On approval of the Regulations on the National Security Committee of the Republic of Kazakhstan

In accordance with subparagraph 6) of Article 3 of the Law of the Republic of Kazakhstan "On National Security Agencies of the Republic of Kazakhstan", I HEREBY DECREE:

1. To approve the attached Regulations on the National Security Committee of the Republic of Kazakhstan.

Chapter 1. General provisions

1. The National Security Committee of the Republic of Kazakhstan (hereinafter referred to as the National Security Committee) is a special state body of the Republic of Kazakhstan directly subordinate and accountable to the President of the Republic of Kazakhstan, which manages, within the limits of its powers, the unified system of national security bodies of the Republic of Kazakhstan (hereinafter referred to as the national security bodies), intelligence, counterintelligence, operational and investigative activities in the field of protection and protection of the State Border of the Republic of Kazakhstan (hereinafter – State border), provision of government communications and organization of encryption work, in the field of state control in the field of informatization in terms of information security of critical information and communication infrastructure facilities, suppression of acts of terrorism and other particularly dangerous criminal attacks on individuals, society and the state, organization of aviation activities of national security agencies, identification, suppression, disclosure and investigation of corruption offenses, protection of state secrets, and is the authorized body for the protection of state secrets in the Republic of Kazakhstan.

2. The National Security Committee has departments:
1) Border Service of the National Security Committee;
2) Government Communications Service of the National Security Committee;
3) Special Purpose Service "A" of the National Security Committee;
4) The Foreign Intelligence Service of the National Security Committee;
4-1) Anti-Corruption Service of the National Security Committee;
5) Aviation Service of the National Security Committee.

3. The National Security Committee carries out its activities in accordance with the Constitution, laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and other regulatory legal acts, as well as these Regulations.
4. The National Security Committee is a legal entity in the organizational and legal form of a republican state institution, has seals with the image of the State Emblem of the Republic of Kazakhstan and stamps with its name in Kazakh and Russian, letterheads of the established sample, accounts with treasury authorities in accordance with the legislation of the Republic of Kazakhstan.
5. The National Security Committee enters into civil law relations on its own behalf.
6. The National Security Committee has the right to act as a party to civil law relations on behalf of the State if it is authorized to do so in accordance with the legislation of the Republic of Kazakhstan.
7. The National Security Committee, in matters of its competence, in accordance with the procedure established by law, makes decisions drawn up by orders of the head of the National Security Committee and other acts provided for by the legislation of the Republic of Kazakhstan.
8. The structure and staffing limit of the National Security Committee are approved in accordance with the legislation of the Republic of Kazakhstan.

10. This Regulation is the founding document of the National Security Committee.
11. The activities of the National Security Committee are financed from the national budget in accordance with the legislation of the Republic of Kazakhstan.
12. The National Security Committee is prohibited from entering into contractual relations with business entities for the performance of duties that are the authority of the National Security Committee.
If the National Security Committee is granted the right by legislative acts to carry out income-generating activities, the income received is directed to the state budget, unless otherwise established by the legislation of the Republic of Kazakhstan.
Chapter 2. Tasks and powers of the state body
13. Tasks:
1) participation in the development and implementation of state policy in the field of ensuring the security of individuals, society and the state;
2) obtaining intelligence information in the interests of the Republic of Kazakhstan in accordance with the Law of the Republic of Kazakhstan "On Foreign Intelligence";
3) providing the President, Parliament, Government and other state bodies of the Republic of Kazakhstan with intelligence information and analytical assessments necessary for decision-making in political, financial, economic, military, political, scientific, technical, humanitarian, environmental and other areas affecting the national interests of the Republic of Kazakhstan;
4) assistance in the implementation of the policy of the state leadership in political, military-political, financial-economic, scientific-technical, humanitarian, environmental and other areas affecting the national interests of the Republic of Kazakhstan;
5) ensuring the interaction of government agencies and organizations of the Republic of Kazakhstan within the framework of the intelligence community of the Republic of Kazakhstan;
6) ensuring the security of foreign institutions of the Republic of Kazakhstan and their personnel and implementing measures to protect state secrets and counteract technical intelligence in foreign institutions of the Republic of Kazakhstan;
7) carrying out counterintelligence activities;
7-1) carrying out intelligence activities in accordance with the legislation of the Republic of Kazakhstan;
8) coordination and implementation of activities aimed at countering technical intelligence in relation to information constituting state secrets;
9) identification, prevention and suppression of terrorist and other activities aimed at forcibly changing the constitutional order, violating the integrity and undermining the security of the Republic of Kazakhstan;
10) coordination of activities in the field of countering terrorism and extremism in the Republic of Kazakhstan;
11) identification, suppression, disclosure and investigation of criminal offenses attributed by the legislation of the Republic of Kazakhstan to the jurisdiction of national security agencies;
11-1) detection, suppression, disclosure and investigation of corruption offenses;
12) providing the President of the Republic of Kazakhstan, government agencies, the Armed Forces of the Republic of Kazakhstan, other troops and military formations with government communications in peacetime and wartime;
13) organization of cryptographic work in authorized state bodies, military administration bodies, national security and internal affairs of the Republic of Kazakhstan;
14) ensuring the protection and protection of the State Border;
15) organization of secure communication of foreign institutions of the Republic of Kazakhstan and provision of physical protection of foreign institutions of the Republic of Kazakhstan;

