In accordance with subparagraph 5) of paragraph 2 of Article 4 of the Law of the Republic of Kazakhstan dated July 13, 1999 "On Combating Terrorism"
I DECREE:
1. To approve the attached Regulations on the republican, regional, city of republican significance, capital, district (city of regional significance) and maritime operational headquarters for combating terrorism.

2. This Decree shall enter into force from the date of signing.

Regulations on the republican, regional, city of republican significance, capital, district (city of regional significance) and maritime operational headquarters for combating terrorism

1. General provisions
1. The operational headquarters for combating terrorism are permanent operational management bodies for the forces and means of government agencies involved in the anti-terrorist operation.
2. The Republican operational headquarters for combating terrorism operates at the republican level.
3. In the administrative-territorial units of the Republic of Kazakhstan, there are regional, cities of republican significance, the capital, and district (cities of regional significance) operational headquarters for combating terrorism, subordinate in their activities to the republican operational headquarters for combating terrorism.

3-1. For the timely response and suppression of acts of terrorism committed against objects of maritime economic activity located on the continental shelf or offshore navigation facilities, a permanent maritime operational headquarters for combating terrorism is being established.

4. The legal basis for the activities of republican, regional, city of republican significance, capital, district (city of regional significance) and marine operational headquarters for combating terrorism is the Constitution of the Republic of Kazakhstan, constitutional laws, laws, acts of the President of the Republic of Kazakhstan and other regulatory legal acts, as well as this Regulation.

2. The main tasks, functions and powers of the republican, regional, city of republican significance, capital, district (city of regional significance) and marine operational headquarters for combating terrorism

5. The main tasks of the republican, regional, city of republican significance, capital, district (city of regional significance) and marine operational headquarters for combating terrorism are:
1) creating conditions for maintaining and developing the readiness of forces and means to conduct an anti-terrorist operation;
2) preparation and conduct of an anti-terrorist operation to suppress an act of terrorism, minimize and (or) eliminate its consequences by providing emergency medical care, medical and psychological support, emergency rescue and other urgent work, as well as ensuring the safety of protected persons.

6. In accordance with the main tasks, the republican, regional, cities of republican significance, the capital, the district (cities of regional significance) and the maritime operational headquarters for combating terrorism are assigned the following functions:
1) development of measures aimed at improving the effectiveness of the activities and interaction of state bodies and local governments to curb acts of terrorism;
2) preparation and conduct of anti-terrorist exercises, trainings and experiments to work out the practical application of the forces and means of government agencies;
3) organization of the collection and analysis of information necessary to assess the readiness of forces and means to respond to terrorist manifestations;
4) working out a decision on the procedure for conducting an anti-terrorist operation in the territory of the region, the city of republican significance, the capital, the district (city of regional significance) and the sea area, including the introduction of a legal regime for anti-terrorist operations for the period of its conduct;
5) managing the preparation and conduct of an anti-terrorist operation in the territory of the region, the city of republican significance, the capital, the district (city of regional significance) and the sea area.

7. Republican, regional, city of republican significance, capital, district (city of regional significance) and maritime operational headquarters for combating terrorism have the right:
1) request from state and local government bodies, officials and organizations the necessary information, documents and materials in the field of countering terrorism;
2) involve the forces and means of central and local executive bodies necessary to prevent, minimize and (or) eliminate the consequences of an act of terrorism in conducting an anti-terrorist operation.;
3) involve special forces units of foreign states in accordance with the requirements of international treaties ratified by the Republic of Kazakhstan;
4) to interact, within the limits of their competence, with state and local government bodies, organizations and individuals on the issues of responding to terrorist manifestations;
5) determine the list of measures taken and time limits for the period of the anti-terrorist operation in accordance with Article 15-1 of the Law of the Republic of Kazakhstan dated July 13, 1999 "On Combating Terrorism".

3. Composition of republican, regional, city of republican significance, capital, district (city of regional significance) and marine operational headquarters for combating terrorism

9. The Head of the Republican operational headquarters for combating terrorism is the Chairman of the National Security Committee of the Republic of Kazakhstan.
When conducting an anti-terrorist operation to ensure the safety of protected persons, the republican operational headquarters for combating terrorism is managed by the Head of the State Security Service of the Republic of Kazakhstan. In this case, the Chairman of the National Security Committee of the Republic of Kazakhstan becomes his first deputy.

10. The permanent members of the Republican operational headquarters for combating terrorism are:
1) The Minister of Internal Affairs of the Republic of Kazakhstan (Deputy Head);
2) Chief of Staff of the Anti-Terrorist Center of the National Security Committee of the Republic of Kazakhstan (Deputy Head);
3) Minister of Defense of the Republic of Kazakhstan;
4) Head of the State Security Service of the Republic of Kazakhstan;
5) Minister of Artificial Intelligence and Digital Development of the Republic of Kazakhstan;
6) Minister of Transport of the Republic of Kazakhstan;
7) Minister of Culture and Information of the Republic of Kazakhstan;
8) Minister of Industry and Construction of the Republic of Kazakhstan;
9) Minister of Emergency Situations of the Republic of Kazakhstan.
By the decision of the head of the republican operational headquarters for combating terrorism, heads of other government agencies may be included in the headquarters.

