To approve the agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on social guarantees for citizens of the Republic of Kazakhstan and the Russian Federation residing and/or working in the Baikonur complex, signed in Almaty on October 12, 1998.

The Government of the Republic of Kazakhstan and the Government of the Russian Federation, hereinafter referred to as the parties, the agreement between the Republic of Kazakhstan and the Russian Federation on the basic principles and conditions for the operation of the Baikonur cosmodrome of March 28, 1994, the agreement between the Republic of Kazakhstan and the Russian Federation on the lease of the Baikonur complex of December 10, 1994, the status of the city of Baikonur between the Republic of Kazakhstan and the Russian Federation, guided by the agreement of December 25, 1995 on the formation and status of its executive bodies, taking into account international treaties on social problems, to which the Republic of Kazakhstan and the Russian Federation are participants, agreed on the following:

Article 1

This Agreement establishes the main directions and conditions of interaction of the parties on ensuring social guarantees for citizens of the Republic of Kazakhstan and the Russian Federation living and/or working in the Baikonur complex.

Article 2

For the purpose of this Agreement, the term "authorized body of the party" means: for the Kazakh side - the Ministry of Labor and social protection of the population of the Republic of Kazakhstan; for the Russian side - the Ministry of Labor and social development of the Russian Federation.

Article 3

Social guarantees of citizens of the Republic of Kazakhstan living and/or working in the Baikonur complex are provided in accordance with the laws of the Republic of Kazakhstan, unless otherwise provided by this Agreement. Social guarantees of citizens of the Russian Federation living and/or working in the Baikonur complex are provided in accordance with the laws of the Russian Federation, unless otherwise provided by this Agreement.

Article 4

Social guarantees of citizens of the Republic of Kazakhstan living and/or working in the Baikonur complex, affected by an environmental disaster in the Aral Sea region, are provided by the Kazakh side in accordance with the laws of the Republic of Kazakhstan.

Article 5

Medical and social expertise of citizens of the Republic of Kazakhstan and the Russian Federation living and/or working in the Baikonur complex is assigned to the institution of medical and social expertise under the administration of the city of Baikonur. For citizens of the Republic of Kazakhstan and the Russian Federation working in the Baikonur complex, medical and social expertise is carried out in accordance with the laws of the Russian Federation. For citizens of the Republic of Kazakhstan living in the Baikonur complex, but not working, medical and social expertise is carried out in accordance with the laws of the Republic of Kazakhstan. For citizens of the Russian Federation who live in the Baikonur complex, but do not work, medical and social expertise is carried out in accordance with the laws of the Russian Federation. The exercise of the right of citizens of the Republic of Kazakhstan and the Russian Federation working in the Baikonur complex to appeal against the decision of the institutions of medical and social expertise is carried out by the Russian side in accordance with the laws of the Russian Federation. The exercise of the right of citizens of the Republic of Kazakhstan living in the Baikonur complex, but not working, to appeal against the decision of medical and social expert institutions is carried out by the Kazakh side in accordance with the laws of the Republic of Kazakhstan.

Article 6

In order to organize work to promote employment of citizens of the Republic of Kazakhstan and the Russian Federation living in the Baikonur complex, the territorial body for employment of the Ministry of Labor and social development of the Russian Federation will be created in the city of Baikonur. The interaction of the above-mentioned territorial body of the Ministry of Labor of Russia with the relevant territorial body of the Republic of Kazakhstan on employment of citizens of the Republic of Kazakhstan and the Russian Federation recognized as unemployed in accordance with the established procedure is determined by a separate agreement between the authorized bodies of the parties.

Article 7

State social insurance of citizens of the Republic of Kazakhstan and the Russian Federation working in organizations located in the Baikonur complex and registered with the bodies of the Social Insurance Fund of the Russian Federation, and in appropriate cases their family members, is carried out at the expense of the Social Insurance Fund of the Russian Federation in accordance with the law of the Russian Federation, unless otherwise provided by international treaties.

Article 8

Medical support for citizens of the Republic of Kazakhstan and the Russian Federation living and/or working in the Baikonur complex signed on April 20, 1995, the Ministry of health of the Republic of Kazakhstan, the administration of Leninsk and the Ministry of Health and medical industry of the Russian Federation, the Ministry of Defense of the Russian Federation (military-space forces), In the case of the lease of the Baikonur complex by the Russian Federation between the Space Agency of Russia, it is carried out in accordance with the agreement "on the procedure for providing medical services to employees of the Baikonur complex and other residents of Leninsk."

Article 9

Financial security of social guarantees of citizens of the Republic of Kazakhstan and the Russian Federation living and/or working in the Baikonur complex is established by a separate agreement of the parties.

Article 10

The authorized bodies of the parties, in the course of implementing the provisions of this Agreement, Act directly with each other, as well as, if necessary, in cooperation with the administration of the city of Baikonur. In appropriate cases, the authorized bodies of the parties, within their competence, ensure the implementation of the provisions of this Agreement. Disputes regarding the interpretation and application of this Agreement are resolved through consultations and negotiations of the parties.

Article 11

This Agreement shall enter into force from the date of the last written notification of the implementation by the parties of the internal procedures necessary for its entry into force.

Article 12

This agreement is concluded for the period of validity of the lease agreement of the Baikonur complex, but it remains valid until the expiration of six months from the date of receipt by one of the parties through diplomatic channels of a written notification of the other party of its intention to terminate this Agreement.

Article 13

By mutual agreement, the parties may make changes and additions to this Agreement. In Almaty, on October 12, 1998, two copies were created, each in Kazakh and Russian languages, and both texts have the same power.
