On approval of the Methodology for determining the price of saiga derivatives

In accordance with subparagraph 3) Paragraph 1 of Article 9 of the Law of the Republic of Kazakhstan "On the protection, reproduction and use of wildlife" I ORDER:
1. To approve the attached Methodology for determining the price of saiga derivatives.
2. The Committee of Forestry and Wildlife of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:
1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) posting of this order on the Internet resource of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan after its official publication;
3) within three working days after the fulfillment of subitems 1) and 2) of this paragraph, provide the Department of Legal Service of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan with information on their implementation.
3. Control over the execution of this order is entrusted to the supervising Vice Minister of Ecology and Natural Resources of the Republic of Kazakhstan.
4. This order shall enter into force upon the expiration of ten calendar days after the date of its first official publication.

The method of determining the price of saiga derivatives
Chapter 1. General provisions
1. This Methodology for determining the price of saiga derivatives (hereinafter referred to as the Methodology) is used by the authorized body to determine the sale price of saiga derivatives in order to ensure pricing transparency, prevent underestimation and (or) overestimation of prices and generate fair market value.
2. The methodology defines the algorithm for determining the sale price by the authorized body and the algorithm for calculating the sale price of saiga derivatives by a consultant used by the authorized body to determine the sale price of saiga derivatives.
3. The following basic concepts are used in this Methodology:
1) saiga derivatives – saiga antlers and products made from them and (or) their derivatives;
2) the seller is Zhasyl Damu Joint Stock Company, one hundred percent of whose shares belong to the state, which carries out activities on the sale of saiga derivatives by decision of the Government of the Republic of Kazakhstan.;
3) the authorized body is the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan;
4) subordinate organization is the republican state–owned enterprise Okhotzooprom Production Association, which is under the jurisdiction of the authorized body and carries out labeling and storage of saiga derivatives;
5) consultant – joint stock company "Center for the Development of Trade Policy "QazTrade", one hundred percent of the shares of which belong to the state, determined by the decision of the Government of the Republic of Kazakhstan by the National Institute of Development in the field of development and promotion of non-primary exports.;
Chapter 2. Algorithm for calculating the sale price of saiga derivatives by a consultant

Defining an indicator
The selling price of saiga derivatives is the price per 1 (one) kilogram of saiga derivatives.
2.
Frequency and timing
When selling saiga derivatives, after the authorized body receives information from the subordinate organization on the volumes and nomenclature of labeled saiga derivatives stored in its warehouse and (or) database.
3.
Information sources
The sources of information are:1) information from the subordinate organization on the volumes and nomenclature of labeled saiga derivatives; 2) responses from potential buyers received by the consultant; 3) official sources of information containing data on market prices for saiga derivatives and similar goods; 4) data from interested government agencies, if available; 5) the official exchange rate of the National Bank of the Republic of Kazakhstan as of the date calculation.

The algorithm of the indicator reflects a detailed and clear calculation sequence with an indication of the unit of measurement
The recommended price for the initial sale is determined by the formula:B = (P1 + P2 + P3) / 3,where:C is the recommended price for 1 (one) kilogram of saiga derivatives, indicated in the consultant's report;P1, P2, P3 are the comparable suggested prices of the three potential buyers who offered the highest prices taken into account in the calculation.The recommended price of the initial sale in the presence of two offers from potential buyers or price offers is determined by the formula:B = (P1 + P2) / 2,where:In – recommended price for 1 (one) kilogram of saiga derivatives, indicated in the consultant's report, tenge;P1, P2 – comparable suggested prices of two potential buyers who offered the highest prices taken into account in the calculation, tenge.The recommended price of the initial sale in the presence of offers from potential buyers or price offers that do not meet the above requirements:B = accounting for all P and K, where:B is the recommended price for 1 (one) kilogram of saiga derivatives, indicated in the consultant's report;P– comparable prices offered by all potential buyers, taken into account in the calculation, tenge;K – analysis of all official sources

To calculate the recommended selling price of saiga derivatives, a consultant:
1) sends potential buyers requests containing information about the volume, nomenclature, time of sale, unit of measurement, currency of calculation and other conditions for the sale of saiga derivatives that affect the price; 2) takes into account the responses of potential buyers if there is a proposed price per unit of saiga derivatives, the proposed volume of purchase, the validity period of the offer, payment terms and delivery or other information that makes it possible to bring the offer to a comparable form; 3) brings the offers of potential buyers to a comparable form by recalculating the price for a single unit of measurement, accounting for comparable payment terms, as well as excluding conditions that are not directly related to the price of saiga derivatives; 4) excludes responses from potential buyers that do not contain the proposed price, contain inaccurate or incomplete information, as well as offers whose conditions do not allow them to be brought to a comparable form; 5) in order to prevent underestimation of the recommended selling price, calculation of the offer of the three potential buyers who offered the highest prices. At the same time, the difference between the maximum and minimum prices should not exceed twenty percent.
Chapter 3. The algorithm for determining the sale price by the authorized body

Getting the consultant's report
The authorized body receives a consultant's report from the seller, accompanied by supporting materials used in the preparation of recommendations on the sale price of saiga derivatives.
2.
Determination of the primary sale price
If the consultant's report meets the requirements of this Methodology, the price of the initial sale of saiga derivatives is determined taking into account the recommended price indicated in the consultant's report.
3.
Return of materials for revision
If the consultant's report does not comply with the requirements of this Methodology, the authorized body returns the materials to the seller for revision with comments.
4.
Determination of the subsequent sale price
The price of the subsequent sale of saiga derivatives is determined based on the price established by the results of previous tenders.B1= I1,where:B1 is the price for 1 (one) kilogram of saiga derivatives for subsequent sale (upcoming tenders), tenge; I1 is the price for 1 (one) kilogram of saiga derivatives based on the results of previous tenders, tenge.When tenders are declared invalid, a correction factor is applied to the selling price of saiga derivatives.B2= I2*0.8,where:B2 – price for 1 (one) kilogram of saiga derivatives, tenge;I2 – the price for 1 (one) kilogram of saiga derivatives, determined by the previous decision of the authorized body, tenge;0.8 is the correction factor.If the tenders are declared invalid, after applying the correction factor, the authorized body instructs the seller to involve a consultant to calculate the selling price of saiga derivatives, in accordance with the procedure established by Chapter 2 of this Methodology.
5.
Making a decision and sending it to the seller
The sale price of saiga derivatives is formalized by a decision of the authorized body and brought to the attention of the seller to organize the sale of saiga derivatives in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