in accordance with the legislation of the Republic of Kazakhstan, to conduct forensic, psychological, sociological and polygraphic studies.;
to carry out operational and combat measures to curb illegal activities in accordance with the special methods being developed, as well as to use special means in accordance with the list approved by the Government of the Republic of Kazakhstan.;
to infiltrate special services and organizations of foreign states, criminal groups whose goals and actions are aimed at undermining the security of the state, violating the territorial integrity of the Republic of Kazakhstan, and forcibly changing the constitutional order;
to interact with the subjects of the foreign intelligence service of the Republic of Kazakhstan in the conduct of intelligence activities, including the use of electronic and special technical means;
to make proposals to the President and the Government of the Republic of Kazakhstan on improving the foreign intelligence service of the Republic of Kazakhstan;
independently or jointly with authorized state bodies to resolve issues related to the closure of entry to the Republic of Kazakhstan and the expulsion from the Republic of Kazakhstan of foreigners and stateless persons who, by their actions, pose a threat or damage the security of society and the state.;
when detecting, suppressing, disclosing and investigating criminal offenses attributed by the legislation of the Republic of Kazakhstan to the jurisdiction of national security agencies, to give binding instructions to other bodies within the limits provided for by the criminal procedure legislation of the Republic of Kazakhstan.;
to summon citizens to the national security agencies based on materials in production, to receive explanations, certificates, documents from them and to make copies of them, to bring in persons who evade appearing on a call;
in accordance with the legislation of the Republic of Kazakhstan, to verify the identity documents of citizens with reasonable suspicion of committing criminal offenses, to detain persons suspected of committing criminal offenses, to check documents, personal search of detainees and their vehicles, as well as the seizure of their belongings and documents.;
when participating in an anti-terrorist operation and ensuring the legal regime of an anti-terrorist operation, apply the measures and time restrictions provided for by the Law of the Republic of Kazakhstan "On Countering Terrorism".;
use means of communication, vehicles belonging to the Armed Forces of the Republic of Kazakhstan, other troops and military formations, as well as other organizations, to prevent criminal offenses, prosecute and detain persons who have committed or are suspected of committing criminal offenses, deliver detained persons to their place of detention, as well as to travel to the scene and deliver those in need. urgent medical care for citizens in medical institutions (organizations). At the request of owners of communication facilities and vehicles, the national security authorities shall compensate for the actual damage caused as a result in accordance with the procedure established by the legislation of the Republic of Kazakhstan.;
freely enter the territory and premises of organizations, military formations and units, residential and other premises belonging to citizens, and land plots belonging to them in order to prevent criminal offenses, prosecute persons suspected of committing them, if delay may endanger the life and health of citizens, and harm the security of the country. The national security authorities notify the prosecutor of cases of forced entry into residential and other premises belonging to citizens within twenty-four hours.;
submit mandatory submissions to government agencies and organizations on the elimination of causes and conditions that contribute to the implementation of threats to the security of the Republic of Kazakhstan, the commission of criminal offenses, the investigation of which is attributed by the legislation of the Republic of Kazakhstan to the jurisdiction of national security agencies;
to carry out administrative detention of persons who have committed offenses related to attempts to enter and enter specially protected territories of special-regime and other facilities illegally located in the border zone. To check their identity documents, receive explanations from them, carry out their personal search, inspection and seizure of belongings and documents;
to have temporary detention facilities, pre-trial detention facilities for the detention, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, of persons in respect of whom detention or detention by national security agencies on suspicion of committing criminal offenses has been chosen as a preventive measure, in some cases, in coordination with national security agencies, detained and detained by law enforcement agencies and courts, as well as convicts;
to monitor, provide methodological and practical assistance in matters of ensuring the safety of state secrets, commercial, banking and other legally protected secrets, the security of special-purpose telecommunications networks of national security agencies, the activities of the encryption service in government agencies, the Armed Forces of the Republic of Kazakhstan, other troops and military formations, as well as in other organizations;
have other separate structural units outside its location that perform part of the functions of national security agencies and are not subject to registration with an authorized body.;
establish, maintain and develop contacts, conclude cooperation agreements with special services, law enforcement agencies, government and special communications agencies of foreign countries, international law enforcement organizations on the basis of international treaties of the Republic of Kazakhstan;
conclude contracts, agreements (memoranda) with organizations, issue joint orders with government agencies of the Republic of Kazakhstan necessary to fulfill the tasks and functions assigned to the National Security Committee.;
suspend, in accordance with the established procedure, the work of encrypted communications network units until the identified violations are eliminated, as well as the activities of any networks and means of communication if they are used for criminal purposes that harm the interests of individuals, society and the state, with the exception of government and presidential communications networks, communications services provided to the State Security Service, military authorities, national Security and Internal Affairs of the Republic of Kazakhstan;
suspend, in accordance with the established procedure, the work of encrypted communications network units until the identified violations are eliminated, as well as the activities of any networks and means of communication if they are used for criminal purposes that harm the interests of individuals, society and the state, with the exception of government and presidential communications networks, communications services provided to the State Security Service, military authorities, national Security and Internal Affairs of the Republic of Kazakhstan;
to prevent the use of transmitting radio-electronic devices on the territory of the Republic of Kazakhstan, used in violation of the established rules or legislation of the Republic of Kazakhstan on the protection of state secrets;

