On Approval of the Requirements for the development or adjustment of the economic opinion of the central authorized body for budgetary policy and the sectoral opinion of the central authorized body of the relevant industry for the provision of state guarantees to support private entrepreneurship

  In accordance with paragraph 4 of Article 144-1 of the Budget Code of the Republic of Kazakhstan, I ORDER:

     1. To approve the attached Requirements for the development or correction of the economic opinion of the central authorized body for budgetary policy and the sectoral opinion of the central authorized body of the relevant industry for the provision of state guarantees to support private entrepreneurship.

     2. The Department of State Support and Protection of Entrepreneurship of the Ministry of National Economy of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan and its posting on the Internet resource of the Ministry of National Economy of the Republic of Kazakhstan after the day of its first official publication.

     3. Control over the execution of this order is entrusted to the supervising Vice Minister of National Economy of the Republic of Kazakhstan.

     4. This order will enter into force on July 12, 2026 and is subject to official publication.

Requirements for the development or adjustment of the economic opinion of the central authorized body for budgetary policy and the sectoral opinion of the central authorized body of the relevant industry for the provision of state guarantees to support private entrepreneurship

Chapter 1. General provisions

     1. These Requirements apply to the development or adjustment of the economic opinion of the central authorized body for budgetary policy and the sectoral opinion of the central authorized body of the relevant industry for the provision of state guarantees to support private entrepreneurship (hereinafter referred to as – Requirements) have been developed in accordance with paragraph 4 of Article 144-1 of the Budget Code of the Republic of Kazakhstan and define the requirements for the development or adjustment of the economic opinion of the central authorized body for budgetary policy and the sectoral opinion of the central authorized body of the relevant industry for the provision of state guarantees to support private entrepreneurship.

     2. The following basic concepts are used in these Requirements:

     1) the state guarantee of the Republic of Kazakhstan for the support of private entrepreneurship (hereinafter referred to as the state guarantee) – the obligation of the Government of the Republic of Kazakhstan to the special fund for the development of entrepreneurship in accordance with the terms of the guarantee agreement for the support of private entrepreneurship to fully or partially repay the amount of its debt to financial and other organizations if the funds of the special fund for the development of entrepreneurship are insufficient to fulfill obligations under the guarantees provided to them for investment projects with a financing amount of over seven billion tenge;

     2) the economic opinion of the central authorized body for budgetary policy for the provision of a state guarantee to support private entrepreneurship (hereinafter referred to as the economic opinion) – the conclusion of the central authorized body for budgetary policy on the expediency of providing a state guarantee to support private entrepreneurship (its impact on the country's economy and compliance with strategic and (or) program documents, prepared on the basis of a positive industry opinion of the authorized body of the relevant industry) to the special entrepreneurship development fund;

     3) industry opinion of the authorized body of the relevant industry (hereinafter referred to as the industry opinion) is the conclusion of the authorized body of the relevant industry on compliance with the priorities of the industry development by providing a state guarantee for the support of private entrepreneurship to the relevant special entrepreneurship development fund applying for a state guarantee for the support of private entrepreneurship.

Chapter 2. Requirements for the development or correction of the economic opinion of the central authorized body for budgetary policy and the sectoral opinion of the central authorized body of the relevant industry for the provision of state guarantees to support private entrepreneurship

     3. The economic conclusion is developed on the basis of the following documents submitted by the special fund for the development of entrepreneurship to the authorized body for budgetary policy on paper and electronic media with an attachment:

     1) information on the state guarantee, which contains the amount of the state guarantee, its validity period, the institutional scheme for the use of the state guarantee (information about all participants in the process, their interaction);

     2) information about the special entrepreneurship development fund, which contains copies of the founding documents, as well as documents confirming the status of the special entrepreneurship development fund, the company's development strategy, and the rating report;

     3) a positive conclusion of the authorized body of the relevant industry, which contains the positive results of evaluating the following information:

     the possibility and expediency of providing such a measure of state support to private entrepreneurship;

     the state of the industry and the problems that affect its development;

     compliance with the objectives of providing a state guarantee to support private entrepreneurship and solve existing problems in the industry;

     the validity of providing a state guarantee to support private entrepreneurship to a special entrepreneurship development fund, and the expected effect in the supervised industry and related sectors (spheres) of the economy (the main participants, the scheme of their interaction, the scheme of using and refunding funds diverted to fulfill obligations under the state guarantee to support private entrepreneurship);

     anticipated risks that may require fulfillment of obligations under the state guarantee to support private entrepreneurship (insurance, political, financial stability risks) and measures to minimize them;

     compliance of the activities carried out by the special fund for the development of entrepreneurship with the objectives of the documents of the State Planning System of the Republic of Kazakhstan, including the needs for the provision of services in the relevant industry, as well as the expected end result from the provision of a state guarantee to support private entrepreneurship, compliance with the provision of a state guarantee to support private entrepreneurship instructions or acts of the President of the Republic of Kazakhstan, the Government of the Republic of Kazakhstan;

     the validity of the size and duration of the state guarantee for the support of private entrepreneurship;

     distribution of benefits from the application of the state guarantee to support private entrepreneurship;

     the expected multiplier effect of the application of the state guarantee to support private entrepreneurship in related sectors (spheres) of the economy.

     The industry opinion is signed by the first head of the authorized body or a person acting in his place.

     4. The Central authorized Body for Budgetary Policy, no later than 30 (thirty) business days from the date of submission by the special fund for the development of entrepreneurship to the authorized body for budgetary policy of the documents specified in paragraph 3 of these Requirements, prepares an opinion for the provision of state guarantees to support private entrepreneurship in accordance with the Annex to these Requirements, which contains:

     analysis of the availability of submitted documentation provided for in paragraph 3 of these Requirements;

     analysis of the justification for granting a state guarantee to the relevant special fund for the development of entrepreneurship (according to the conclusion of the authorized body of the relevant industry);

     analysis of compliance with documents of the State Planning System;

     conclusions and recommendations.

     5. In the event that within 3 (three) The central authorized body for budgetary policy has not issued a state guarantee to the special fund for the development of entrepreneurship for several years after the provision of the conclusion, and this conclusion is subject to correction.

     6. In case of correction of the economic conclusion, the special fund for the development of entrepreneurship submits documents to the authorized body for budgetary policy in accordance with paragraph 3 of these Requirements.

     At the same time, the correction of the economic conclusion by the central authorized body for budgetary policy is carried out no later than 30 (thirty) working days from the date of submission of the documents by the special fund for business development to the authorized body for budgetary policy.
