On approval of the agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Turkey on the mutual provision of land plots for the construction of buildings of diplomatic missions

     To approve the agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Turkey on the mutual transfer of land plots for the construction of buildings of diplomatic missions, concluded in Ankara on December 5, 2001.

  Agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Turkey on the mutual provision of land plots for the construction of buildings of diplomatic missions

(Entered into force on July 4, 2002 - Bulletin of international treaties of the Republic of Kazakhstan, 2002, No. 9, Article 61)

     The Government of the Republic of Kazakhstan and the Government of the Republic of Turkey (hereinafter referred to as the parties), in order to strengthen traditionally friendly relations between the two countries, to ensure the creation of appropriate conditions for the presence and functioning of diplomatic missions and consular offices of the Republic of Kazakhstan and the Republic of Turkey in the Republic of Kazakhstan, taking into account the Vienna Convention on Diplomatic Relations of April 18, 1961, agreed on:

  Article 1

     The Turkish side will provide the Kazakh side with a plot of 4294 square meters, 25016/3, 4066 square meters, 25016/4 and 2810 square meters, 25012/6, located in the diplomatic town of Oran in Ankara, Turkey for gratuitous use for a period of 49 years, and then with an extension for this same period.       The above-mentioned land plots in Ankara will be transferred to the Kazakh side without the burden of immovable property inseparable from the land.        The Kazakh side may build facilities on these sites necessary for the functioning of the Embassy of the Republic of Kazakhstan.        Before the completion of the construction of the embassy building of the Republic of Kazakhstan in Ankara, the Turkish side will transfer the building with a total area of 260 square meters to the Republic of Turkey, Ankara, Marty Chykmazy, 14, Bilkent 1, Bilkent-Ankara for free use.       The Turkish side pays for the rental of the embassy building of the Republic of Kazakhstan in the Republic of Turkey with a total area of 652 square meters, located at the address: Ebuzia Tevfik Sokak 6, Çankaya-Ankara, Ankara, Turkey, until the construction of the embassy building of the Republic of Kazakhstan in Ankara.       If the Embassy of the Republic of Kazakhstan in the Republic of Turkey intends to replace the building in which it is currently located, the amount of rent paid by the Turkish side should not exceed 60,000 US dollars per year. At the same time, the selection of a new building will be carried out by the Kazakh side in cooperation with the Turkish side.       The Turkish side provides assistance in providing a building for the Consular Office of the Republic of Kazakhstan in Istanbul.

  Article 2

     The Kazakh side will provide the Turkish side with land plots with a total area of 13,600 square meters and a total area of 17,600 square meters in the Zhastar microdistrict, located in Karaotkel, Astana, for gratuitous use for a period of 49 years, and then with an extension for the same period.       The above-mentioned land plots in Astana will be transferred to the Turkish side without the burden of immovable property inseparable from the land.       The Turkish side can build structures necessary for the functioning of the Embassy of the Republic of Turkey on the above sites.       The Kazakh side provides the Turkish side with a building with a total area of 465 square meters and adjacent land plots with an area of 1700 and 2200 square meters for gratuitous use for a period of 49 years, and then, with an extension for this same period, for the needs of the diplomatic mission and/or consular office of the Republic of Turkey, located at the address: 29 Tole bi street, Almaty, the Republic of Kazakhstan.

  Article 3

     Buildings, structures and land plots specified in Articles 1 and 2 of this Agreement are provided in a state free from debt, without burdens and rights of third parties.

  Article 4

     The parties may not transfer the plots specified in this agreement to other individuals or legal entities without the written permission of the Ministry of foreign affairs of the country of stay.

  Article 5

     The parties undertake to comply with the current legislation in the field of urban planning and architecture in the countries of their stay.

  Article 6

     Land plots and buildings specified in Articles 1 and 2 of this agreement are exempt from all taxes, fees and duties levied in the country of stay.

  Article 7

     All expenses for repairs, electricity, gas, water and Heat Supply, and communication services are paid by the diplomatic missions of the parties.

  Article 8

     All disputes that may arise in connection with the interpretation and application of this agreement will be resolved by the parties through mutual consultations and negotiations.

  Article 9

     By mutual agreement of the parties, amendments and additions may be made to this Agreement, which is formalized by separate protocols that are integral parts of this Agreement.

  Article 10

     This Agreement shall enter into force on the date of receipt of the last written notification that the Parties have completed the internal procedures necessary for its entry into force.       Done in Ankara on December 5, 2001, in two originals, each in the Kazakh, Turkish, Russian and English languages, all texts being equally authentic.       In case of disagreement in the interpretation of the provisions of this Agreement, the Parties will adhere to the English text.
