On approval of the Rules for determining the cost of work on conducting a comprehensive non-departmental expert examination of construction projects, as well as a comprehensive urban planning expert examination of urban development projects

In accordance with subparagraph 27) of Article 24 of the Building Code of the Republic of Kazakhstan, I ORDER:

     1. Approve:

     1) Rules for determining the cost of work on conducting a comprehensive non-departmental expert examination of construction projects, as well as a comprehensive urban planning expert examination of urban development projects, in accordance with Appendix 1 to this order;

     2) A list of certain orders that have become invalid, in accordance with Appendix 2 to this order.

     2. The Committee on Construction and Housing and Communal Services of the Ministry of Industry and Construction of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:

     1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

     2) posting of this order on the Internet resource of the Ministry of Industry and Construction of the Republic of Kazakhstan after its official publication.

     3. Control over the execution of this order is entrusted to the supervising Vice Minister of Industry and Construction of the Republic of Kazakhstan.

     4. This order will enter into force on July 1, 2026 and is subject to official publication.

Rules for determining the cost of work on conducting a comprehensive non-departmental expert examination of construction projects, as well as a comprehensive urban planning expert examination of urban development projects

Chapter 1. General provisions

     1. The rules for determining the cost of work on conducting a comprehensive non–departmental expert examination of construction projects, as well as a comprehensive urban planning expert examination of urban development projects (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 27) of Article 24 of the Building Code of the Republic of Kazakhstan (hereinafter referred to as the Code).

     2. These Rules are intended to determine the cost of carrying out:

     1) comprehensive non-departmental expertise of construction projects;

     2) comprehensive urban planning expertise of urban development projects.

     3. The following basic concepts are used in these Rules:

     1) state expert organization is a legal entity established by decision of the Government of the Republic of Kazakhstan in the organizational and legal form of a republican state enterprise on the right of economic management and carrying out project expertise activities attributed to the state monopoly, as well as carrying out other activities provided for by the laws of the Republic of Kazakhstan;

     2) an expert organization is a legal entity accredited in accordance with the procedure established by the Code, which carries out a comprehensive non–departmental expert examination of construction projects that are not classified by the legislation of the Republic of Kazakhstan as a state monopoly.;

     3) expert work – work on the examination of project documentation, technical supervision and technical inspection of the reliability and stability of buildings and structures.

     4. The cost of expert work performed by a state expert organization, regardless of the source of funding, is established in accordance with these Rules.

     5. The cost of expert work performed by expert organizations is established in accordance with these Rules and (or) in the contract between the customer and the expert organization.

Chapter 2. Determining the cost of work on conducting a comprehensive non-departmental expert examination of construction projects, as well as a comprehensive urban planning expert examination of urban development projects

     6. The cost of conducting a comprehensive non-departmental expert examination of construction projects and a comprehensive urban planning expert examination of urban projects is determined by the formula:

     where:

     SE – the cost of a comprehensive non-departmental expert examination of a construction project or a comprehensive urban planning expert examination of urban development projects;

     JV is the standard cost of design and survey work (hereinafter referred to as PIR) for the development of construction projects or urban development projects, determined in accordance with the state regulatory document on pricing in construction;

     MPE is the value of the monthly calculation index as of the date of registration of a construction project or urban development project on the portal for organizing the development and examination of projects based on the "one–stop shop" principle;

     MCI is the value of the monthly calculation index as of the date of determining the cost of the PIR;

     keV is the coefficient of expert verification, which determines the ratio of the cost of expert work to the cost of the PIR, determined in accordance with the appendix to these Rules.

     7. If, under the contract for the examination of projects, only a part of the sections of construction projects or urban planning projects is subject to consideration, the cost of those sections that are not subject to the examination of projects is excluded from the cost of the PIR, when substituting it into the formula of paragraph 6 of these Rules.

     The standard cost of individual sections of construction projects or urban development projects is determined according to the relative indicators of the distribution of project costs across their sections, given in the state regulatory document on pricing in construction.

     8. If there are no indicators of the standard cost of construction projects or urban planning projects in state regulatory documents, the cost of project expertise is determined by a separate calculation, making estimates (calculations) for the planned labor costs of experts in the field of design.

     9. In cases of early termination of expert work on complex non-departmental expertise of construction projects and complex urban planning expertise of urban projects, The cost of expert work performed is determined by dividing the total cost of expert work by the number of working days of the standard duration of the examination established by the contract (excluding the standard time limit for eliminating expert comments) and multiplying by the number of working days from the date of commencement of expert work to the date of termination of expert work (excluding the standard time limit for eliminating expert comments).

     1. When using this table (compared with column 1), the cost of the PIR and the value of the monthly calculation index through which it is expressed are assumed to be current prices at the date of determining the cost of the PIR.
