In order to further strengthen cooperation between the Republic of Kazakhstan and the People's Republic of China in the fight against terrorism, separatism and extremism
I decree:
1. To approve the Agreement between the Republic of Kazakhstan and the People's Republic of China on Cooperation in Combating Terrorism, Separatism and Extremism, signed in Beijing on December 23, 2002.
2. This Decree comes into force from the date of signing.

The Republic of Kazakhstan and the People's Republic of China, hereinafter referred to as the "Contracting Parties", in order to further strengthen cooperation between the Contracting Parties in combating terrorism, separatism and extremism within the framework of the Shanghai Convention on Combating Terrorism, Separatism and Extremism of June 15, 2001 (hereinafter referred to as the "Shanghai Convention"), based on mutual respect for sovereignty, equality and mutual benefit, have agreed on the following:
Article 1
1. In order to implement the objectives of this Agreement, the Contracting Parties will adhere to the principles and provisions of the Shanghai Convention on Combating Terrorism, Separatism and Extremism. 2. The issues not settled by this Agreement are regulated in accordance with the provisions of the Shanghai Convention on Combating Terrorism, Separatism and Extremism.
Article 2
1. The central competent authorities designated by the Contracting Parties in accordance with Article 4 of the Shanghai Convention are the central competent authorities for the implementation of this Agreement. 2. The central competent authorities of the Contracting Parties shall carry out direct mutual contacts and cooperation in the implementation of the relevant provisions provided for in this Agreement. 3. The central competent authorities of the Contracting Parties shall notify each other of specific forms of communication, including the names of the authorities responsible for permanent communications, as well as their current telephone numbers, fax numbers, and e-mail addresses. In the event of a change in the above-mentioned forms of communication, one of the Contracting Parties shall promptly inform the other Contracting Party about this.
Article 3
1. The central competent authorities of the Contracting Parties will determine the procedure for regular meetings and consultations between the relevant departments and experts in order to inform each other, exchange views and coordinate positions on combating the acts referred to in paragraph 1 of Article 1 of the Shanghai Convention. 2. The Central Competent Authorities of the Contracting Parties may hold special meetings and consultations in order to implement the Shanghai Convention and this Agreement, at the request of the Central Competent Authorities of one of the Contracting Parties.
Article 4
The information specified in Article 7 of the Shanghai Convention means the following: 1) Information about terrorist, separatist and extremist organizations and their members, including the names, structures and main activities of organizations, as well as surnames, citizenship, residence or location, characteristic features of appearance, photographs, fingerprint data of their members and other information, useful for identifying and identifying these individuals; 2) Information on the plans of terrorist, separatist and extremist organizations aimed at carrying out the acts specified in paragraph 1 of Article 1 of the Shanghai Convention on the territory of any of the Contracting Parties, on their participation in training, as well as information on their training bases and the data of these databases; 3) Information on the implementation of terrorist, separatist and extremist organizations of the acts referred to in paragraph 1 of Article 1 of the Shanghai Convention on the territory of third countries and directed against any of the Contracting Parties; 4) Information on the illegal manufacture, acquisition, storage, transfer, transfer, sale, use or threat of use by terrorist, separatist and extremist organizations and their members of poisonous, poisonous, radioactive, infectious materials, explosives, explosive devices, firearms and ammunition, nuclear, chemical, biological and other types of weapons of mass destruction destruction, materials and equipment that can be used in their creation; 5) Information on the implementation or threat of terrorist activities by terrorist, separatist and extremist organizations and their members directed against heads of State and other government officials, diplomatic missions, consular offices, employees of international organizations, important delegations and important facilities of any of the Contracting Parties; 6) Information on the illegal production, distribution and propaganda by terrorist, separatist and extremist organizations of propaganda materials (printed, audio, video materials) about the ideologies of terrorism, separatism and extremism; 7) Information on sources and channels of financing of terrorist, separatist and extremist organizations; 8) Information on the characteristics, patterns, methods and methods of activity of terrorist, separatist and extremist organizations; 9) Information, information and materials on the experience of detecting, preventing and suppressing terrorist, separatist and extremist activities; 10) Information on the name, category and number of the identity card, residence or location, photographs and other personal information of any persons having the nationality of one of the Contracting Parties and located in the territory of the other Contracting Party suspected of carrying out the acts specified in paragraph 1 of Article 1 of the Shanghai Convention; 11) Information or information about organizations or persons providing financing, equipment, weapons and training for terrorist, separatist and extremist activities. The procedure and conditions for providing information and sending requests for such information specified in this article are regulated in accordance with the procedure established by the Shanghai Convention on Combating Terrorism, Separatism and Extremism.
Article 5
1. In order to implement the Shanghai Convention and this Agreement, the Contracting Parties should strengthen cooperation in the field of police research, exchange of equipment, development and improvement of police equipment, joint production of technical means and equipment, including providing each other with technical and material assistance if necessary. 2. Materials, special equipment, equipment and machinery received by one of the Contracting Parties from the other Contracting Party under this Agreement are not subject to transfer to a third party without the prior written consent of the Contracting Party to the provision. 3. Information on investigative and operational methods, special forces and technical means, and characteristics of logistics materials used in the framework of mutual assistance by the Contracting Parties in accordance with the Shanghai Convention and this Agreement shall not be transferred to a third party or disclosed without the prior written consent of the Contracting Party to the provision. 4. The Contracting Parties are strengthening law enforcement cooperation within the framework of the regional anti-terrorist structure of the member States of the Shanghai Cooperation Organization.
Article 6
The Contracting Parties shall independently bear the costs associated with the implementation of this Agreement, unless otherwise agreed.
Article 7
The working languages of cooperation between the Central Competent Authorities of the Contracting Parties under this Agreement are Russian and Chinese.
Article 8
This Agreement does not limit the right of the Contracting Parties to conclude other international treaties on matters that are the subject of this Agreement, which do not contradict its ideas and objectives and do not affect the rights and obligations of the Contracting Parties arising from other international treaties to which they adhere.
Article 9
In case of disputes and disagreements in the interpretation or application of the provisions of this Agreement, the Contracting Parties will resolve them through negotiations and mutual consultations through diplomatic channels.
Article 10
By mutual agreement of the Contracting Parties, amendments and additions may be made to this Agreement, which are formalized by separate protocols that are integral parts of this Agreement.
Article 11
1. This Agreement shall be concluded for an indefinite period and shall enter into force on the thirtieth day after receipt of the last written notification on the completion by the Contracting Parties of the internal procedures necessary for its entry into force. 2. Each of the Contracting Parties may denounce this Agreement by notifying the other Contracting Party in writing 12 months in advance through diplomatic channels.
Done in Beijing on December 23, 2002, in two originals, each in the Kazakh, Chinese and Russian languages, all texts being equally authentic. In case of disagreement in the interpretation of the provisions of this Agreement, the Contracting Parties will refer to the text in Russian.
