On approval of the Rules for Assigning Diplomatic Ranks

In accordance with Article 11 of the Law of the Republic of Kazakhstan dated March 7, 2002 "On the Diplomatic Service of the Republic of Kazakhstan", I decree:
1. To approve the attached Rules for Assigning Diplomatic Ranks.

2. This Decree comes into force from the date of signing.

Rules for assigning diplomatic ranks

1. General provisions
1. These Rules apply in accordance with the Law of the Republic of Kazakhstan dated March 7, 2002 "On the Diplomatic Service of the Republic of Kazakhstan" and regulate the procedure for awarding diplomatic ranks to employees of the diplomatic service of the Republic of Kazakhstan (hereinafter referred to as employees).

2. The procedure for assigning diplomatic ranks
2. Employees are assigned the following diplomatic ranks:
1) attache;
2) the third secretary;
3) Second secretary of the II class;
4) Second secretary of the first class;
5) First secretary of the II class;
6) First secretary of the first class;
7) adviser of the II class;
8) advisor of the first class;
9) Envoy Extraordinary and Plenipotentiary of the II class;
10) Envoy Extraordinary and Plenipotentiary of the First class;
11) Ambassador Extraordinary and Plenipotentiary.
3. The diplomatic ranks of Ambassador Extraordinary and Plenipotentiary, Envoy Extraordinary and Plenipotentiary of Classes I and II are assigned by the President of the Republic of Kazakhstan on the recommendation of the Minister of Foreign Affairs of the Republic of Kazakhstan.
The submission for the assignment of the above-mentioned diplomatic ranks is submitted by the Minister of Foreign Affairs of the Republic of Kazakhstan to the President of the Republic of Kazakhstan, taking into account the effectiveness of participation in the implementation of the foreign policy of the Republic of Kazakhstan and the effectiveness of participation in the implementation of foreign policy initiatives of the President of the Republic of Kazakhstan.
The diplomatic rank of Ambassador Extraordinary and Plenipotentiary may be awarded to employees of the diplomatic service who have at least two years of diplomatic service experience as Ambassador Extraordinary and Plenipotentiary of the Republic of Kazakhstan, Permanent Representative of the Republic of Kazakhstan to an international organization.
The diplomatic rank of Envoy Extraordinary and Plenipotentiary of the First class may be awarded to diplomatic service personnel holding the position of Minister of Foreign Affairs of the Republic of Kazakhstan, Ambassador Extraordinary and Plenipotentiary of the Republic of Kazakhstan, Permanent Representative of the Republic of Kazakhstan to an international organization, Deputy Minister of Foreign Affairs of the Republic of Kazakhstan.
The diplomatic rank of Envoy Extraordinary and Plenipotentiary of the II class may be awarded to employees of the diplomatic service who hold a position not lower than the Chairman of the Committee, Ambassador-at-Large of the Ministry of Foreign Affairs, Director of the Department, Charge d'affaires of the Republic of Kazakhstan, Consul General of the Republic of Kazakhstan.
Other diplomatic ranks are assigned by the Minister of Foreign Affairs of the Republic of Kazakhstan on the recommendation of the heads of foreign institutions or structural divisions of the Ministry of Foreign Affairs of the Republic of Kazakhstan.

4. The following terms of stay in diplomatic ranks are established for employees:
1) for attache, third secretary, second secretary of II and I classes - two years;
2) for the first secretary of the II and I classes, adviser of the II class - three years.
Terms of stay in diplomatic ranks from adviser of the first class and above are not established.
5. During the stay of employees in diplomatic ranks
are counted:
1) work in the Ministry of Foreign Affairs of the Republic of Kazakhstan and its subordinate organizations;
2) work in foreign institutions;
3) work in the representative offices of the Ministry of Foreign Affairs of the Republic of Kazakhstan in the territory of the Republic of Kazakhstan;
4) work in the Ministries of Foreign Affairs of the former USSR and the Union Republics;
5) work in international organizations;
6) scientific or teaching activities in higher educational institutions and scientific institutions of the Ministry of Foreign Affairs of the Republic of Kazakhstan;
7) advanced training through the Ministry of Foreign Affairs of the Republic of Kazakhstan in educational and scientific institutions;
8) studies temporarily sent by the Ministry of Foreign Affairs of the Republic of Kazakhstan to higher educational institutions, postgraduate studies, doctoral studies and scientific institutions.
6. The assignment of a diplomatic rank to an employee is carried out consistently with a positive characteristic, taking into account the position held, work experience and qualifications.
Diplomatic ranks are retained for life, with the exception of cases provided for in article 13 of the Law of the Republic of Kazakhstan "On the Diplomatic Service of the Republic of Kazakhstan".
7. Depending on the order of assignment, diplomatic ranks are divided into first and next.
8. The first diplomatic rank is awarded after holding a full-time diplomatic position in the bodies of the diplomatic service in accordance with the procedure established by law, taking into account knowledge, seniority and work experience in the specialty.
The diplomatic rank of an employee, as a rule, must correspond to the position of the diplomatic service.
9. The next diplomatic rank is awarded based on the position held, the time spent in the previous diplomatic rank, the characteristics and results of the last attestation of the employee.
10. The officials specified in paragraph 6 of paragraph 3 of these Rules are required to submit an employee for assignment of the next diplomatic rank no later than 1 (one) month before the expiration of the term of stay in the relevant diplomatic rank.

11. For non-fulfillment and improper fulfillment by an employee of the duties assigned to him, abuse of official authority, violation of official discipline, disciplinary action may be imposed on an employee in the form of a delay in awarding a diplomatic rank of up to one year.

12. The decision to impose a penalty in the form of a delay in awarding a diplomatic rank of up to one year is made in accordance with article 22 of the Law of the Republic of Kazakhstan "On the Diplomatic Service of the Republic of Kazakhstan".
13. The employee is reappointed for the assignment of the next diplomatic rank only after the delay period has expired.
14. The submission for the assignment of the next diplomatic ranks of employees who have disciplinary action or against whom an internal investigation is being conducted is not carried out, respectively, until the disciplinary action is lifted or until the end of the internal investigation.
15. The presentation of the assignment of diplomatic rank should reflect:
1) Education;
2) the previous diplomatic rank in case of assignment of the next diplomatic rank;
3) work experience in the diplomatic service;
4) assessment of professional activity, business, moral qualities of the employee.
3. Final provisions
16. The assignment of diplomatic ranks is confirmed by the issuance of appropriate certificates and an entry in the service record (employment record). When awarding the diplomatic rank of Ambassador Extraordinary and Plenipotentiary, along with the certificate, a badge "Tot zhane Okiletti Elshi" is issued in the form according to the appendix.
