     In accordance with subparagraph 3) I HEREBY DECREE paragraph 2 of Article 4 of the Law of the Republic of Kazakhstan "On Combating Terrorism":

     The footnote. The preamble is in the wording of the Decree of the President of the Republic of Kazakhstan dated 02/28/2024 No. 491.

     1. To approve the attached Regulations on the Anti-Terrorist Center of the Republic of Kazakhstan.

     2. To invalidate the Orders of the President of the Republic of Kazakhstan dated December 29, 2003 No. 435 "On the Anti-Terrorist Center of the National Security Committee of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 2003, No. 50, Article 572) and of April 8, 2005 No. 544 "On Amendments and additions to the Order of the President of the Republic of Kazakhstan dated December 29 2003, No. 435" (SAPP of the Republic of Kazakhstan, 2005, No. 18, Article 207).

     3. This Decree shall enter into force from the date of signing.

Regulations on the Anti-Terrorist Center of the Republic of Kazakhstan

     The footnote. The Regulation is amended by Decree of the President of the Republic of Kazakhstan dated 02/28/2024 No. 491.

Chapter 1. General provisions

     1. The Antiterrorist Center of the Republic of Kazakhstan (hereinafter referred to as the Antiterrorist Center) is a permanent consultative and advisory body formed under the authorized state body for coordinating activities in the field of countering extremism and terrorism in order to create, maintain and develop conditions necessary and sufficient to effectively counter extremism and terrorism in the Republic of Kazakhstan, including to ensure consistency actions of state bodies and local self-government bodies of the Republic of Kazakhstan in this area.

     The legal basis for the activities of the Anti-Terrorist Center is the Constitution of the Republic of Kazakhstan, laws, acts of the President of the Republic of Kazakhstan and other regulatory legal acts, as well as this Regulation.

Chapter 2. The main tasks, functions and powers of the Anti-Terrorist Center

     2. The main tasks of the Anti-Terrorist Center are:

     1) preparation of proposals to the President of the Republic of Kazakhstan on the formation of state policy and improvement of legislation of the Republic of Kazakhstan in the field of countering extremism and terrorism;

     2) development of conceptual approaches, identification of main priorities, development of practical measures for state and local government bodies in the field of countering extremism and terrorism;

     3) coordination of the activities of state bodies and local self-government bodies for the prevention of extremism and terrorism; identification, suppression of extremist actions and terrorist activities, disclosure and investigation of extremist and terrorist crimes; minimizing and (or) eliminating the consequences of terrorism, as well as organizing their interaction with public associations and organizations in the field of countering extremism and terrorism;

     4) monitoring, assessment and forecasting of terrorist threats and manifestations;

     5) organization of the activities of the republican operational headquarters for combating terrorism;

     6) implementation of international best practices in countering extremism and terrorism;

     7) solving other tasks stipulated by the legislation of the Republic of Kazakhstan in the field of countering extremism and terrorism.

     3. In accordance with the main tasks of the Anti-Terrorist Center, the following functions are assigned::

     1) participation in the development of state policy in the field of countering extremism and terrorism;

     2) analysis of law enforcement practice and study of foreign experience in countering extremism and terrorism;

     3) identification and elimination of the causes and conditions negatively affecting the state of the national system of countering extremism and terrorism;

     4) elaboration and submission of proposals on issues within the competence of the Anti-Terrorist Center that require a decision by the President or the Government of the Republic of Kazakhstan;

     5) assessment and development of measures to improve the activities of state and local government bodies in the field of countering extremism and terrorism;

     6) developing measures for the mutual exchange of information between government agencies that are part of the Anti-Terrorism Center on countering extremism and terrorism, including through the use of the Anti-Terror information system, in accordance with the procedure determined by a joint regulatory legal act;

     7) cooperation in ensuring the personal safety of employees of state bodies and local self-government bodies in the process of their implementation of anti-terrorist measures;