to receive, free of charge and in compliance with the requirements established by legislative acts for the disclosure of information constituting commercial, banking and other legally protected secrets from government agencies and organizations, information necessary for the performance of tasks assigned to national security agencies, including electronic information resources provided from the information systems of government agencies and organizations, in accordance with the procedure established by by joint regulatory legal acts with the specified state bodies, and by agreements with organizations.;
to send employees, military personnel and employees of national security agencies on official business trips, including outside the Republic of Kazakhstan;
to store and use archival operational, investigative and other materials related to the activities of national security agencies;

to conduct scientific research on the problems of ensuring the security of the Republic of Kazakhstan, to develop and create information systems and special types of communication systems;
to organize and carry out scientific research and development work;
to use on a contractual basis office premises, transport and other technical means of the Armed Forces of the Republic of Kazakhstan, other troops and military formations and other organizations, as well as premises, vehicles and other property of individuals and legal entities;
conclude agreements, contracts with bodies and organizations of the Republic of Kazakhstan, special services and organizations of foreign states;
to organize training, retraining and advanced training of personnel for state bodies of the Republic of Kazakhstan, as well as special and other bodies of foreign states in accordance with international treaties of the Republic of Kazakhstan;
to check the identity documents of individuals at the entrance (entrance) to facilities and premises of national security agencies and at the exit (exit) from them, to inspect their belongings (with the exception of protected persons and other persons defined by the legislation of the Republic of Kazakhstan);
to carry out control, organize inspections of the state of work to ensure the secrecy regime, the safety of state secrets, the organization and management of office work in the national security agencies;
in order to encrypt the identity of employees and military personnel of national security agencies, the departmental affiliation of their units, premises and vehicles, or the identity of citizens who assist national security agencies on a confidential basis, to use, produce and (or) execute documents of other government agencies, as well as organizations whose use, manufacture and (or) registration procedures It is determined by the Chairman of the National Security Committee. If it is necessary for national security bodies to use documents of state bodies requiring registration with state bodies for the purposes provided for in this paragraph, including documents issued by them, at the request of the National Security Committee, the relevant state bodies shall produce and (or) register them for national security bodies free of charge in accordance with the procedure established by joint regulatory legal acts. acts;
to send mandatory requests to other government agencies and organizations for the provision of forms of documents and official identification cards to national security agencies, as well as samples of their filling out;
in order to encrypt the identity of employees and military personnel of other subjects of foreign intelligence and special state bodies of the Republic of Kazakhstan, the departmental affiliation of their units, premises and vehicles, as well as the identity of confidential assistants, to produce and (or) issue documents of other state bodies and organizations for other subjects of foreign intelligence and special state bodies of the Republic of Kazakhstan, the procedure for the manufacture and/or design of which is determined by joint regulatory legal acts. If it is necessary for other subjects of foreign intelligence and special state bodies to use documents of state bodies requiring registration with state bodies, including documents issued by them, at the request of the National Security Committee, the relevant state bodies shall produce and (or) execute them free of charge in accordance with the procedure established by joint regulatory documents. legal acts;
to carry out technical studies on the classification of goods as special technical means for carrying out operational and technical measures and means of cryptographic protection of information, to issue appropriate conclusions on them;
consider applications from individuals and legal entities for the issuance of certificates (permits) for the import or export of special technical means and means of cryptographic protection of information, registration of notifications on the characteristics of goods containing cryptographic functions, issue appropriate permits for them and register notifications;
to coordinate licenses for the import and export of cryptographic information protection tools and special technical means intended for conducting operational search activities;
to develop, create, acquire and use special communications, weapons and equipment, including special technical and other means, while the development, production and adoption of state encryption tools and their special protection (against technical intelligence means) are carried out in accordance with the procedure established by the legislation of the Republic of Kazakhstan. To conclude agreements, contracts with government agencies and organizations of the Republic of Kazakhstan, special services and organizations of foreign states for these purposes.;
to create, commission, operate, develop and terminate the operation of government communications networks, encrypted communications networks of national security agencies, as well as special-purpose telecommunications networks used in the interests of national security agencies;
to carry out personnel training on a contractual basis for government agencies of the Republic of Kazakhstan and special services of foreign states;
use video cameras and other types of electronic equipment of government agencies and other organizations in accordance with the procedure established by joint regulatory legal acts or agreements.;

to involve citizens of the Republic of Kazakhstan on a voluntary basis as freelance operational staff;

to establish, accredit, and terminate the activities of a special certification center;
to organize and direct the activities of border representatives;
develop and approve regulatory legal acts in the field of protection of state secrets in accordance with the purpose and objectives of protection of state secrets;