11. The decisions of the republican operational headquarters for combating terrorism, adopted in accordance with its competence, are mandatory for all government agencies whose representatives are part of it and the regional, city of republican significance, capital, district (city of regional significance) and marine operational headquarters for combating terrorism.

12. The heads of the territorial bodies of the National Security Committee of the Republic of Kazakhstan manage the activities of the operational headquarters for combating terrorism in the region, the city of republican significance, the capital, and the district (city of regional significance).
The head of the maritime operational headquarters for combating terrorism is the head of the association (regional department) of the Border Service of the National Security Committee of the Republic of Kazakhstan, which protects the State border of the Republic of Kazakhstan and monitors compliance with established regimes in the border area of the Republic of Kazakhstan on the Caspian Sea.
The First Deputy Head of the Maritime Operational Headquarters for combating terrorism is the head of the territorial body of the National Security Committee of the Republic of Kazakhstan.
When conducting an anti-terrorist operation to ensure the safety of protected persons, the head of the regional, city of republican significance, capital, district (city of regional significance) operational headquarters for combating terrorism is appointed by the Head of the State Security Service of the Republic of Kazakhstan from among representatives of state bodies that are part of the republican operational headquarters for combating terrorism, or their territorial divisions.
The deputy head of the regional, district (city of regional significance) operational headquarters for combating terrorism during an anti-terrorist operation aimed at ensuring the safety of protected persons is a senior official of the State Security Service of the Republic of Kazakhstan accompanying the protected person.

13. The permanent members of the regional, city of republican significance, capital, district (city of regional significance) and marine operational headquarters for combating terrorism are:
1) Head of the territorial division of the internal affairs bodies of the Republic of Kazakhstan (Deputy Chief of Staff);
2) head of the territorial division of the department of the authorized body in the field of civil protection of the Republic of Kazakhstan;
3) the head of the garrison of the Armed Forces of the Republic of Kazakhstan in accordance with the decision of the higher command;
4) commander of the military unit of the National Guard of the Republic of Kazakhstan;
5) first deputy akim of the region, city of republican significance, capital, district (city of regional significance).
By decision of the head of the operational headquarters for combating terrorism, heads of other government agencies may be included in its composition.

14. The decisions of the operational headquarters for combating terrorism of the region, the city of republican significance, the capital, the district (city of regional significance) and the maritime, adopted in accordance with their competence, are mandatory for all government agencies whose representatives are part of them.

15. The republican, regional, cities of republican significance, the capital, the district (cities of regional significance) and the maritime operational headquarters for combating terrorism are convened by their heads to work out issues of coordination, improve interaction, conduct anti-terrorist exercises and training provided for in its work plans.
Decisions taken by the republican, regional, city of republican significance, capital, district (city of regional significance) and maritime operational headquarters for combating terrorism are formalized in the form of protocols, which are signed by the head of the operational headquarters for combating terrorism. Decisions taken during the anti-terrorist operation are signed by all members of the operational headquarters for combating terrorism.

16. The composition of the forces and means of the operational headquarters for combating terrorism, the procedure for forming operational groups, and a detailed list of their actions during the preparation and conduct of an anti-terrorist operation are determined by joint regulatory legal acts of the National Security Committee, the Ministry of Internal Affairs, the State Security Service, the Ministry of Defense of the Republic of Kazakhstan, as well as other government agencies involved within their competence. in countering terrorism.

4. Organization of activities of republican, regional, city of republican significance, capital, district (city of regional significance) and marine operational headquarters for combating terrorism

17. In order to increase the effectiveness of interaction between the forces and means of government agencies involved in conducting an anti-terrorist operation, the head of the republican, regional, city of republican significance, capital, district (city of regional significance) and the naval operational headquarters for combating terrorism approves a standard interdepartmental plan for conducting an anti-terrorist operation. The plan provides for:
1) the calculation of the forces and means involved, the name, number, deployment, armament and technical equipment of the operational groups, their leaders are appointed;
2) the notification scheme for participants in the anti-terrorist operation, the initial location of the gathering and deployment of the operational headquarters and its operational groups;
3) the degree of participation of other state bodies in the anti-terrorist operation;
4) the general mechanism for preparing and conducting an anti-terrorist operation.
The activities of the plan are worked out by conducting multi-level anti-terrorist exercises, trainings and experiments, the organization and implementation of which are regulated by a joint order of the National Security Committee, the Ministry of Internal Affairs, the State Security Service and the Ministry of Defense of the Republic of Kazakhstan, as well as other government agencies involved within their competence in countering terrorism.