     8) consideration of issues related to the activities of operational headquarters to combat terrorism;

     9) providing practical and methodological assistance to anti-terrorist commissions, territorial divisions of central state bodies and local self-government bodies in organizing activities to counter extremism and terrorism;

     10) ensuring the preparation, conduct and coordination of joint and international anti-terrorist exercises and training to prevent acts of terrorism, minimize and eliminate their consequences;

     11) cooperation with government agencies in the development and coordinated implementation of measures for training and advanced training of personnel in the field of countering extremism and terrorism, including coordination and methodological support for the professional training of personnel of authorized government agencies;

     12) the use, by agreement, of the functional capabilities and logistical base of government agencies involved in countering extremism and terrorism;

     13) elaboration of measures for the formation and development of the Internet resource of the Anti-Terrorist Center in accordance with the Rules approved by a joint order of the state bodies that are part of the Anti-Terrorist Center;

     14) publication of the interdepartmental Information Bulletin of the Anti-Terrorist Center in accordance with the Rules of preparation and publication approved by a joint regulatory legal act of the state bodies that are part of the Anti-Terrorist Center;

     15) submitting proposals for the development of international treaties, regulatory legal acts, joint plans and programs on countering extremism and terrorism for consideration by state bodies;

     16) implementation of international cooperation in the field of countering extremism and terrorism, interaction with international centers and organizations on countering extremism and terrorism;

     17) sending, in accordance with the established procedure, employees of state bodies that are part of the Antiterrorist Center to quota positions in international organizations in the field of countering extremism and terrorism or to full-time positions in diplomatic missions of the Republic of Kazakhstan to perform the duties of authorized representatives on the basis of international treaties ratified by the Republic of Kazakhstan.

     4. In order to fulfill the tasks assigned to it, the Anti-Terrorist Center has the right:

     1) at meetings of the Anti-Terrorist Center, to hear reports from officials of state bodies that are part of the Anti-Terrorist Center, heads of anti-terrorist commissions, to coordinate plans of anti-terrorist commissions for the relevant year, to discuss the results of the work of state bodies and local governments in the field of countering extremism and terrorism;

     2) to take, within the limits of their competence, decisions necessary for the coordination and improvement of interaction between state bodies and local governments, public associations and organizations in the field of countering extremism and terrorism;

     3) to make proposals to the President of the Republic of Kazakhstan, the Administration of the President of the Republic of Kazakhstan, the Security Council of the Republic of Kazakhstan, and the Government of the Republic of Kazakhstan on bringing officials of central and local executive bodies to justice for improper performance of their duties in the field of countering extremism and terrorism;

     4) request and receive, in accordance with the established procedure, from state bodies, local governments, public associations, organizations, regardless of their forms of ownership, the necessary materials and information in the field of countering extremism and terrorism;

     5) create interdepartmental working groups to resolve issues within the competence of the Anti-Terrorist Center and determine the procedure for their work;

     6) participate in the development and conclusion of memoranda and agreements with foreign states, international organizations and centers on countering extremism and terrorism;

     7) to store and use official documents and materials necessary to ensure the activities of the Anti-Terrorist Center, if necessary and in coordination with government agencies to use their information systems in accordance with the legislation of the Republic of Kazakhstan.

Chapter 3. Composition of the Anti-Terrorist Center

5. The head of the Anti-Terrorist Center is ex officio the Chairman of the National Security Committee of the Republic of Kazakhstan.

     Head of the Anti-Terrorism Center:

     1) preside over its meetings;

     2) approves the agreed work plan of the Anti-Terrorist Center for the relevant year;

     3) at the end of the year, hears the report of the Headquarters of the Anti-Terrorist Center of the National Security Committee of the Republic of Kazakhstan (hereinafter referred to as the Headquarters of the Anti-Terrorist Center) on the implementation of decisions of the Anti-Terrorist Center;

     4) informs the President of the Republic of Kazakhstan about the work of the Anti-Terrorist Center.

