On amendments and additions to the Constitutional Law of the Republic of Kazakhstan "On State Symbols of the Republic of Kazakhstan"
Constitutional Law of the Republic of Kazakhstan dated October 28, 2015 No. 370-V SAM
Article 1. To make the following amendments and additions to the Constitutional Law of the Republic of Kazakhstan dated June 4, 2007 "On State Symbols of the Republic of Kazakhstan" (Bulletin of the Parliament of the Republic of Kazakhstan, 2007, No. 11, Article 72; 2008, No. 13-14, Article 53; 2012, No. 12, Article 82):
1) in paragraph 1 of article 4:
in part one:
add subparagraph 5-1) to read as follows:
"5-1) in the premises (parts of the premises) designated for the exposition dedicated to state symbols of state-owned legal entities, national management holdings, national holdings, national companies, as well as other joint-stock companies and limited liability partnerships in respect of which the Republic of Kazakhstan is the sole shareholder (participant);";
subparagraph 10) should be worded as follows:
"10) during the celebration of the Day of the State Symbols of the Republic of Kazakhstan, official and solemn ceremonies, and sporting events in accordance with the procedure determined by the Government of the Republic of Kazakhstan;";
The second part should be worded as follows:
"The procedure for the use (establishment, placement) of the National Flag and its image in formations, military units, subdivisions, institutions of the Armed Forces and other troops and military formations is determined by general military regulations.";
add the following part of the fifth:
"The procedure for the use (establishment, placement) of the National Flag and its image is determined by the Government of the Republic of Kazakhstan.";
2) add paragraph 3 to Article 5 as follows:
"3. Flags of foreign states used by foreign organizations and representative offices operating in the territory of the Republic of Kazakhstan, with the exception of diplomatic missions, consular offices, international organizations and (or) their representative offices accredited in the Republic of Kazakhstan, shall be placed simultaneously with the National Flag of the Republic of Kazakhstan.";
3) in article 6:
in paragraph 1:
in part one:
in subparagraph 1), replace the words "military formations, units" with the words "formations, military units";
add subparagraph 4) as follows:
"4) in the premises (parts of the premises) designated for the exposition dedicated to state symbols of state-owned legal entities, national management holdings, national holdings, national companies, as well as other joint-stock companies and limited liability partnerships in respect of which the Republic of Kazakhstan is the sole shareholder (participant).";
The second part should be worded as follows:
"The procedure for the use (establishment, placement) of the State Coat of Arms and its images in formations, military units, subdivisions, institutions of the Armed Forces and other troops and military formations is determined by general military regulations.";
In subparagraph 1) of paragraph 2, the words "military formations, units" should be replaced by the words "formations, military units";
Paragraph 4 should be supplemented with the following part four:
"The procedure for the use (establishment, placement) of the State Coat of Arms and its image is determined by the Government of the Republic of Kazakhstan.";
4) in article 8:
Subparagraph 6) of paragraph 1 should be worded as follows:
"6) when raising the National Flag of the Republic of Kazakhstan during official and solemn ceremonies, sports events held by state bodies, as well as public associations and other organizations of the Republic of Kazakhstan;";
add paragraph 1-1 as follows:
«1-1. The text of the National Anthem must be placed in the premises (parts of the premises) designated for the exposition dedicated to state symbols, state-owned legal entities, national management holdings, national holdings, national companies, as well as other joint-stock companies and limited liability partnerships in respect of which the Republic of Kazakhstan is the sole shareholder (participant).
The order of use (establishment, placement) of the text of the National Anthem is determined by the Government of the Republic of Kazakhstan.";
Paragraph 2 should be worded as follows:
"2. The procedure for the performance of the National Anthem and the use of its text in formations, military units, subunits, institutions of the Armed Forces and other troops and military formations is determined by general military regulations.";
5) in article 10:
subparagraph 3) should be worded as follows:
"3) approval of the rules for the use (establishment, placement) of the State Flag, the State Emblem of the Republic of Kazakhstan and their images, as well as the text of the National Anthem of the Republic of Kazakhstan;";
add subparagraph 3-1) to read as follows:
"3-1) approval of the rules for celebrating the Day of the State Symbols of the Republic of Kazakhstan;";
6) subparagraph 2) of paragraph 2 of Article 11 shall be worded as follows:
"2) creates an expert council on issues of state symbols and heraldic signs, and also develops and approves regulations on it;".
Article 2. This Constitutional Law shall enter into force ten calendar days after the date of its first official publication.
