On approval of the Model Regulation on Anti-Terrorist Commissions

     In accordance with subparagraph 4) paragraph 2 of Article 4 of the Law of the Republic of Kazakhstan "On Combating Terrorism"

I DECREE:

     The footnote. The preamble is in the wording of the Decree of the President of the Republic of Kazakhstan dated 02/28/2024 No. 491.

     1. To approve the attached Model Regulation on Anti-Terrorist Commissions.

     2. Within three months, local executive bodies shall approve the regulations on the anti-terrorist commissions of the region, the city of republican significance, the capital, the district (city of regional significance) in accordance with the attached Model Regulations on Anti-Terrorist Commissions.

     3. This Decree shall enter into force from the date of signing.

Model provision on anti-terrorist commissions

Chapter 1. General provisions

     The footnote. The title of Chapter 1 is as amended by Decree of the President of the Republic of Kazakhstan dated 02/28/2024 No. 491.

     1. Anti-Terrorist Commission under the Akimat _____________________________

     ______________________________________________________________________The Anti-Terrorist Commission (hereinafter referred to as the Anti-Terrorist Commission) is an advisory body responsible for coordinating the activities of territorial divisions of central government bodies and local governments to prevent extremism and terrorism, minimize and (or) eliminate the consequences of terrorism.

     2. The Anti-Terrorist Commission implements the decisions of the Anti-Terrorist Center of the Republic of Kazakhstan within the limits of

     3. The legal basis for the activities of the anti-terrorist commission is the Constitution of the Republic of Kazakhstan, constitutional laws, laws, acts of the President of the Republic of Kazakhstan and other regulatory legal acts, as well as this Regulation.

Chapter 2. The main tasks, functions and powers of the Anti-terrorism Commission

     4. The main tasks of the Anti-terrorism Commission are:

     1) participation in the implementation on the territory ______________________________________( regions, cities of republican significance,____________________________________________________________________capital, district (city of regional significance) of the state policy in the field of countering extremism and terrorism, as well as preparation of proposals to the Anti-Terrorist Center of the Republic of Kazakhstan on improving the legislation of the Republic of Kazakhstan in this area;

     2) coordination of the activities of territorial divisions of central state bodies and local self-government bodies, executive bodies funded from the local budget, to prevent extremism and terrorism, minimize and (or) eliminate the consequences of terrorism;

     3) developing measures to prevent extremism and terrorism, eliminate the causes and conditions conducive to the manifestation of extremism and terrorism, ensure the protection of facilities vulnerable to terrorism, minimize and (or) eliminate the consequences of terrorism, and monitor the implementation of these measures;

     4) solving other tasks stipulated by the legislation of the Republic of Kazakhstan in the field of countering extremism and terrorism.

     5. In accordance with the main tasks, the anti-terrorist commission is entrusted with the following functions::

     1) ensuring the planning, organization and implementation of measures to prevent extremism and terrorism, minimize and (or) eliminate the consequences of terrorism, taking into account the current situation in_______________________________________________________________________________;(region, city of republican significance, capital, district (city of regional significance)

     2) monitoring, assessment and forecasting of political, socio-economic, religious processes in the______________________________________________________________________________ ,( region, city of republican significance, capital, district (city of regional significance)influencing the situation in the field of countering extremism and terrorism, the emergence and development of conditions and factors contributing to their manifestations;

     3) coordination of interaction between territorial divisions of central state bodies, local self-government bodies, and executive bodies funded from the local budget in the field of preventing extremism and terrorism, minimizing and (or) eliminating the consequences of terrorism;

     4) identification and elimination of causes and conditions that negatively affect the coordination of activities of territorial divisions of central government bodies, local governments, executive bodies funded from the local budget in the field of prevention of extremism and terrorism, minimizing and (or) eliminating the consequences of terrorism;

     5) resolving issues of financial, logistical, personnel, information and other support for government agencies in the field of preventing extremism and terrorism, minimizing and (or) eliminating the consequences of terrorism;

     6) hearing the report of the office of the anti-terrorist commission on the implementation of decisions of the anti-terrorist commission;

     7) coordination of the activities of lower-level commissions, provision of practical and methodological assistance in the prevention of extremism and terrorism, minimization and (or) elimination of the consequences of terrorism (this subparagraph is applied in the regulations on anti-terrorist commissions of the region, the city of republican significance, the capital);

     8) study of the state, analysis of problems, development of measures to improve the anti-terrorist security of facilities vulnerable to terrorism;

     9) organization of mutual exchange of information on countering extremism and terrorism between territorial divisions of central state bodies, local self-government bodies, executive bodies funded from the local budget and members of the anti-terrorist commission;

     10) cooperation in the development and coordinated implementation of training and advanced training measures in the field of extremism and terrorism prevention;

     11) preparation of proposals for the development, approval, amendments and additions to the lists of facilities vulnerable to terrorism, in particular _______________________________________________________________________________;(region, city of republican significance, capital, district (city of regional significance)

     12) performing other functions stipulated by the legislation of the Republic of Kazakhstan in the field of countering extremism and terrorism.