     6. Ex officio members of the Anti-Terrorism Center are:

     1) Head of the State Security Service of the Republic of Kazakhstan;

     2) Minister of Defense of the Republic of Kazakhstan;

     3) Minister of Internal Affairs of the Republic of Kazakhstan;

     4) Chairman of the Financial Monitoring Agency of the Republic of Kazakhstan;

     5) Minister of Emergency Situations of the Republic of Kazakhstan;

     6) Minister of Science and Higher Education of the Republic of Kazakhstan;

     7) Minister of Education of the Republic of Kazakhstan;

     8) Minister of Culture and Information of the Republic of Kazakhstan;

     9) Minister of Justice of the Republic of Kazakhstan;

     10) Minister of Labor and Social Protection of the Population of the Republic of Kazakhstan;

     11) Minister of Industry and Construction of the Republic of Kazakhstan;

     12) Minister of Transport of the Republic of Kazakhstan;

     13) Minister of Health of the Republic of Kazakhstan;

     14) Minister of Tourism and Sports of the Republic of Kazakhstan;

     15) Minister of Foreign Affairs of the Republic of Kazakhstan;

     16) Minister of Finance of the Republic of Kazakhstan;

     17) Minister of National Economy of the Republic of Kazakhstan;

     18) Minister of Artificial Intelligence and Digital Development of the Republic of Kazakhstan;

     19) Minister of Energy of the Republic of Kazakhstan;

     20) Chief of Staff of the Anti-Terrorist Center (Deputy Head of the Anti-Terrorist Center).

     7. By the decision of the head of the Anti-Terrorist Center, the first heads of state bodies outside the Anti-Terrorist Center or persons acting in their duties are invited to a meeting of the Anti-Terrorist Center.

     Officials and specialists of state and local government bodies, as well as representatives of public associations and organizations, may be involved in the work of the Anti-Terrorist Center (as agreed).

Chapter 4. Organization of the work of the Anti-Terrorist Center

     8. Organizational, information, analytical and logistical support for the activities of the Anti-Terrorist Center is provided by the working body - the Headquarters of the Anti-Terrorist Center, which is a structural unit of the National Security Committee of the Republic of Kazakhstan.

     The headquarters of the Anti-Terrorist Center provides organizational and information and analytical support for the activities of the republican, regional, city of republican significance, capital, district (city of regional significance) operational headquarters for combating terrorism, including when measures are put into effect according to the plan of the anti-terrorist operation.

     The Chief of Staff of the Anti-Terrorist Center directs the working group of the republican operational headquarters during the anti-terrorist operation and signs documents on the activities of the Headquarters of the Anti-Terrorist Center.

     9. The Anti-Terrorism Center carries out its activities on the basis of a jointly adopted annual work plan. Proposals for the work plan for the coming year are submitted by members of the Anti-Terrorist Center to the head of the Anti-Terrorist Center no later than December 1 of this year.

     10. Based on the monitoring, assessment and forecasting of terrorist threats and manifestations, as well as proposals received from government agencies, local governments and anti-terrorist commissions, the headquarters of the Anti-Terrorist Center prepares a draft work plan for the Anti-Terrorist Center, coordinates it with the members of the Anti-Terrorist Center and submits it to the head of the Anti-Terrorist Center for signature.

     11. Adjustments may be made to the work plan of the Anti-Terrorist Center with notification to the members of the Anti-Terrorist Center.

     12. Meetings of the Anti-Terrorist Center are convened by its head and are held at least once a quarter.

     13. On the initiative of the head and members of the Anti-Terrorist Center, extraordinary meetings may be convened, for consideration of which unscheduled issues are submitted.

     14. Based on the submitted materials, the Headquarters of the Anti-Terrorist Center prepares the agenda of the meeting and determines the date, time and place of the meeting, which are approved by the head of the Anti-Terrorist Center.