inform the President of the Republic of Kazakhstan, the Parliament of the Republic of Kazakhstan, and the Government of the Republic of Kazakhstan about threats to the country's security;
to carry out intelligence activities in the interests of the Republic of Kazakhstan in accordance with the Law of the Republic of Kazakhstan "On Foreign Intelligence";
carry out counterintelligence activities;
identify, prevent and suppress terrorism and other activities aimed at forcibly changing the constitutional order, violating the integrity and undermining the security of the Republic of Kazakhstan;
identify, prevent, disclose and investigate criminal offenses attributed by law to the jurisdiction of national security agencies;
Assist government agencies in preventing and suppressing the activities of illegal paramilitary groups, political parties and trade unions of other states, religious-based parties, as well as financing of political parties and trade unions by foreign legal entities and citizens, foreign states and international organizations in the territory of the Republic of Kazakhstan.;
develop and implement measures for the counterintelligence protection of information constituting state secrets in government agencies, military formations, units and organizations, as well as monitor their activities in this area. Conduct a special check of citizens of the Republic of Kazakhstan who are being processed (re-registered) for access to information constituting state and official secrets;
participate in the development and implementation of measures to ensure the safety of defense facilities, nuclear energy, transport and communications, life support facilities in the regions and other strategic facilities, the list of which is determined by the Government of the Republic of Kazakhstan;
to participate in ensuring the security of foreign institutions of the Republic of Kazakhstan and their personnel;
participate, in accordance with the legislation of the Republic of Kazakhstan, in resolving issues related to the admission to citizenship of the Republic of Kazakhstan and renunciation of citizenship of the Republic of Kazakhstan, travel abroad of citizens of the Republic of Kazakhstan, entry into and exit from the territory of the Republic of Kazakhstan of foreigners and stateless persons, as well as the regime of their stay in the territory of the Republic of Kazakhstan;
to take measures in cooperation with other competent authorities to ensure the security of representative offices of foreign States and international organizations in the territory of the Republic of Kazakhstan;
to participate, on the instructions of the President of the Republic of Kazakhstan, together with other government agencies, in ensuring the security of heads of state, governments of foreign countries and heads of international organizations during their stay in the Republic of Kazakhstan, as well as important socio-political events held in the country.;
participate in ensuring the security of the President of the Republic of Kazakhstan and other protected persons;
ensure the protection and protection of the State Border;
to carry out the procedure of identity verification based on fingerprint information in relation to persons who have passed fingerprint registration when crossing the State border of the Republic of Kazakhstan;
carry out fingerprint registration of foreigners and stateless persons subject to expulsion from the Republic of Kazakhstan or subject to international readmission treaties ratified by the Republic of Kazakhstan;
conduct information and analytical work in order to implement the tasks assigned to the national security agencies;

Implement measures to ensure their own security, including preventing technical penetration of information from national security agencies that constitute state secrets.;
To take the necessary measures to ensure secrecy in the conduct of intelligence, counterintelligence, operational search activities, the sale of materials reflecting the results of these activities, as well as to prevent the declassification of information sources through the administrative activities of the Chairman of the National Security Committee or an official authorized by him, ensuring that access to materials of operational activities is restricted until they are made public.;
ensure the mobilization readiness of national security agencies;
to carry out personnel training for national security agencies, their retraining and advanced training;
to carry out a mandatory special inspection of citizens of the Republic of Kazakhstan who enter public service for the first time or re-enter public service after its termination, as well as applicants for the position of a judge, an employee of the National Bank of the Republic of Kazakhstan and its departments, an employee of the authorized body for regulation, control and supervision of the financial market and financial organizations, an aviation inspector of an authorized organization in in the field of civil aviation, which performs control and supervisory functions in the field of aviation security, in the following cases:, within the limits and in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

13) monitoring the implementation by state and local government bodies of a set of measures to improve security systems and readiness to neutralize terrorist threats;

309) development and approval, in coordination with the central authorized body for budget planning, of nutrition standards for military personnel of military administration bodies of national security bodies in peacetime;
310) development and approval of rules for the payment of monetary compensation in the amount of the cost of combined-arms rations in the absence of the possibility of providing food according to the established standards of basic food rations to military personnel serving under the contract of national security agencies;
311) development and approval of rules for the payment of money at the expense of the state to military personnel of national security agencies for the transportation of their own property within the Republic of Kazakhstan;
312) development and approval of rules for granting military personnel of national security agencies and their family members the right to travel by air at the expense of the State;