     6. In order to carry out its tasks, the anti-terrorist commission has the right:

     1) to make recommendations, within the limits of their competence, concerning the organization, coordination and improvement of the activities of territorial divisions of central state bodies, local self-government bodies, executive bodies funded from the local budget, for the prevention of extremism and terrorism, minimizing and (or) eliminating the consequences of terrorism;

     2) develop draft plans and programs for the prevention of extremism and terrorism;

     3) request and receive, in accordance with the established procedure, the necessary materials and information from officials of state bodies and organizations on the prevention of extremism and terrorism, minimizing and (or) eliminating the consequences of terrorism;

     4) to involve officials of territorial divisions of central state bodies, local self-government bodies, executive bodies funded from the local budget, as well as representatives of organizations to participate in the work of the anti-terrorist commission (as agreed);

     5) to hear, in accordance with the established procedure, officials of territorial divisions of central state bodies and local self-government bodies on the prevention of extremism and terrorism, minimization and (or) elimination of the consequences of terrorism.

Chapter 3. Composition of the Anti-Terrorism Commission

     7. The chairman of the anti-terrorist commission is ex officio akim _____________________________________________________.

     8. Chairman of the Anti-Terrorism Commission:

     1) preside over its meetings;

     2) coordinate, no later than December 20 of this year, with the Headquarters of the Antiterrorist Center of the National Security Committee of the Republic of Kazakhstan (hereinafter referred to as the Headquarters of the Antiterrorist Center), the plan of the antiterrorist commission for the coming year;

     3) approves, no later than January 15 of the current year, the plan of the Anti-Terrorist Commission for the current year, agreed with the Headquarters of the Anti-Terrorist Center;

4) informs the Headquarters of the Anti-Terrorist Center by the 25th of the last month of the quarter about the work of the anti-terrorist commission during the reporting period (provides copies of minutes of meetings, reference, information and analytical documents and other materials).

     9. The head of the territorial body of the National Security Committee of the Republic of Kazakhstan is the Deputy Chairman of the anti-terrorist Commission.

     10. The personnel of the anti-terrorist commission, depending on their location in the territory _________________________

Chapter 4. Organization of the work of the Anti-terrorist Commission

     12. The Anti-Terrorist Commission carries out its activities under the coordination of the Anti-Terrorist Center of the Republic of Kazakhstan, in cooperation with territorial divisions of central state bodies, local governments, executive bodies funded from the local budget, organizations regardless of their form of ownership and public associations.

     13. The Anti-Terrorist Commission conducts its work in cooperation with the operational headquarters. _________________________________

     14. The Anti-Terrorist Commission carries out its activities on a planned basis.

     15. Excluded by Decree of the President of the Republic of Kazakhstan dated 02/28/2024 No. 491.

     16. The meeting of the anti-terrorist commission is held by the Chairman of the anti-terrorist commission at least once a quarter. If necessary, by the decision of the Chairman of the anti-terrorist commission, its extraordinary meetings may be held.

     17. The members of the anti-terrorist commission have equal rights when discussing the issues under consideration at the meeting.

     If it is impossible for a member of the anti-terrorist commission to attend a meeting, the chairman of the anti-terrorist commission is notified in advance in writing and a representative of the relevant territorial subdivision of the central state body, local government body, executive body funded from the local budget is proposed to replace him. The said representative, after agreement with the chairman of the anti-terrorist commission, may attend its meeting with the right of an advisory vote.

     A meeting of the anti-terrorist commission is considered competent if more than half of its members are present.

     18. Decisions are made by a simple majority of votes. If the votes of the members of the anti-terrorist commission are equal, the vote of the chairman of the commission is decisive.

     19. The decision of the anti-terrorist commission is formalized by a protocol, which is signed by the chairman of the anti-terrorist commission.

     20. The heads of territorial divisions of central state bodies, local self-government bodies, and executive bodies funded from the local budget that are part of the antiterrorist commission may, in accordance with the legislation of the Republic of Kazakhstan, adopt acts (joint acts) to implement decisions of the antiterrorist commission.

     21. Organizational and logistical support for the activities of the anti-terrorist commission is provided by the akim. ________________________________________________________________________________ .(region, city of republican significance, capital, district (city of regional significance)

     For these purposes, the akim, within the limits of his competence,:

     determines the structural unit of the akimat (the apparatus of the anti-terrorist commission) consisting of at least two people;

     appoints as the head of the staff of the anti-terrorist commission an authorized official with sufficient authority in the field of interaction with law enforcement and special government agencies on security issues, including countering extremism and terrorism, responsible for organizing this work.

     Officials of the territorial divisions of the central state bodies that are part of the anti-terrorist commission may be involved in the work in the office of the anti-terrorist commission by agreement.

     22. The Office of the Anti-Terrorist Commission:

     1) develops a draft work plan of the anti-terrorist commission for the relevant year;

     2) ensures the preparation and holding of meetings of the anti-terrorist commission;

     3) ensures the activities of the anti-terrorist commission for monitoring the implementation of protocol decisions of meetings of the Anti-Terrorist Center of the Republic of Kazakhstan and the Anti-terrorist Commission;

     4) analyzes information about socio-political, socio-economic and religious processes in the ________________________________________________________,( region, city of republican significance, capital, district (city of regional significance)

     has an impact on the development of the situation in the field of prevention of extremism and terrorism, develops proposals of the anti-terrorist commission to eliminate the causes and conditions conducive to their manifestations.;

     5) ensures the interaction of the Anti-terrorist commission with the Headquarters of the Anti-Terrorist Center;

     6) organizes and coordinates the activities of lower-level anti-terrorist commissions;

     7) organizes the activities of a permanent working group at the office of the anti-terrorist commission.

     The main task of the working group is to prepare for the meetings of the anti-terrorism commission, study and develop coordinated measures to eliminate problems in the field of extremism and terrorism prevention.

     The head of the working group is an official with the necessary authority to coordinate the activities of the working group of the anti-terrorist commission.