     The agenda of the meeting, accompanied by all necessary materials and documents, is sent to the members of the Anti-Terrorist Center and other invited participants of the meeting no later than five working days before the meeting.

     15. The preparation of materials on issues that are submitted for consideration by the Anti-Terrorist Center is carried out by the executors included in the work plan of the Anti-Terrorist Center. In this case, the state body indicated first is the responsible executor. The co-executors of the events provide the responsible executive with the necessary materials to compile the background material for the meeting.

     Responsible executors from among government agencies form reference and other materials on the issues under consideration, a list of invited persons, which are sent to the Headquarters of the Anti-Terrorist Center no later than thirty days before the date of the meeting of the Anti-Terrorist Center.

     16. When preparing materials and executing decisions of the Anti-Terrorist Center, members of the Anti-Terrorist Center may send requests for information, materials and other documents on issues included in the work of the Anti-Terrorist Center to other members of the Anti-Terrorist Center, other state bodies, local governments, as well as representatives of public associations and organizations (as agreed) involved in the work of the Anti-Terrorist Center. the competence of these bodies.

     17. The headquarters of the Anti-Terrorist Center verifies the completeness and quality of the materials to be considered at the meeting, which are reported to the head of the Anti-Terrorist Center. Materials prepared improperly are returned for revision.

     The finalized documents are submitted to the Headquarters of the Anti-Terrorist Center within three working days.

     18. The Headquarters of the Anti-Terrorist Center ensures the attendance of persons invited to the meeting and familiarizes them with relevant materials and documents.

     19. A meeting of the Anti-Terrorist Center is considered competent if more than half of its members are present.

     If it is impossible for a member of the Anti-Terrorist Center to attend a meeting, he/she shall notify the head of the Anti-Terrorist Center in writing in advance and send a candidate for a representative of the relevant state body to replace him/her. The person performing his duties, after coordination with the head of the Anti-Terrorist Center, may attend its meeting with the right to vote.

     20. The members of the Anti-Terrorist Center have equal rights when discussing the issues under consideration at the meeting.

     The first heads of government agencies not part of the Anti-Terrorist Center, or persons acting as such, who are invited to a meeting of the Anti-Terrorist Center, have the right to vote when making decisions on the issues on which they were invited.

     Decisions are made by a simple majority of votes. If the votes are equal, the chairman's vote is decisive.

     21. The results of the discussion and the decisions taken by the Anti-Terrorist Center are recorded in the minutes of the meeting (hereinafter referred to as the minutes), which are drawn up within five working days after the meeting and submitted for signature to the head of the Anti-Terrorist Center.

     22. The protocol signed by the head of the Anti-Terrorist Center is sent by the Headquarters of the Anti-Terrorist Center to the members of the Anti-Terrorist Center, other invited participants of the meeting, as well as to the Administration of the President of the Republic of Kazakhstan within two working days after its signing.

     The head of the Anti-Terrorist Center is informed by the Headquarters of the Anti-Terrorist Center about the implementation of the protocol of the Anti-Terrorist Center.

     The decisions of the Anti-Terrorist Center are implemented by the state and local executive bodies that participated in the development of these decisions, within the framework of their competence established by the legislation of the Republic of Kazakhstan.

     23. In order to ensure the implementation of the decisions of the Anti-Terrorist Center, the first heads of state bodies take measures to determine and consolidate the competence of the units and employees responsible for implementing the tasks of the state body in the field of countering extremism and terrorism, which is reported to the Headquarters of the Anti-Terrorist Center.

     24. In order to implement the decisions of the Anti-Terrorist Center, the Headquarters of the Anti-Terrorist Center monitors the implementation of the protocol in state and local government bodies, except in cases provided for by the laws of the Republic of Kazakhstan.

If several state bodies are involved in the execution of the decision of the Anti-Terrorist Center set out in the protocol, organizational support is assigned to the body indicated first. The co-executors of the events should provide the responsible contractor with the necessary materials at least seven working days before the deadline for the execution of the event.