18. Depending on the scale and degree of public danger and the expected negative consequences of an act of terrorism, the anti-terrorist operation is led by the head of the republican, regional, city of republican significance, capital, district (city of regional significance) and the naval operational headquarters for combating terrorism.
The management of the anti-terrorist operation in the area (city of regional significance) after the arrival and deployment of the forces and means of the regional operational headquarters for combating terrorism is carried out by the head of the higher operational headquarters for combating terrorism.

19. When conducting an anti-terrorist operation, the republican operational headquarters for combating terrorism starts its working group.
The working group includes heads of structural divisions of government agencies. The group is led by the head of the working body of the Anti-Terrorist Center of the Republic of Kazakhstan. When conducting an anti-terrorist operation to ensure the safety of protected persons, the head of the working group is appointed by a person from among the heads of structural divisions of the State Security Service of the Republic of Kazakhstan. The Working Group analyzes the operational situation related to the preparation or commission of an act of terrorism, predicts its further development, and develops management decisions.

20. Regional, republican cities, capitals, district (cities of regional significance) and naval operational headquarters for combating terrorism conduct an anti-terrorist operation in coordination with the head of the republican operational headquarters for combating terrorism.

21. The head of the republican, regional, city of republican significance, capital, district (city of regional significance) and the maritime operational headquarters for combating terrorism from the beginning of the anti-terrorist operation until its completion becomes the head and chief for all military personnel, employees and specialists of government agencies of the Republic of Kazakhstan involved in its conduct.
In accordance with international treaties ratified by the Republic of Kazakhstan, the head of the republican, regional, city of republican significance, capital, district (city of regional significance) and the maritime operational headquarters for combating terrorism becomes the head for specialists of special forces units of foreign countries involved in the anti-terrorist operation.

22. Unlawful interference by another official, regardless of his position, in the operational management of an anti-terrorist operation is not allowed.
23. Regional (cities of regional significance) operational headquarters for combating terrorism conduct an anti-terrorist operation as part of priority measures until the arrival and deployment of forces and means of the regional operational headquarters for combating terrorism. The further conduct of the anti-terrorist operation is carried out by the head of the higher operational headquarters for combating terrorism, who issues an appropriate order.
In case of impossibility of timely arrival of the regional operational headquarters for combating terrorism, its head, in coordination with the republican operational headquarters for combating terrorism, directs the forces and means of the operational headquarters for combating terrorism of the capital, the city of republican significance, the district (city of regional significance) bordering the administrative-territorial unit in which the anti-terrorist operation is conducted.

24. When measures are put into effect according to the plan for conducting an anti-terrorist operation by the regional, city of republican significance, capital, district (city of regional significance) and maritime operational headquarters for combating terrorism, the working body of the Anti-Terrorist Center of the Republic of Kazakhstan begins to operate in order to coordinate.

25. The head of the republican, regional, city of republican significance, the capital, the district (city of regional significance) and the naval operational headquarters for combating terrorism issues orders during the anti-terrorist operation:
1) on the announcement of the beginning and end of the anti-terrorist operation, the determination of the personnel of the republican, regional, city of republican significance, capital, district (city of regional significance) and marine operational headquarters for combating terrorism and operational groups involved in accordance with the standard plan of the anti-terrorist operation, on the limits of the use of the assigned forces and means, as well as on the procedure for the use of weapons in accordance with the legislation of the Republic of Kazakhstan;
2) on determining the area of the anti-terrorist operation;
3) on the introduction, if necessary, of the legal regime of the anti-terrorist operation for the period of its implementation, in accordance with Article 15 of the Law of the Republic of Kazakhstan dated July 13, 1999 "On Combating Terrorism";
4) on conducting an operation to free hostages and neutralize terrorists. In the case of joint operational and combat use of several special forces units of various law enforcement agencies, appoints one of the heads of special forces units as the commander of the combined tactical group.

26. To fulfill the assigned tasks, the forces and means of government agencies involved in the republican, regional, cities of republican significance, the capital, district (cities of regional significance) and maritime operational headquarters for combating terrorism are equipped with the necessary material and technical means according to the standards approved by the central state body in coordination with the central authorized body for budget planning.

27. Logistical support for the organizational activities of the republican, regional, city of republican significance, capital, district (city of regional significance) and marine operational headquarters for combating terrorism is provided at the expense of government agencies, their territorial divisions and subordinate government agencies, whose officials are included in the relevant operational headquarters for combating terrorism.

28. Organizational and information and analytical support for the activities of the republican, regional, city of republican significance, capital, district (city of regional significance) and marine operational headquarters for combating terrorism is carried out by the working body of the Anti-Terrorist Center of the Republic of Kazakhstan, the territorial bodies of the National Security Committee of the Republic of Kazakhstan and the Border Guard Service association of the National Security Committee of the Republic of Kazakhstan.
