On approval of the Rules for certification of a construction site
Order of the Acting Minister of Industry and Construction of the Republic of Kazakhstan dated April 22, 2026 No. 196. Registered with the Ministry of Justice of the Republic of Kazakhstan on April 23, 2026 No. 38527
In accordance with paragraph 3 of Article 128 of the Building Code of the Republic of Kazakhstan, I ORDER:
1. Approve the attached Rules for certification of the construction site.
2. The Committee on Construction and Housing and Communal Services of the Ministry of Industry and Construction of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:
1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) posting of this order on the official Internet resource of the Ministry of Industry and Construction of the Republic of Kazakhstan after its official publication.
3. Control over the execution of this order is entrusted to the supervising Vice Minister of Industry and Construction of the Republic of Kazakhstan.
4. This order will enter into force on July 1, 2026 and is subject to official publication.

Rules for certification of a construction site
Chapter 1. General provisions
1. These Rules for Certification of a Construction facility (hereinafter referred to as the Rules) have been developed in accordance with paragraph 3 of Article 128 of the Construction Code of the Republic of Kazakhstan (hereinafter referred to as the Code) and regulate the procedure for organizing and carrying out work on certification of construction facilities in settlements located in seismic areas (zones) of increased seismic hazard of the Republic of Kazakhstan.
2. The following concepts are used in these Rules:
1) seismic safety of buildings and structures is the ability of buildings and structures to withstand seismic impacts without damage and destruction that pose a direct threat to human safety. Earthquake-safe buildings may not have requirements for maintainability, the possibility of further operation, ensuring the safety of equipment, etc.;
2) earthquake resistance of buildings and structures – the ability of buildings and structures to withstand seismic impacts, while maintaining their operational qualities within the limits provided for by the provisions of current regulations;
3) seismicity of the construction site is the seismic hazard of the construction site, expressed in integer points on the scale of seismic intensity, predicted with a given probability of exceeding, taking into account the influence of local seismotectonic, engineering and geological conditions and topographic effects on the parameters of seismic impacts.;
4) certification of construction sites is a technical procedure for taking inventory of existing buildings in an urbanized area located in a seismically active zone, describing the design solution, physical and operational condition of the construction site and assessing their earthquake resistance and structural vulnerability during the inventory process;
5) the passport of a construction object is a document containing the identification, spatial planning, structural, technical and seismic characteristics of the object given in the Appendix to these Rules.;
6) specialized scientific research organizations – organizations whose field of activity is research in the field of earthquake-resistant construction, seismology and microseismozoning, which have the equipment and specialists necessary to carry out relevant theoretical and experimental work.;
7) seismic impact – ground movement caused by natural or man-made factors (earthquakes, explosions, traffic, industrial equipment operation), causing movement, deformation, damage or destruction of construction and natural objects;
8) seismic vulnerability – the degree of susceptibility of a building or structure to damage caused by a seismic impact of a given intensity;
9) seismic risk – the probability of socio-economic damage from possible earthquakes in accordance with the seismic hazard of the territories and the vulnerability of buildings and structures;
10) tectonic fault – ruptures, cracks in the Earth's crust formed during tectonic movements and deformations of rocks.
3. Certification of all buildings and structures is the main stage of work to ensure a socially necessary and economically feasible level of earthquake resistance of construction facilities.
4. These Rules apply to buildings and structures located in seismic zones, regardless of the form of ownership.
5. The main objectives of certification are:
1) determination of the actual earthquake resistance of construction sites;
2) identification of the most earthquake-prone objects that require priority measures to be taken on them, including strengthening, changing the purpose of the construction site or the level of its operation.
Chapter 2. Procedure for certification of a construction object
Paragraph 1. Certification of the construction site
6. Certification of the construction site is carried out in order to:
1) creating conditions for the sustainable functioning of the main social infrastructure facilities, life support systems and housing stock;
2) achieving an acceptable level of seismic safety of buildings and structures;
3) determining the need to implement primary measures to account for seismic risk;
4) prevention of socio–economic losses, to ensure safety and improve the quality of life of the population, sustainable socio–economic development;
5) reduction of possible economic, social and environmental damage from seismic impacts;
6) creating a risk map based on the materials of certification;
7) identification of seismically vulnerable facilities, in relation to which measures should first be developed to reduce the seismic risk of their further operation to an acceptable level.;
8) identification of the most earthquake-prone objects requiring priority reinforcement;
9) development of recommendations for further operation and (or) seismic enhancement of the construction site;
10) estimates of the expected degree of damage to buildings and structures, depending on their structural solutions, wear and tear, and seismic capacity at maximum seismic impacts.