313-2) development and approval of rules for the establishment and payment of remuneration for information that helped to prevent or suppress an act of terrorism;
313-3) development and approval of a standard form of a family and property status survey report for an employee of the national security agency;
313-4) development and approval of regulatory legal acts on the organization of the activities of national security agencies and the implementation of the tasks assigned to them;
313-5) development and approval of rules for the organization and maintenance of convoys of vehicles of national security agencies and special-purpose vehicles, regulation of traffic on highways and streets during the passage of these convoys;
313-6) development and approval of the list of special means of the military police of the National Security Committee;
313-7) development and approval of rules for the organization and maintenance of combat duty in national security agencies;
313-8) development and approval of rules for the organization and conduct of combat service in national security agencies;
313-9) development and approval of rules for carrying out work aimed at patriotic, moral and spiritual education of personnel and the prevention of offenses in national security agencies;
313-10) development and approval of a standard of conduct for a serviceman of the Border Guard Service of the National Security Committee of the Republic of Kazakhstan during border control;
313-11) coordination of the list of authorized prosecutors exercising supreme supervision over the observance of legality in the field of foreign intelligence in the territory of the Republic of Kazakhstan, established by the order of the Prosecutor General of the Republic of Kazakhstan;
313-12) development and approval of rules for the development and approval of standard job descriptions for employees and military personnel of national security agencies;
313-13) development and approval of rules for the provision by telecom operators and (or) owners of communication networks operating in the territory of the Republic of Kazakhstan, at the expense of their own or borrowed funds, of the functions of their telecommunications equipment for the technical conduct of operational search, counterintelligence measures and requirements for networks and means of communication in coordination with the authorized body in the field of communications;
313-14) coordination of the rules for submitting aggregated data to the authorized body in the field of communications by telecom operators and (or) owners of communication networks operating in the territory of the Republic of Kazakhstan in case of threat and occurrence of emergency situations of a social, natural and man-made nature caused by natural disasters (earthquakes, mudslides, avalanches, floods and others), crisis environmental situations, wildfires, and epidemics determined by the authorized body in the field of communications;
313-15) coordination of rules for the presentation of databases in a de-identified form for use in scientific and scientific-technical activities, determined by the authorized body in the field of state statistics;

