On approval of requirements for an individual entrepreneur or a legal entity with whom a contract is concluded for the operation of a construction facility

Order of the Acting Minister of Industry and Construction of the Republic of Kazakhstan dated May 22, 2026 No. 255. Registered with the Ministry of Justice of the Republic of Kazakhstan on May 26, 2026 No. 38782

In accordance with paragraph 1 of Article 137 of the Building Code of the Republic of Kazakhstan, I ORDER:

     1. Approve the attached Requirements for an individual entrepreneur or a legal entity with whom a contract is concluded for the operation of a construction facility.

     2. The Committee on Construction and Housing and Communal Services of the Ministry of Industry and Construction of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:

     1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

     2) posting of this order on the official Internet resource of the Ministry of Industry and Construction of the Republic of Kazakhstan after its official publication.

     3. Control over the execution of this order is entrusted to the supervising Vice Minister of Industry and Construction of the Republic of Kazakhstan.

     4. This order will enter into force on July 1, 2026 and is subject to official publication.

Requirements for an individual entrepreneur or a legal entity with whom a contract is concluded for the operation of a construction facility

     1. A contract for the operation of a construction facility is concluded with an individual entrepreneur or a legal entity that meets the following requirements:

     1) is registered in accordance with the procedure established by the legislation of the Republic of Kazakhstan as an individual entrepreneur or a legal entity by the type of activity "Real estate management for remuneration or on a contractual basis" (OKED 68.32);

     2) have on staff or on the basis of a civil contract at least one specialist who meets the requirements of professional standards, including recognized professional qualifications in accordance with the Law of the Republic of Kazakhstan "On Professional Qualifications";

     3) have the material and technical base necessary for the operation of the construction site, including:

     premises (office) for the safe operation of the construction site and the reception of owners and other interested parties;

     equipment and tools for the operation of a construction site or contracts for the performance of such work.