11) assessment of economic and social damage from the effects of possible earthquakes, assessment of the economic costs of seismic reinforcement based on the degree of damage to buildings in possible estimated earthquakes.
7. Certification of the construction site is carried out in accordance with the certification agreement (hereinafter referred to as the agreement) in accordance with the technical specification from the Customer.
8. The customer, when engaging an accredited organization to carry out a technical inspection of the reliability and stability of buildings and structures, is guided by these Rules and state regulations of the Republic of Kazakhstan in the field of architecture, urban planning and construction, as well as the terms of the contract.
9. Certification of a construction site is carried out by conducting a preliminary visual inspection in order to obtain the complete information necessary to assess the seismic risks, earthquake resistance and structural vulnerability of the construction site, taking into account the actual condition of their structures, if certain signs (defects, wear) are identified, additional instrumental studies are assigned according to established criteria.
10. Preparatory stage:
1) collection and analysis of initial design and executive documentation;
2) determination of the spatial planning and structural scheme of the construction site;
3) determination of the seismicity of the construction site.
11. Object inspection:
1) conducting a visual inspection of load-bearing and enclosing structures;
2) identification of defects, damages and signs of reduced load-bearing capacity;
3) photofixation, general view of the building and structures;
4) filling out the passport in accordance with the Appendix to these Rules, which is signed by the executors of the organization that conducted the survey and translated into electronic format.
12. Engineering analysis:
1) analysis of the structural scheme of the construction site;
2) assessment of compliance of the actual condition with the requirements of standards on earthquake resistance;
3) determining the level of seismic vulnerability of the facility.
13. According to the results of the seismic vulnerability assessment of the construction site, in accordance with the requirements of regulatory and technical documents, the following are recognized:
1) Earthquake-resistant;
2) Not earthquake resistant.
14. Preparation of the report:
1) based on the results of the visual inspection and completed passports (Appendix to the Rules), a general scientific and technical report is prepared with an assessment of the seismic vulnerability of the surveyed objects.;
2) a report on direct economic damage and social losses caused by damage to buildings from predicted earthquakes with an estimate of the costs of seismic reinforcement.
15. The customers of the certification of the construction site are local executive authorities, and the contractor is determined on a competitive basis in accordance with the legislation of the Republic of Kazakhstan on public procurement.
16. The customer provides the organization with full technical assistance in carrying out the certification of the construction site.
17. The deadline for the completion of expert work on the certification of a construction site is determined by the contract.
Paragraph 2. Scientific and technical report on certification of the construction site
18. The scientific and technical report should contain:
1) title page (name of the contractor's organization, name of the facility, approved by whom, registration number);
2) content of the report;
3) Introduction;
4) general data (the basis for certification of the construction site (number and date of the contract, goals and objectives, relevance of the work);
5) methods of certification work;
6) seismic conditions of the area (seismic situation of the territory, earthquake survey);
7) engineering analysis of earthquake effects in the certification area;
8) general description of the site of the facilities (description of the site location, climatic conditions, engineering and geological conditions of the site);
9) spatial planning and design solutions (description of the adopted spatial planning and design solutions);
10) classification by building type (according to the design scheme, division into standard series, if available);
11) engineering analysis of all received data;
12) assessment of seismic vulnerability according to a constructive scheme;
13) assessment of direct economic damage and social losses caused by damage to buildings from predicted earthquakes with an estimate of the costs of seismic reinforcement.
14) withdrawal;
15) appendices (a list of objects of certification, an approved passport for the inspection of the object, photographic materials, completed passports of objects).
19. The scientific and technical report on the certification of a construction site, issued by the organization, is signed by all the performers who carried out the certification, and approved by the first head of the organization.
20. The scientific and technical report on the certification of a construction site is subject to review by all interested parties within 30 (thirty) calendar days, unless this document contains state-protected information constituting state and official secrets, the dissemination of which is limited by the state in accordance with the Law of the Republic of Kazakhstan "On State Secrets".
21. The scientific and technical report on the certification of a construction site may be appealed by interested parties in accordance with the procedure and within the time limits provided for by the Administrative Procedural Code of the Republic of Kazakhstan.
