emergency, in accordance with the procedure established by law, makes decisions drawn up by orders and orders of the commandant of the locality, binding on all individuals and legal entities, officials, local government and self-government bodies, as well as the heads (commanders) of internal affairs bodies, divisions in the relevant territory. authorized body in the field of natural and man-made emergencies, military formations, located (stationed) in an area where a state of emergency has been imposed, and additionally involved in ensuring a state of emergency.
4. The Commandant's Office of a locality is formed from representatives of central, local executive bodies, law enforcement, special state bodies and the Armed Forces of the Republic of Kazakhstan stationed in the area where the state of emergency has been introduced. The personnel and structure of the office of the commandant of the area are determined by the commandant of the area based on the circumstances that served as the basis for the introduction of a state of emergency.
5. The location of the commandant's office of a locality is the territory of a locality or locality where a state of emergency has been imposed and its permanent body is located. 6. Financing of the activities of the local commandant's office is carried out at the expense of the reserve of the Government of the Republic of Kazakhstan and the reserves of local executive bodies, and when the President of the Republic of Kazakhstan introduces an emergency budget, financing is carried out at the expense of the emergency budget.
2. Main tasks, functions, rights and obligationscommandantships of the area
7. The main tasks of the commandant's office of the area are: 1) ensuring public order and security in the area where the state of emergency has been introduced, protection of particularly important state and strategic facilities, as well as facilities that ensure the livelihoods of the population and the functioning of transport; 2) monitoring the proper execution by the heads of organizations of their duties, orders and orders of the commandant; 3) control over the implementation of the imposed measures and time restrictions applied in a state of emergency.
8. To fulfill the main tasks, the district commandant's office performs the following functions: 1) develops draft orders and orders of the district commandant on ensuring the state of emergency, as well as action plans to eliminate the circumstances that served as the basis for the introduction of the state of emergency; 2) organizes the provision of public order and public safety, as well as the protection and defense of facilities, vulnerable to terrorism, in an area where a state of emergency has been imposed; 3) organizes a checkpoint, inspection and inspection of citizens and vehicles, the expulsion of violators of public order who are not residents of the area, at their expense to their place of permanent residence or outside the area where a state of emergency has been declared; 4) organizes bringing to the attention of the population decrees of the President of the Republic of Kazakhstan, orders and orders the commandant of the locality for ensuring the state of emergency; 5) organizes the accreditation of journalists at the commandant's office of the locality where the state of emergency has been introduced; 6) analyzes the sufficiency of places in special institutions for the detention of detainees who have violated the state of emergency; 7) ensures compliance with the requirements of the curfew; 8) analyzes the fulfillment by the heads of organizations of their duties, orders and orders of the commandant; 9) analyzes the need to apply additional measures and temporary restrictions stipulated by the Law of the Republic of Kazakhstan "On the State of Emergency", and ensures the implementation of these measures; 10) analyzes the need for additional financing of measures to ensure the state of emergency; 11) plans and conducts operational and preventive measures aimed at ensuring law and order in the area where the state of emergency has been introduced; 12) performs other functions in accordance with the legislation of the Republic of Kazakhstan.
9. The district Commandant's office has the right to: 1) request and receive from central and local executive bodies and organizations documents and information necessary for carrying out its activities; 2) involve organizations to eliminate the circumstances that served as the basis for the introduction of a state of emergency; 3) involve specialists from central and local executive bodies, organizations to perform analytical, expert and other works necessary to resolve the issues of eliminating the circumstances that served as the basis for the introduction of a state of emergency.; 4) make proposals to the central and local executive bodies on the consideration of issues related to the fulfillment of tasks to eliminate the circumstances that served as the basis for the introduction of a state of emergency; 5) use the funds and reserves of the territorial operational management centers of the internal affairs bodies and duty units of the law enforcement agencies involved.
10. The duties of the local commandant's office are: 1) to ensure the application of measures and time restrictions provided for in Articles 15, 16 of the Law of the Republic of Kazakhstan "On the State of Emergency"; 2) daily, with the participation of representatives of law enforcement and special government agencies stationed in the territory where the state of emergency has been introduced, to analyze the organization of their work to maintain an appropriate level public order and security, determine organizational and practical measures to prevent and prevent offenses; 3) organize briefings for patrol personnel before joining the squad, control the provision of personnel with the necessary weapons, special means and means of communication; 4) organize inspections of the order of duty by patrols, as well as posts guarding particularly important state and strategic facilities, as well as facilities that ensure the livelihoods of the population and the functioning of transport; 5) organize inspections of the security checkpoint; 6) to monitor the arrival and change of additional forces and equipment from other regions of the country; 7) to cooperate with local executive bodies operating in the territory of the state of emergency on issues related to the tasks of the local commandant's office; 8) to hear from the heads of organizations on the execution of orders and orders of the commandant to eliminate the circumstances that served as the basis to impose a state of emergency; 9) hold press conferences or briefings with representatives of the media; 10) keep records of financial expenses for measures to maintain the state of emergency.
3. Organization of the activities of the local commandant's office
11. The commandant's office of the locality is managed by the commandant of the locality, who is personally responsible for the exercise of his functions and the fulfillment by the commandant's office of the locality of the tasks assigned to it. The commandant of the area exercises powers in accordance with article 13 of the Law of the Republic of Kazakhstan "On the State of Emergency".
12. The commandant of the area is appointed and dismissed by the President of the Republic of Kazakhstan. The Commandant reports to the President of the Republic of Kazakhstan, and when the State Commission for Ensuring the State of Emergency is established, to the President of the Republic of Kazakhstan and the Chairman of the State Commission.
13. From the moment of its establishment, the local commandant's office carries out its activities in a continuous mode of operation, the specific schedule of which is established by its commandant. The labor relations of the employees of the local commandant's office are regulated in accordance with the legislation of the Republic of Kazakhstan.
14. The staff of the local commandant's office includes: 1) deputy commandants: for the management of forces and means ensuring the state of emergency, for ensuring the curfew regime, for logistical and technical support; 2) assistants to the commandant for work with the local population and the media; 3) units: headquarters, secretariat, groups legal support, information warfare, electronic intelligence and suppression.
15. The composition and structure of the office of the local commandant's office may be changed or supplemented by additional groups based on the circumstances that served as the basis for the introduction of a state of emergency.
