On approval of the Model Regulation of the Architectural and Urban Planning Council

Order of the Minister of Industry and Construction of the Republic of Kazakhstan dated February 12, 2026 No. 54. It was registered with the Ministry of Justice of the Republic of Kazakhstan on February 20, 2026, No. 38013.

In accordance with paragraph 3 of Article 32 of the Building Code of the Republic of Kazakhstan, I ORDER:

     1. To approve the attached Standard Provision of the Architectural and Urban Planning Council.

     2. The Committee on Construction and Housing and Communal Services of the Ministry of Industry and Construction of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:

     1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

     2) posting of this order on the Internet resource of the Ministry of Industry and Construction of the Republic of Kazakhstan.

     3. Control over the execution of this order is entrusted to the supervising Vice Minister of Industry and Construction of the Republic of Kazakhstan.

     4. This order will enter into force on July 1, 2026 and is subject to official publication.

The standard provision on the Architectural and urban Planning Council

1. General provisions

     1. This Model Regulation on the Architectural and Urban Planning Council (hereinafter referred to as the Model Regulation) has been developed in accordance with paragraph 3 of Article 32 of the Building Code of the Republic of Kazakhstan.

     2. The Architectural and Urban Planning Council (hereinafter referred to as the Council) is a permanent consultative and advisory body established under the akimats of the capital, regions and cities of republican significance to coordinate actions to implement a unified urban planning policy, improve the quality of human habitat and vital activity, ensure sustainable development and the formation of a modern architectural appearance of settlements.

     3. In its activities, the Council is guided by the legislation of the Republic of Kazakhstan on architectural, urban planning and construction activities, as well as this Standard Provision.

2. The main goals and objectives of the Council

     4. The Council:

     1) considers and makes recommendations on issues of monumental and artistic design, architectural appearance, urban planning and the design code of the settlement;

     2) considers the terms of reference for the development of urban-planning projects for the development and development of settlements;

     3) reviews the monitoring report on the implementation of the general plan of the settlement;

     4) reviews and ensures compliance of the submitted projects with the current legislation, urban planning regulations, as well as strategic documents for the development and development of settlements;

     5) performs other functions in accordance with the legislation of the Republic of Kazakhstan.

3. Structure and management of the Council

     5. The composition of the architectural and urban planning council is formed by the local representative body of the capital, the region and the city of republican significance in an odd number of at least seven people.

     6. The architectural and urban planning council includes representatives of the local executive body, architects and specialists from research organizations, representatives of design, public and other organizations, including those representing the interests of persons with disabilities.

     7. The Council is headed by the akim of the capital, the region and the city of republican significance – the Chairman.

     8. The Vice-Chairmen of the Council are:

     Deputy Akim of the capital, region and city of republican significance in charge of construction issues;

     the chief architect of the capital, the region and the city of republican importance.

     9. The Secretary of the Council is appointed by an employee of the local executive body for architecture and urban planning, who is not a member of it and does not have the right to vote when making decisions.

     10. In the absence of the Chairman, a meeting of the Council may be conducted by one of the Deputy Chairmen of the Council.

     11. In addition to the approved composition, representatives of professional and public associations, accredited associations and unions are involved in the work of the Council with the right to vote.

     12. The frequency of meetings of the Council is determined by the Chairman or Deputy Chairman.

4. The working body of the Council

     13. The working body performs the following functions:

     1) preparation of materials for the Council meeting;

     2) preparation of the agenda of meetings and registration of minutes;

     3) notifying the members of the Council of the time and agenda of the meeting;

     4) other organizational and technical functions necessary to ensure the work of the Council.

     14. Following the meeting, a protocol is drawn up, which reflects the decisions taken by the Council. A member of the Council who does not agree with the adopted decision shall attach to the minutes the text of his dissenting opinion.

     15. The decisions of the Council are considered valid if at least 2/3 of its members attended the meeting.

     16. Based on the results of the discussion, the Council recommends the draft:

     1) to implement;

     2) to the implementation with comments;

     3) return it for revision;

     4) Reject.

     17. The minutes of the Council meeting are sent to all interested government agencies for decision-making, as well as to individuals and legal entities whose drafts were considered according to the agenda of the Council meeting.

     18. In order to ensure transparency of the Council's work and to inform the public, accredited representatives of the mass media, architects, teachers and students of architectural faculties of higher educational institutions are allowed to attend the Council meeting.