Chapter 3. Status and powers of the First Head of the National Security Committee
16. The National Security Committee is managed by its Chairman, who is personally responsible for fulfilling the tasks assigned to the National Security Committee and exercising its powers.
17. The Chairman of the National Security Committee is appointed by the President of the Republic of Kazakhstan with the consent of the Senate of the Parliament of the Republic of Kazakhstan and dismissed by the President of the Republic of Kazakhstan.
18. The Chairman of the National Security Committee has deputies, including the first one, who are appointed and dismissed in accordance with the legislation of the Republic of Kazakhstan.
19. Powers of the Chairman of the National Security Committee:
1) organizes the work of the National Security Committee;
2) submits proposals to the President of the Republic of Kazakhstan on the structure of the National Security Committee, the formation, abolition and reorganization of departments and territorial bodies of the National Security Committee, as well as state institutions subordinate to the National Security Committee;
3) approves the structure and staff of structural divisions, departments and territorial bodies of the National Security Committee, as well as state institutions subordinate to the National Security Committee, and the regulations (charters) on them, with the exception of departments whose regulations are approved by the President of the Republic of Kazakhstan on the proposal of the Chairman of the National Security Committee;
4) within the limits of its competence, issues legal acts regulating the activities of national security agencies, repeals legal acts that contradict the norms of the Constitution and legislation of the Republic of Kazakhstan, adopted by officials subordinate to it.;
5) makes proposals to the President and the Government of the Republic of Kazakhstan on issues of ensuring national security, organizational, staff, personnel, military medical (medical) and logistical support of national security bodies;
6) represents the National Security Committee in relations with government agencies of the Republic of Kazakhstan, as well as special services, government and special communications agencies of foreign states and international organizations;
7) sends official representatives of national security agencies and their assistants to foreign institutions of the Republic of Kazakhstan in coordination with special services or law enforcement agencies of other states, with the Ministry of Foreign Affairs of the Republic of Kazakhstan in order to increase the effectiveness of combating international criminal offenses, as well as to organize interaction on issues defined by international treaties of the Republic of Kazakhstan;
8) delegates powers to his deputies, heads and officials of departments, structural divisions, territorial bodies and subordinate organizations of the National Security Committee;
9) appoints and dismisses the heads of structural divisions of the National Security Committee, departments of the National Security Committee for regions, cities of republican significance and the capital and other bodies of the National Security Committee in accordance with the procedure determined by the President of the Republic of Kazakhstan, and also establishes the procedure for the appointment and dismissal of individual officials of national security bodies;
10) approves the nomenclature of positions, the list of positions filled by employees and military personnel, with the exception of senior officers, employees, and also determines the number of employees and military personnel of the active reserve;
11) confers the first special or military rank of an officer and the rank of "colonel" ("captain of the first rank"), and as a reward – an extraordinary special or military rank ahead of schedule and one step higher than the special or military rank prescribed by the position, in accordance with the procedure established by the legislation of the Republic of Kazakhstan;
12) resolves issues related to the replacement of positions in government agencies and organizations of employees and military personnel of the active reserve of national security agencies in coordination with their leadership.;
13) centralizes and distributes the budget funds provided for the maintenance of national security agencies within the approved funding plans;
14) encourages and disciplines employees, military personnel, and employees of the National Security Committee and its subordinate bodies.;
15) encourages citizens of the Republic of Kazakhstan, foreigners and stateless persons for their contribution to ensuring the national security of the Republic of Kazakhstan, as well as strengthening cooperation between the special services of foreign states;