     To implement the decisions of the Anti-Terrorist Center in the field of countering extremism and terrorism, draft acts of the President of the Republic of Kazakhstan, resolutions of the Government of the Republic of Kazakhstan and other regulatory legal acts of the Republic of Kazakhstan may be developed, which are submitted for consideration in accordance with the procedure established by the legislation of the Republic of Kazakhstan.

     25. Representatives of the Presidential Administration of the Republic of Kazakhstan and members of the Security Council of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan may participate in meetings of the Anti-Terrorist Center.

Chapter 5. The procedure for seconding or sending authorized representatives of state bodies to the working body of the Anti-Terrorist Center

     26. In order to ensure effective cooperation between government agencies engaged in countering extremism and terrorism and solving the tasks of the Anti-Terrorist Center within the competence of government agencies that are part of the Anti-Terrorist Center, their authorized representatives are seconded or sent to the working body of the Anti-Terrorist Center.

     An authorized representative of a government agency is understood to be an employee of a special government agency, a law enforcement agency and a military officer, an administrative civil servant sent to the working body of an Anti-Terrorist Center to ensure effective cooperation between government agencies in the field of countering extremism and terrorism.

     A seconded authorized representative of a government agency is understood to be an employee of a special government agency, a law enforcement agency, and a military personnel seconded to a working body of an anti-terrorist center to ensure effective cooperation between government agencies in the field of countering extremism and terrorism.

     27. The secondment of an authorized representative of a state body to the working body of the Anti-Terrorist Center is carried out in accordance with the legislation of the Republic of Kazakhstan.

     28. The referral of an authorized representative of a state body to the working body of the Anti-Terrorist Center is carried out by the state body in coordination with the head of the Anti-Terrorist Center.

     29. Before sending an authorized representative of the state body to the working body of the Anti-Terrorist Center, the personal file of the authorized representative of the state body is submitted for consideration and, if necessary, an interview is conducted with the Chief of Staff of the Anti-Terrorist Center.

     30. If the head of the Anti-Terrorist Center receives written consent, the state body issues an order within ten working days to send its authorized representative to the working body of the Anti-Terrorist Center, leaving him on the staff of the state body.

     The job description of the authorized representative of the state body sent is approved by the Chief of Staff of the Anti-Terrorist Center and the authorized official of the sending state body.

     The period of service sent by an authorized representative of the state body in the working body of the Anti-Terrorist Center is determined by the state body in coordination with the head of the Anti-Terrorist Center, but should not be less than one year.

     31. The Chief of Staff of the Anti-Terrorist Center issues an order to accept the authorized representative for temporary registration in the working body of the Anti-Terrorist Center.

     32. If it is necessary to replace the sent authorized representative of the state body, the sending state body shall notify the head of the Anti-Terrorist Center in writing with the submission of another candidate in accordance with the procedure established by paragraphs 28, 29 and 30 of these Regulations.

     33. The head of the Anti-Terrorist Center submits petitions for encouragement or disciplinary penalties to the state bodies that have sent or seconded their authorized representatives to the working body of the Anti-Terrorist Center.

Chapter 6. Financing the activities of the Anti-Terrorist Center

     34. Financing of the activities of the Anti-Terrorist Center is carried out at the expense and within the limits of the funds provided in the republican budget for the relevant financial year to the National Security Committee of the Republic of Kazakhstan, as well as to the state bodies that are part of the Anti-Terrorist Center.

     35. For the period of service in the working body of the Anti-Terrorist Center, financial, material and social support for seconded authorized representatives of state bodies is carried out in accordance with the procedure established by the legislation of the Republic of Kazakhstan.

     For the period of service in the working body of the Anti-Terrorist Center, financial, material and social support for the authorized representatives of state bodies is carried out according to the norms and at the expense of funds provided for the maintenance of state bodies from where the employees were sent.