16) submits proposals to the President of the Republic of Kazakhstan on awarding higher special or military ranks and awarding employees, military personnel and employees of national security agencies with state awards, as well as on awarding honorary titles;
17) awards departmental awards to employees, military personnel and employees of national security agencies;
18) classifies a unit of the national security agency as other troops and military formations;
19) enlists candidates, conscripts with higher or secondary specialized education, and those who are liable for military service in the reserve with their removal from military registration, appoints, dismisses and dismisses them from service, assigns special or military ranks and moves them to positions in accordance with the procedure established by the legislation of the Republic of Kazakhstan.;
20) seconds employees and military personnel of national security agencies to state bodies and other organizations of the Republic of Kazakhstan in coordination with their first leaders, unless otherwise provided by laws, as well as to international organizations on the basis of international treaties of the Republic of Kazakhstan;
21) provides access to state secrets in the scope of training programs at training, retraining and advanced training courses for national security agencies, as well as in the scope of training programs at training, retraining and advanced training courses for special and other bodies of foreign states in accordance with international treaties of the Republic of Kazakhstan, as well as government agencies of the Republic of Kazakhstan Kazakhstan;
22) takes measures to combat corruption in the national security agencies and bears personal responsibility for this.
23) determines, in coordination with the central authorized body for budget planning, the norms of food rations for certain categories of employees of national security agencies, taking into account the specifics of their service;
24) determines the procedure for applying incentives to employees of national security agencies;
25) determines the procedure for reimbursement of expenses related to the preparation for transportation of the body, transportation of the body, burial of employees of national security agencies who died while serving or died as a result of mutilation (wounds, injuries, contusions), illness, manufacture and installation of a tombstone;
26) determines the procedure for the gratuitous temporary transfer of buildings, canteen premises and the property located in them to property lease (lease) within the term of the catering agreement;
27) determines the procedure for providing meals to certain categories of employees of national security agencies;
28) determines the procedure for payment of monetary compensation in the absence of the possibility of providing food according to the established norms of food rations to certain categories of employees of national security agencies.;
28-1) determines the procedure for issuing referrals to employees of national security agencies (except cadets, trainees) who are entitled to reimbursement for transportation costs across the territory of the Republic of Kazakhstan when traveling for medical examination (examination) and back.;
29) determines the procedure for conducting special inspections of employees and military personnel of national security agencies.
The powers of the Chairman of the National Security Committee during his absence are carried out by the person replacing him, in accordance with the current legislation.

20. The Chairman of the National Security Committee determines the powers of his deputies in accordance with the current legislation.
Chapter 4. Property of the state body
21. The National Security Committee may have separate property on the right of operational management in cases provided for by law.
The property of the National Security Committee is formed at the expense of property transferred to it by the owner, as well as property (including monetary income) acquired as a result of its own activities and other sources not prohibited by the legislation of the Republic of Kazakhstan.
22. The property assigned to the National Security Committee belongs to republican ownership.
23. The National Security Committee does not have the right to independently alienate or otherwise dispose of the property assigned to it and property acquired at the expense of funds provided to it under the financing plan, unless otherwise established by law.
Chapter 5. Reorganization and abolition of the state body
24. The reorganization and abolition of the National Security Committee are carried out in accordance with the legislation of the Republic of Kazakhstan.
